Bradford, Village Manager ��6� DATE: January 4, 1994 SUBJECT Resolution No. 6-93/94 - Opposinq Legislation that Would Eliminate the New Option to Annex Certain Enclaves by Interlocal Aqreement; Agenda Item Apparently, there is a move afoot in Tallahassee by numerous State Legislators to pass legislation eliminating the new provisions given to municipalities to annex certain enclaves by way of Interlocal Agreement with the applicable county in question. Based upon our preliminary analysis, there appear to be three or four parcels of land within Tequesta's Reserve Annexation Area which could utilize the current procec�ures. Nevertheless, municipalities are long overdue in receiving consideration from the State Legislature to facilitate annexation in order to efficiently and effectively deliver necessary public services to the community-at- large. Some legislators are claiming that they were unaware of these provisions in the legislation which was adopted in 1993. The truth is they probably failed to fully predict the reaction of impacted unincorporated residents. We should fight any effort to .usurp annexation powers granted to municipalities and should seek additional powers to facilitate effective and economical public services by municipal corporations, that unit of government closest to the people. It is recommended that the Village Council adopt this Resolution. WHEREAS, on December 1, 1993, the House Committee on j Community Affairs Sub-Committee on Growth Management will I ' consider PCB CA 94-02 which, if adopted, would substantially invalidate a provision of the State Law codified as part of i the State Annexation Law at Chapter 171, Florida Statutes, � which was just enacted in 1993 to assist cities and counties ;' in the elimination of enclaves; and I WHEREAS, there are other similar bills being prepared at this �I time which will likely come before the Senate Committee on 1 Community Affairs during the week of January 10, 1994; and � wHEREAS, during the November Special Session, Senator Dudley attempted twice to have the full Senate consider this measure; and WHEREAS, the 1993 Annexation Legislation which is currently codified as Sections 171.0413 and 171.0621, Florida Statutes, provides for expedited methods for the annexation of small- scale enclaves as defined in the aforementioned Sections of the Florida Statutes; this provision was included in order to provide a method to eliminate the numerous small-scale enclaves which currently exist; and - . i 'I I � '� WHEREAS, this 1993 Legislation represented the first reform � j to the Annexation Statute in nearly twenty ( 20 ) years and was 'i based upon recommendations of the Elms Committee after much � study and consensus building throughout the State of Florida; ' � and i; i WHEREAS, the Village of Tequesta, Palm Beach County, Florida, � is strongly opposed to any type of legislation which would ; have the effect of repealing or invalidating the 1993 ' Legislation and/or which negate the efforts of the Elms ;i Committee and make it difficult to eliminate enclaves, as it ;� has been in the past. i� �� NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE ;i VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: ;i �; 'i SECTION 1. The Village Council of the Village of Tequesta �� hereby expresses its strong opposition to PBC CA 94-02 which ! is legislation being�proposed which if adopted, substantially I� invalidates the provisions of Chapter 171, Florida Statutes, �I just enacted in 1993 which provide a mechanism for expediting (� the elimination of enclaves. Similarly, the Village Council opposes any type of similar legislation which would il invalidate or have the effect of repealing the annexation legislation adopted in 1993 which was a result of consensus I � building throughout the state and represented the ' recommendations of the Elms Committee. � SECTIOp 2. The Village Manager is hereby directed to 'submit a copy of this Resolution to each Member of the Palm Beach County Board of County Commissioners, to each Member of the Palm Beach County Legislative Delegation, to each Member of the State House Committee on Community Affairs, to each Member of the State Senate Committee on Community Affairs, and to other House and Senate Committees that may be assigned to review this proposed legislation from time to time.
