A proposed eight s±ory. 17 unit, multi-family resi�3sntial
buildinQ.
Tom, the Community Appearance Board reviewed the above referenced
project on March 30, 1994
The following concerns were expressed by the Board regarding this
proposed project:
i. that the project needed taller palms on the south side to
buffer the buildinq;
2. that a landscape berm should be installed along the front
propertp lins at the road right-of-way and on both sides
of the entrance drive;
3. that ths gigeon plum should be chanqed out to Ligustrum
trees;
4. that an additional Liqustrum tree should be glanted in the
parking island under the Sabal palms;
5. that the proposed building was not of a Mediterranean.
Spanish or Key West style; and
6. that the overhead qaraqe doors on the front of the
building needed to be hiqh quality and be buffered from
view.
Motion to approve the proposed pra�ect subject to the followinq
changes to the landscape plan:
1. with Sabal or cocoanut palms alonq the 6outh property
1 ine;
2. addinq a landscape berm alonq the street riqht-of-way on
both sides of the entrance drive;

Building Official Comments: This proposed pro7ect is Phase I of a
two phase project. Only Phase I is being rQViewed for approval at
this time. Phase II, the progosed five unit townhome phase is being
contpstRd by certain individuals and associations on �each Road and
is currently in litigation. Phase I, tha eiqht story. 17 unit multi-
family residential building can be built as a stand alone pro7ect.
with or without Phase II, the townhomes. �ver beinq constructed.
Staff recommends approval af Phase I only at this time.

An eight story multi—family residential building.
This letter is to confirm the action of the Village of Tequesta
Community Appearance Board at the March 30, 1994 meeting approving
your application for the above referenced project as submitted and
sub�ect to the following changes to the landscape plans:
o with sabal or coconut palms alonq the south property line;
o adding a landscape berm along the street right—of—way on both
sides of the entrance drive;
o changing the pigeon plum to liqustrum trees; and
o adding one ligustrum in the parking island undernsath the
sabal palms. ________ _ ___ __.______
As you are aware, this proposed pro7ect must be reviewed by the
Village Council at Site Plan Review. Opon receipt of fifteen sets of
the revised landscape glans, by noon on Tuesday. April 5, 1994, the
above referenced pro�ect can be placed on the aqenda of the Council
meeting scheduled for Thursday, April 14, 1994, beginninq at 7:00 P.M.
in the Villaqe Hall. 357 Teqvesta Drive, Tequesta. You and/or your
representative must be in attendance at this meeting to present your
application and answer any questions the Council may have. If a
representative is not,present, the Council will withhold action until
a later date. '
This approval has no bearing or relationship to any other approvals or
permits which may be required. Please f eel free to contact the
Department of Community Development should you have any questions
reqardinq this matter.

I. CALL TO ORDER AND ROLL CALL
The Tequesta Community Appearance Board held a regularly
scheduled meeting at the Village Ha11, 357 Tequesta Drive,
Tequesta, Florida, on Wednesday, March 30, 1994. The meeting
was called to order by Chairwoman Leslie Cook at 9:35 A.M.
Community Appearance Board members present were: Paul Coben,
Ruth Maitland, Claudette Dalack, Stephen Parker, sitting in as
a Regular Member of the Board, and Scott D. Ladd, Clerk of the
Board.
II. APPROVAL OF AGENDA
The Agenda was approved as submitted.
III. APPROVAL OF PREVIOUS MINUTES
The recording secretary noted the changes to be made to the
March 2, 1994 minutes as specified by Boardmember Coben.
IV. NEW BUSINESS
1) An application from Jupiter Island Corporation, R. Mason
Simpson, agent, for the construction of an eiqht story
multi-family residential buildinq (Phase I), and five
four story townhomes ( Phase II ), to be known as Cliveden,
425 Beach Road, Tequesta.
Mason Simpson referred the Board to the color version of the
building explaining that it is eight stories of apartment
units, with one level of parking, etc., and described the
various areas of parking, lobby, privacy wall along south side
of property, and pool. There will be 16 covered and 16 open
parking spaces. He indicated the building meets all set-backs
and that there are no variances required.
Mr. Simpson briefly described the Phase II townhomes, and that
that portion of the project is currently in litigation, and
will not be addressed until it is resolved.

