TEQUESTA INVESTORS LP (HARLOW IN PARIS), Respondent. RE: Violation of Chapter 70 Article II Section 70 -43 of the Code of Ordinances of the Village of Tequesta. Address: 223 US Hwy 1 Tequesta, Florida 33469 Legal Description: WATERWAY VILLAGE LOT A PCN: 60- 43- 40- 30 -05- 000 -0901 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on the 28 day of February, 2013, and based on the evidence and testimony presented, entered an Order Finding Delinquency for Business Tax Receipt and Assessing Fines and Penalties. The following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT 1. The Respondent, Tequesta Investors LP (Harlow in Paris), was represented at the hearing by Victor and Peggy Spivey; there was a finding of proper notice. 2. The Village Code Inspector testified to and produced documentation of the violation. Specifically, the Village Code Inspector testified to and produced documentation demonstrating that the Respondent has not paid the business tax imposed by the Village of Tequesta for fiscal year 2012 and such license is delinquent. Page 1 of 2 CONCLUSIONS OF LAW The above - stated facts constitute a violation of Section 70 -43 of the Code of Ordinances of the Village of Tequesta and subjects Respondent to fines and penalties as set forth in Chapter 205, Florida Statutes. ORDER Pursuant to Section 205.053, Florida Statutes, Respondent is delinquent in the payment of the required business tax of One Hundred Dollars ($100.00); and has been assessed the delinquency penalty of up to twenty -five percent (25 %) of the tax due or Twenty -five Dollars ($25.00). Respondent currently owes the Village of Tequesta One Hundred and Twenty -five Dollars ($125.00) (tax due plus delinquency penalty). The Respondent is hereby ordered to pay this total fine amount within thirty (30) days from the date of this Order. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes. Upon complying in any code enforcement matter, it is always the responsibility of the Respondent to contact the Code Enforcement Department at (561) 540 -5790 to request a reinspection of the property.
