Fvr the purpose of this ordinance� the following definitions

The utility fee is ta be paid by th� owner of esoh parcel
subject to the fee. Yf the property is Lenant-occupisd, thQ
property owner a�ay request that the villaga bill the tanant !or
such fee. 9uch instructions taust be in writing. All propsrti
except the undisturbed parcels shall be rendered bills or
statements for the use of these services.And fncilities ot the
system by the villaqe utilities Cepartment. These bilis or
statementa �hall be payable nt the aame time �nd in the a�ts manner
and 6ubject to t,he sruaa dfscontinuance of service by the Villaqe
utility as set forth under the terms and conditions or Chapter �8 `
of the Code of the Village of Tequesta.
Any p�yment remaini»g unpaid on an owner-occupfed propertY !or
a period ot thirty (30) days ar on a tenant-occupied propsrty Zar
ninety (90) days, shall constitute a lien in Zavor o! the Villaqs
�yz�tnst the prvperty servlced, and the proper Vil2age offiCial� are
authorized and directed to record a lien for such unpaid ree in the
pubXic recards o� paim Beach eounty, F�orida. Such lien shali be
superior in dignity to a»y encumbrances an the said property,
whether occurriny prior to or subsequent to such lien beinq
recorc�ed, except for Cax lien�, and may be foreclosed by the
Vill�ge attorney as provided by 1�►�+.

A. Owner or tenant initiated adjustmenta.
Request tor adjustment or the ut111ty !ee shall be sub�aitted
to the director, who shall have authority to adjust t2�e =ee, to
administer the procedures and standards� and to review criteria for
the adjustment oP such fees as established herein. Al1 requests
shall be reviewed strictly on the basis of the amount of imperviaus
area on the property. No credit shall be qiven !or the
installaticut of facilities required by Village or cout�ty
development codes ar state sto�mwater ruies. parcels within the
district shttll receive nn ndjustment to their individual user tee
that is rellective of the flood control services being prvvided by
the district. The followinq procedures shall apply to all requeets
lor ad�ustment of the stormwateX utility fee:
1. Arty owner or tenant who believes the utility Eee is
incorrect nay, subject to the limitations set Yorth in this
section, submit a request for ad�ustment to the dir�ctor.

3. Requests tor adjustmsnt for tha utility lees shall

advanCe.
4. TI�e oWner or tenant requestinq tiha adjustment mey be
reyufzed, at his own cost� to provide supplement infor�matidn
to the direct4r includinq� but not limited to, �urvey data
Ge�tilied by a professional land surveyor and/or enqineering
reports appraved by a prafessional engineer and acceptable to
the director. Failure to provide such information nay reault
in � deni�l of the adjuatment reque$t.

director within a two (2j month period from the dats ot lilinq
of the request fvr adjustment. Adjustments resultfng lrom
such request shall be retroactive to the beqinning o! the
bilXittgs� but retroactive Aajustments shall not exceed otte (�)
year.
6� The adjustment to the utility fee will be made upon the
c�ranting or the adjustment request, in writinq, by the
director. A denial of a request tor adjustment shall be made
in writing by the director, a copy of which shall be provided
to thQ owner.
�. The direct4X, upari discoverinq an error or o�+�r�iqht in
the calculation of the fee, may initiate a request for
adjustment. The reyu�st mu�t be made in writinq dacumentinq
t.�e reasons for the ad�ustment. Zn the evcnt tht�t �e
ad�ustment would require ttie itic;r�ase in fee for a fee pa�yor,
the director must pravide the request for adjustsaents to the
affected fee payor thirty (30) days prior to adjusting the tee
and offer the tee payor an opportunity with 'in tha stated
thirty (30) days ta provide reasons wby the adjustment �hould
not be made.

to the date at which th� erroneous informativn �ras applied to
the tee payor's fee, but will nbt exceeci one (1� year prior to
the request for ndjustment.
B. All determinntions or the director pursuttnt to thia
sect�on may be appealed to the stormwater utility bvard for reviev
of the denial. TheSe appeals must be liled within thirty (30) days
of reeeipt ot the written determinati�n of the director• Th�
stormwater utility board shall complete their revi�w �+�.ttiin sixty
(60) days oi r�ceipt of said requ��t for review. The board'o
determination on the review shall be in writing and set fcrth iri
det$il the reasons for thelr aecision. Zn reviewinq d�nials of
requests for adjustment, the stormwater utility board sh�ll app1Y