Boardmember Dalack did not like the contemporary design of the
building and prefers the Key West or Bermuda look. Mr.
Simpson explained some of the architectural details of the
building. Boardmember Maitland said that she was very
impressed with the building, and that it fits in perfectly
with what is on the island. Boardmember Maitland said that
while it is true that in Tequesta, they want the Mediterranean
and Bermuda feel, the island is almost completely
contemporary. Chairwoman Cook did not like the way the
garages looked and asked if they could be in some way.
Mr. Simpson said it could not be changed due to the 60 foot
set back requirements. Boardmember Coben suggested using
shrubbery to enhance the south side of the driveway.
Mr. Parker asked about doing some banding of the colors on the
building. Mr. Simpson said it was not feasible and everyone
agreed.
Chairwoman Cook suggested the building be more heavily
landscaped due to the look of parking spaces. Mr. Simpson
explained in detail that the parking spaces had to be built
the way they were in order to not need variances.
Chairwoman Cook and Mr.. Parker discussed the landscaping,
making changes to the- landscape plan, to be given to Mr.
5impson for implementat'ion. '- ` -, - - - - -
Chairwoman Cook called for comments from the audience. A few
members of the audience expressed their concern about going
ahead with Phase I when Phase II has not been settled. Mr.
Simpson assured everyone that Phase I would be built
regardless of the outcome of Phase II.
Mr. Parker made a motion to approve the project with sabal or
coconut palms along the south side, berming along the street
right-of-way, both sides of entrance drive, change the pigeon
plum to ligustrum trees, and add one ligustrum in the parking
island underneath the sabal palms as per the changes on the
plan. Boardmember Coben seconded the motion. The vote on the
motion was:

Ruth Maitland - for
Claudette Dalack - aqainst
Stephea Parker - for
the motion was therefore passed and adopted.

V. UNFIAIISHED BUSINESS
Chairwoman Cook read a letter she composed to Dottie Campbell
thanking her on the fine job she did on the landscaping at
Gallery Square North. Boardmember Maitland suggested th�s be
put in the newsletter.
Chairwoman Cook feels that developers design what they want
and get approval for same before checking with the Village to
see what its overall design is. Boardmember Maitland said a
policy has to be put into the Community Appearance Board
Manual with regard to architecture and style of structures.
VI. COI�ASUNICATION FROM CITIZENS
Chairwoman Cook took comments from the public under New
Business.
VI. ANY OTHER IdATTERS
No discussion took place regarding Any Other Matters.
VII. ADJOURNMENT
This meeting was not officially adjourned, and the Tree Board

Item D- Statement of Compliance With Comprehensive Plan and Concurrency
Requirements
This project complies with the comprehensive plan and concurrency requirements for the
Village of Tequesta. There are no impacts of which we are aware for which there is
insufficient capacity to serve the project. Under the zoning code in an R-3 multi-family
dwelling district, we are allowed 12 dwelling units per acre which equates to 32 total
units for this property. Since we are proposing only 22 units, we are considerably below
the maximum allowed within this zoning district and the comprehensive plan.
Item E- Statements of Preliminary Review of Other Agencies '
Preliminary inquires have been made of Palm Be and South Flonda Water�Management
Environmental Resource Management (DERM)
District (SFWMD). Barbara Conmy of DERM visited the site and indicated no
problems with development as long as any infringement into mangrove is permitted by
DERM. No infringement of this type is envisioned in our plan. SFOVMD indicates that
we must meet minimum first floor criteria and positive outfall drainage requirement,
which we do.
Item G- Environmental Impact Anatysis/StudY
A study has been requested of Cotleur/Hearing to determine any environmental concerns
other than those identified by Palm Beach County Department of Environmental
Resource Management. The study will be done January 14, 1994.
Item H - Tree Survey -
There are no trees remaining on the property other than mangroves which have been
identified as environmentally sensitive and will not be removed.

