SUBJECT: Enqineerinq Design Contract for Tequesta Park
Improvements; Aqenda Item
The 1994 Bond Issue entails improvements to Tequesta Park. The
Tequesta Park improvements contemplated are paving, lighting and
landscaping of the existing parking lot, upgrading and modernizing
the playground area, upgrading all of the existing ballfields and
lighting the basketball court. The estimated cost is $295,000,
of which $25,000 has been allocated for engineering design.
Gee & Jenson has proposed to design these improvements for $26, 810.
This amount includes design and bid document preparation.
Although the fee is 7.3� higher than we had anticipated, we have
added the lighting of the basketball courts and this cost includes
necessary geotechnical and topographical surveys which we had not
included. All in all, we think the design fee is acceptable for
this type of work.
It is recommended the Village Council approve this Contract,
authorizing the Village Manager to execute the same on behalf of
the Village, which will allow said work to be designed prior to
Bond issuance.

Attached is the revised proposal for protessional services on 7eyuesta Park you
requested. As a courtesy, we wanted to provide you with the background for the
proposed fee amount being somewhat higher than the original $25�0� you and Mr.
Preston budgeted fot tttis proJect. You may recatt that the original preliminary cost
estlmates we generated for the project were In December of 1991 � then updated (n
Augvst of 1992. Neither of these inciuded cost items tor ligh�ng the basketbail courts or
the new fencing/equlpment planned at the pract�ce balifie{ds complex� nor ant;cipated
costs for geotechnical and topagraphic surveys. These are now expected to be requlred
to provide the best engineered solution for the new parking lot.
We trust you and the Council witl concur with this explanatton of the new expenses and
hope the increase In the project's costs will not present a financia) hardshtp tor tt�e
Viltage.

In additlon to the fees speclfled above� the Consultant shall be relmbursed b� dired nansalary
expenses� including� twt not Gmited to, data processing, equlpment r�ental, sutomobtle travel at
50.33 per mlle, 50.55 per mi(e tor tour-wheel dfire and ttucks, bnq distance telephone, printin�
and reproductlon� plus Florida sales taxes, if appllcable.
We estimate the cost of these services to be One Thousand SIx Hundred Doliats (�1,600.00).

On any proJect for which constructlon drawings and speclflcatJons were prepared by the
Consultarrt and a oe�ificatian of constn,ction Is �equ(red by a regulatory agency, the CGeM shaq
employ the Consultant to perform resldent project senrices for observatlon o! the constn�ction
work. Unless the Consuttant !s engaged br resldeM proJect services. they w(I! not be in s positfon
to certify the wo�lc to those regutating agencles having Jurisdctlon and requiring ce�ttflcatlon.
Project represertitation may requlre one or more fuq or part-time proJect representatives� �
dependng upon the raquirerr�nts of the project. Tt� pro�ect represe�tabve wi11 endeavor to
provide protecti�on tor the Ciierrt agatnst obse�ved dsfeCts and deficienaes in the woric of the
Cont�actor. However� the furr�shing of resldenl project servk;es does rsot guararttae the woric of
the Cor�trador, nor assume Ii�bility on tt�e part of the Consuitant for Job safety or the Contractors
� means� methods� techniques, sequences and/or prooedures.

Code and Requlatory Compqance
The Consulfant prepares his woric product based on known codes and iMsrpretations and relfes
a� his experience to evaluate their app6cabifify. Input and comments are often sought hom
ar��wriUes havinQ )u�isdiction and in many lnst�nces. agreements are reached which irr�act the
worfc product. When skuatlans ar�se such as cade revisions, changes In I�erpretations. chanpes
to agresd upon drectian, or wo�lc perfomned before required �mnits or agency a�rovals are
recetved, the Consu�taM wip telce apprap�late actior� subject to the dtrecaon of the Client
Senrtces assodated wtth these sibuations w+q be campensated for as addiGonal services.