All stormwater utility fees not paid within thirty (30) days
after the bill is due shal� be considered deiinquent. Ali
` stormwater utility fees delinquent hereunder shall be eu�ject to:
1. An interest charge at the Flarida �tatutory rate, and

fdcili�ies. The process does not apply wherein the stormW�tar
tacilitiea ttre privately held. Each applicntion is evaluated
aqainst the Villr�g�'s mastex p].an, or Where the ma6ter pinn ia
incomplets, against the cux�ulative impact6 trom the
development.
2. Availability charge is adma.nistered on a site specific
basis identical to the fee in lieu of procedure noted ab�ve.
The only difference is that the capital irivestment advanced by
th� Villaqe in implementing +a stormwater facility in �ow
recovered through an availabilitiy charge. The copital charqe
is determined on a pro rata share af a capacity used by the
new appli�atiL a� measur�c3 k�y the cumulative impact from the
development upon ail impacted �acil.ities appiied to the
present wortt� vf LYie vriyinal �a�,ital expenditure. In the
case of � developer ca»structing stormwater nanaqement
Pacilities in excess of the sit� rideds, the Villaye may enter
, an agreement with that deve�oper tv rebate fee in lieu o�
chargas paid to the village by other developers ut�iizinq
those racilities over a pe� iod of time not exceedislg sever► (7)
years from the date of the agre�ment.
C. All d@velopment subj�ct to the provisions of Section 19-8
shall pay a fee calculated consistent with Section 19-9 herein.

RE: Creation of Tequesta Stormwater Utility
As you know, the Public Works Committee met on Monday, November 22,
1993 for the purpose of learning about the Stormwater Utility
Concept. The Town of Jupiter recently implemented a Stormwater
Utility and Encon is rapidly approaching doing the same.
Attached hereto, please find a copy of a hand-out provided by Gee
and Jenson which explains the concept and potential of a Stormwater
Utility Program.
The Public Works Committee has unanimously recommended the creation
of a Stormwater Utility for Teguesta. They have also recommended
that the Ordinance creating the same be made available for First
Reading by the Village Council at your meeting on December 2, 1993.
The Village Attorney has been requested to prepare such an
Ordinance for your consideration.
The primary reasons that the Committee has recommended a Stormwater
Utility for Tequesta are:
1) The Federal Clean Water Act and the resulting National
Pollutant Discharge Elimination System (NPDES) will
ultimately result in enormous and inescapable costs to
the Village.
2) Upon the update of Tequesta's Comprehensive Development
Plan, Tequesta must comply with all new State Water
Policy and South Florida Water Management District

Stormwater Management Goals and Plans all pursuant to the
Surface Water Improvement and Management Act. Likewise,
this will also impose additional costs upon Tequesta.
A Stormwater Utility is the accepted and authorized way in which to
raise the revenues to deal with these unfunded state and federal�
mandates. The Loxahatchee River Environmental Control District,
although they do not refer to it as a Stormwater Utility, is moving
forward with plans to create the same to meet certain
responsibilities that they have to the Loxahatchee River under
their Charter. This is a secondary issue in the need for Tequesta
to move forward with its own Stormwater Utility at this time.
In all probability, the Ordinance that you will have before you on
December 2nd will not impose any fees. At this point in time, it
is important to merely create the utility. Studies and planning
activities will be conducted later to establish drainage basins and
any fees associated with the utility. Any fees adopted will be
offset by a reduction in the Tequesta ad valorem milage rate.
We will recommend that you adopt the Ordinance to create the
Stormwater Utility. In the interim, should you have any questions
regarding the reasons for so doing or about the Stormwater Utility,
please feel free to contact me at your earliest convenience.
Richard Staudinger of Gee & Jenson will be present at your December
2nd meeting to provide you with an overview and to answer any
specific questions you may have in this regard.