North La Mar Condominium & Townhouses
Environmental Assessment
The services of Cotleur Hearing, inc. have been retained to provide an environmental
assessment for the proposed North La Mar condominium and townhouse project. The site is
located on Jupiter Island on the west side of State Road 707 in Township 40, Range 43, Section
31. The parcel includes Lot 193 and part of Lot 194 of the plat of Gomez Grant and Jupiter
Island as recorded in Plat Book 1, Page 80, Palm Beach County, Florida public records and that
part of the submerged land lying east of the bulkhead line as recorded in Plat Book 28, Pages
154 & 155. The land is currently vacant. To the south, land use consists of the La Mar
Condominium Complex. Land to the north is a portion of Coral Cove Park and consists of
roadside parking and a nanow fringe for recreational use.
Encompassing a total of 2.724 acres, the siie contains 1.332 acres of upland area with the
remainder consisting of submerged land within the Intracoastal Watervvay. Probably having been
previously graded, the upland portions of the site are relatively flat and level with a definite grade
change at the shoreline. There is substantial erosion along this top of bank and several existing
Seagrape (Cocoloba uvifera) have fallen over. The upland areas of the site have been previously
cleared and vegetation consists of seeded grass and a few low weedy herbs. A conc�ete
bulkhead armors a portion of the Lot 194 shoreline. The remainder of the shoreline along this
site is vegetated by a fringe of Mangrove, predominately Red Mangrove (Rhizophora mangle),
but also including a few Black Mangrove (Avicennia germinans) and White Mangrove
(Laguncularia racemosa) along the upper edge. One very large Black Mangrove was identified
with a d.b.h. (diameter at breast height) of 19 inches; however, probably as a result of cold kill,
the lateral branches of the tree were dead and rotted with live growth consisting only of young
shoots sprouting off the trunk. The tree is in definite decline.
Submerged lands waterward of the Mangrove fringe does consist of substantial area of quality
seagrass beds. Mangrove species extend 6 to 8 feet landward of the mean high water line
shown on the Boundary Survey prepared by Dailey & Associates dated November 2, 1993. The
remaining slope to the top of the bank is primarily vad of vegetation with only a few Pond Apple
(Annona glabra), Green Buttonwood (Conocarpus erectus) and Coin �ne (Dalbergia
ecastophyllum). Herbaceous growth is limited to Spanish Needles (Bidens pilosa).
The lack of upland vegetation precludes any utilization by wildlife and no evidence of any use
was identified. There was no evidence of Gopher Tortoise on the site nor is the habitat felt to be
suitable for any such use. Wetland areas of the site may �eceive some utilization by aquatic
species; however, these areas are not proposed to be impacted and the naROw width of the
habitat makes it unlikely that they provide any significant value.

Dear Mr. 0'Donnell:
We have been contacted by Southport Dredging (County contractor for the estuarine
and dune restoration projects at Coral Cove Park) and Mr. Mason Simpson (property
owner adjacent to the southern boundary of the park) concerning the removal of
exotic vegetation adjacent to a mangrove fringe (see map). As this areathe
immediately south of one of our recently completed restoration projects,
removal of these exotics (Australian Pines an d Braz i l i a n P e p p e r) would hel p to
reduce the spread of undesirable vegetation to other areas including our newest
restoration site. The exotics are generally found within a transitional area
between the uplands and mangrove fr.inge and are out-competing the mangroves for
sunlight and space. '-- -

The work will be performed by the same contractor that cleared exotics for the
County. To help avoid any potential impact to the existing mangroves waterward
of the exotics, our staff will provide oversight during the clearing of this
vegetation. This work is proposed to begin Monday morning, September 27, and
should be completed within a couple of days.

The above referenced project is proposed along Beach Road in the Village of Tequesta. The
multi-family project is proposed to consist of 22 units.
A trip generation analysis was conducted to determine the number of trips which would
result from the proposed project.
Table 1 shows the trip generation rates used, Table 2 the number of trips generated. �ip
generation showed that the proposed units would generate 154 daily tilps, �vith 14 and 16
trips during the AM and PM peak hour respectively. Since Beach Rr��d h� t�x�:ts�5�5 ct�pticity
available, these 154 trips, will not impact this road.
Since the new trips are less than 200, per the Palm Beach County Land Development Code
Section 7.9 �af�ic Performance Standard, a traffic study is not required. If you have any

Storm drainage will consist of an underground collection system which will receive
all drainage from impervious surfaces including the roofs of buildings and garages.
This will be channeled into an underground e�diltration trench whose ca�acity will
be calculated to be consistent with current South Florida Water Management
District Guidelines.
� Sewer Layout
, Sanitary sewer will be collected from each dwelling unit within the buildings and
carried by gravity lines to the existing lift station on site. It is possible that this
lift station may be relocated on our property. We have had preliminary
discussions with ENCON regarding this and, with their approval, it can be done at
our cost. At this time a final decision has not been made with regard to moving
it.
�, Water Distnbution and System Layout
This will be done with a water supply coming from the main located on the east
side of County Road 707 and will be distributed through the buildings in the
conventional manner. The back flow preventor (as) will be as required by the
Village water company.. _
4> Underground Electr�ical Layout
It is anticipated the transformers will be somewhere near the middle of the
property and will feed into an electric meter room in the mid-rise structure and to
the individual townhouses.

PURPOSE AND SCOPE
The purpose of this study is to establish desigii criteria for a practical and economical
system to drain and control the storm water runoff in the area hereinafter described
under the paragraph LOCATTON AND DESCRIPTION. This system will be designed
to provide a reasonable level of protection for the site improvements and 100 year storm
protection for the residential units. The design will not adversely impact any adjacent
facilities.
The scope of this study is to provide a design basis for a functional positive delay
drainage system. Facilities that will be provided include an exfiltration trench system
for retention/detention storage, a collection system, and an outfall structure, all meeting
the applicable regulatory requirements.
LOCATION AND DESCRIPTI4N
The site of the proposed development is located in Sections 30 and 31, Township 40
South, Range 43 East, and lies in the Village of Tequesta, Florida. Containing a total area
of approximately 2.72 acres, the parcel is bc�rdrred o�l the east by State Road 707; on the
west by the Intracoastal Waterway; on the south are existing residential units; the north
end tapers to a very thin strip of land bordered by the Intracoastal Waterway and State
Road 707. Attached herewith is an aerial on which the approximate limits of the project
are noted.
EXISTING CONDITIONS
The present conditions of the 2.72 acre site is open undeveloped space. A portion of the
property lying along the Intracoastal Waterway is submerged lands. This area is
approximately 1.39 acres.
There are no existing drainage facilities on the site. Topographical information shows
that the upland portion of the site varies from an elevation of 2.0 (msl typ.) at the
Intracoastal Waterway to an elevation of 7.5 at the south end of the site. A review of
the Soil Conservation Service Soil Survey for Palm Beach County indicates that the soil
type for this area is Urban Land Complex which will be suitable for the proposed
development provided proper construction practices are utilized.
Presently, rainfall on this site is discharged to two areas. Some rainfall percolates into
the ground, runoff to the west enters the Intracoastal Waterway and to the east flows
into the road swale system.
PROPOSAL ,
The grading design and proposed drainage system will be such that no storm water
from the developed site will flow directly off the site. Storm water runoff will be
collected in a system of inlets and exfiltration trench and conveyed by underground
eulverts to a"spreader swale" discharging into the Intracoastal Waterway.

Water managemeitt rules require that water quality requirements and/or pre/post
development discharge (on a total volume basis) be contained in the retention system
prior to discharge. Calculations of these volumes will be done and the retention system
sized to accommodate the required volume.
The discharge to the Intracoastal Waterway will be by a"spreader swale" facility. This
is the method preferred by the South Florida Water Management District for facilities
connecting to the LZtracoastal. That method provides for the least impact on the existing
river bed.
The elevation that will be used for determining the minimum finished floor will be
based on the Federal Emergency Man�gement Agency Flood Insurance Rate Map for this
area. A preliminary review of that map indicates that minimum elevation of 6.0 msl
will be necessary in this area.

This preliminary of the Cliveden project has revealed some concerns that need to be designed into the
project or darified.
1. Buildings are required to have a supervised automatic fire protection sprinfder system. System shall
have a water ftow device and control valves for each floor.
2. A class III standpipe system with fire pump is required.
3. A fire alarm system utilizing an emergency voiceJalarm communication shall be installed, with a two
way telephone communication system in accordance with NFPA # 72.
4. Emergency generator is required to operate the Emergency tighting, Fire alarm system, Fire pump,
Central control station equipment and lighting, Fire control room, Elevators and Mechanical equipment
for smoke proof enclosures.
5. Fire control room located in the lobby area shall have an entrance door �rom the exterior of the
building, this room shall be equipped with the voice fire alarm system and corrtrol paneis, fire department
two-way telephone communications service panels and controls, fire detection and fire alarm system
annunciation panels, elevator floor location and operation annunciators, emergency generator status
indicators, control for automatic stairway door unlocking system, fire pump status indicators, telephone
equipment to access public telephone equipment, a complete set of as built building plans, plan table,
command desk and chair.
6. Building shall be compartmentized with smoke zones.
7. Elevators must be large enough to accommodate a two foot by seven foot stretcher.
8. Hall way to bedroom #2 must be straightened to accommodate the above stretcher dimensions.
9. Walkway between parking garages should be ramped if possible.
10. Fire protection hose valves shall be located near the boat docks for fire department use.
11. Entrance canopy to be designed to have a clearance of 11 foot to permit fire apparatus access.
12. Section # 18-2.4.1 of the L'rfe Safety Code requires each living unit to have two separate exits
remotely {ocated from each other. In a sprinkled building, the minimum distance between exit doors shall
be one third the maximum overall diagonal dimension of the area served.
13. Buildings should have lightning protection in accordance with NFPA # 78.

Dear Jim:
This will reiterate our discussions regarding the above captioned project and your memorandum
of March 23, 1994, which included comments regarding the fire rescue and life safety aspects of
it. As I understand it, our discussion was as follows:
1. The building will have a supervised automatic fire protection sprinkler system with
a flow detector switch device and control valve for each floor. This will be
detailed on the working drawings.
2. The building will have a Class III standpipe system with fire pump and this will be
detailed on the working drawings. We will provide one riser through the north
portion of the stairs (ne� to the elevator shaft) and that riser will have a cabinet
and, at the same level, we will provide a 2 1/2" hose valve at the landing of the
other stair. This will save a second riser. We will detail this on the working
drawings.
3. A fire alarm system utilizing emergency voiceialarm communication will be
installed with a two-way telephone communication system in accordance with
NFPA # 72. This will be detailed on the working drawings.
4. We u�ll provide an emergency generator to operate the emergency lighting, the
fire alarm system, the fire pump, the central control station equipment and
lighting, the fire control room, garage door openers, the elevators and mechanical
equipment for smoke proof enclosures. This will be detailed on the working
drawings.
5. The fire control room at the lobby level will have an entrance door from the
e�cterior of the building and will,be equipped as speci�ed in your memorandum.
This will be detailed on the working drawings.
6. The building will be compartmentalized with smoke zones. This will be
accomplished with spring hinges provided on the doors of the elevator foyer.

7. The elevators will he large enough to accommodate a 2' x 7' stretcher while it is
laying completely t1at.
8. We will make the necessary adjustments to bedroom #2 to accommodate the
stretcher dimensions mentioned in #7 above.
9. The walkway between the two western garage buildings will be ramped instead of
having steps. This will allow easier access with a gurney.
10. The fire protection hose valves for the boat docks will only be provided if we
return to the original site plan which included a garage building along the whole
wtstern c�dge of the property. lf we continue with the site plan currently under
review, this hose valve will not be required.
11. The entrance canopy will be designed to have an overhead clearance of 11'.
12. The requirement of Section 18 - 2.4.1 of the Life Safety Code will be met if we
add double doors to the den. This will be done.
13. Buildings will have lightning protection in accordance with NFPA #78. This will
be evidenced on the working drawings.
In addition to the above, we spent some time discussing the placement of speaker strobes,
smoke detectors, firefighter's jacks and other equipment related to the fire protection system.
These devices will be located by Rick Eickler as agreed during our meeting.

The purpose of this letter is to respond to your comment sheet of March 17, 1994,
regarding the above captioned condominium site plan. Our responses are as follows:
l. The site plan is being modified to indicate the m�imurn size of the
entrance wall signs to be 20 square feet. -
2. The front CBS wall is being removed from the site plan so no variance is
required.
3. I am enclosing 15 S-1 sheets with the color chips attached.
4. The S-1 and L-1 dr�v.�inDs are being modified so that the entrance sign and
wall are consistent with the sheet 1 elevation.
5. The gazebo rear set back is 10' and has been noted on the attached site
plan.
6. The height of the wall sign is indicated on the drawings and the front
privacy wall has been eliminated.
7. The lot coverage of the paved parking area is delineated on the site plan.

8. We will provide for solid waste and recycling pick up. The containers will
he rolled by hand out of thc trash room area at the nc�rth side of thc
building onto th� parking lot area where the garbage trucks can em�ty
them. With regard to recycling, there will he six recycling containers
(three co-mingled and three nc;wsprint) accommodated in thc trash room
and there will be an individual trash chute for recyclable waste. On
specific days of the week, the container for that day's recyclable waste will
be placed underneath the chute to segregate the different types of refuse.
Then, according to a posted schedule, the containers will be changed
throughout the week to accommodate the various types of paper, plastic
and aluminum wastes.
9. Although the condominium documents are not written at this time and w�ill
not be for several months, I represent to you that they will provide for
proper restrictions relative to the maintenance of the landscaping, including
a guarantee of survivability, and all the common property . This building
will have residences with prices in the ranbe of $SOO,OQO and up and will be
maintained in keeping with that quality level.
10. The shade pavilion was actually the gazebo and the elevation that showed
that has been modified to indicate that it is the gazebo.
11. The mezzanine resident manager's apartment has now been located on the
ele��ation and is clearlv indicated.
12. I have asked for a new letter of review and approval from Nichol's
Sanitation (copy of the request is attached).
