the regularly scheduled Village Council meeting beginning at 7:00
P. M.. Thursday, February 10, 1994, in the Villaqe Hall, 357

Special Exception Use within the R/OP, Recreation/Open Space

SUBJECT: Constitution Park Improvement Pro�ect - Phase I
Tom, the Community, Appearance Board reviewed the above referenced
pro7ect on January 19, and February 2, 1994.
The followinq concerns were expressed by the Board reqarding this
proposed pro�ect:
1. Alternate Boardmember Parker was concerned with the trunk
caliper of the queen palms.
2. Alternate Boardmember Parker reiterated that he still
would like to see two garking spaces turned into landscape
areas by securing an additional variance to the parking
requirements from the Board of Ad7ustment.
Motion to approve the proposed project as modifisd on the plans at
the meeting, said modification being as follows:
1. Specify a minimum twelve ,< 12") inch cal iper, at t ime of
planting, to gueen palms.
Vote on the motion: 5-0 to approve.
Additional Board comments: NONE
Buildinq Official Comments: This GAB review is for Phase I park
improvements only. Phase II review will be forthcoming in the near
f uture. A variance was Qranted by the Board of Adjustment f or the
number and the size of the parking spaces <copy of BOA approval
letter attached).

Board of Ad�ustment at their September 21, 1993 Public Hearing
approvinq your request for a variance to the terms of the Official
Comprehensive ZoninQ Ordinance of the Villaqe of Tequesta, to
allow the reconstruction of an existinq off-street parking lot
with thirty-nine < 39>, 9' X 18' parking spaces, in 1 ieu of forty-
five <45>, 1Q' X 20' parkinq spaces, as required by the Zoning
Code. This application is approved with the special
considerations attached as outlined in your letter of September 8.

Justification for Variaaces
Dear Board Members:
Please note the following special conditions and circumstances in
considering the Jupiter-Tequesta Junior Citizens, Inc. request for
variances:
1. Special Conditions: Reconstruction of Existina Off-Street
Parking Lot
Anticipated work reflects a reconfiguration of an existing
12,495 square foot off-street parking lot.
2. Pre-existiag Coaditions
Every effort was made to maximize the number of parking spaces
within this already defined area.
3. Special Privileqes
Approval of Off-Street Parking Variances contingent upon
approval of Site Plan Review and Landscape Waiver for
Constitution Park and actual construction of Constitution
Park.
4. Applicant's Riqhts/Dndue Hardship
Adherence to the provisions of Zoning Ordinance regulations
and requirements pertaining to off-street parking spaces would
further reduce the number of parking spaces. Consequently,
adequate parking for the Jupiter-Tequesta Junior Citizens
recreation facility and the future Constitution Park expansion
would not be available for the public.
5. Miniaiwa Variances
..Requested variances - thirty-nine (39) parking spaces instead
of forty-five ( 45 ), including two ( 2) 13' wide ( 8' parking; 5'
access lane) "disabled" parking spaces, and 9'x 18' parking

space dimensions rather than 10'x 20' dimensional parking
spaces - are the minimum variances which would provide for
reasonable use of the property.
6. Proper intent/Consideratioa of Public Welfare
In applying for said variances, every effort has been made to
comply with the provisions of Section VIII, Off-Street Parking
and Loading Regulations, as well as, Ordinance No. 377,
Landscape Ordinance. Reconstruction of the Off-Street Parking
Lot has been planned with the public interest, safety and
welfare in mind.

GENERAL PLANT INSTALLATION NOTES
All plant material shall be Florida No. 1 or better as outlined in "Florida Grades and
Standards for Nursery Plants: Part I and Part II ", State of Florida, Department of
Agriculture.
All tree and shrub planting area to be dressed with 2" Pine Straw Mulch, Cypress Mulch
or Melaleuca Mulch upon approval of owner.
In the event of a discrepancy between the quantities and types of materials designated
in the planting list and the plans, the plans shall control. All discrepancies should be
brought to the attention of the Landscape Architect before proceeding.
All landscape construction and installations to meet the Village of Tequesta, Florida or
other local, state and federal jurisdictional requirements.
Topsoil should be stockpiled for reuse in landscape work. If quantity of stockpiled topsoil
is insufficient, provide additional topsoil as required to complete landscape work. General
soil mix requirements as follows:
Humus (muck): 30%
Sand 70%
Fertilizer 2 lbs. of 12 -6 -8, 60% organic,
per cubic yard soil
Prior to planting, insure that a source of temporary water is available, until irrigation
system is installed and completely operational.
All trees should be staked or guyed immediately after planting as illustrated in details or
alternate method as approved by Landscape Architect.
Grading: Excavation, filling and grading required to establish finish elevations shall
be - completed by General Contractor previous to start of landscape
installation. Fine /Hand grading for all sod areas to be completed by
Landscape Contractor as part of sod installation.
Maintenance: Begin maintenance immediately after planting as follows:
Trees, shrubs, and other plants by pruning, cultivating and weeding as
required for healthy growth. Tighten /repair stake and guy supports as
required. Spray to keep free of insects and disease.
Lawns should be watered, fertilized, weeded, mowed and patched as required to
establish a smooth, acceptable lawn at time of final acceptance.
Guarantee: Guarantee lawns through the specified maintenance period or until final
acceptance. Guarantee trees and shrubs for a period of one (1) year
against defects including death and unsatisfactory growth, except for
damage resulting from neglect by Owner, abuse by others, or unusual
phenomena or incidents which are beyond Contractor's control.
Prohibited Plant Species: All prohibited plant species to be eradicated from site before
beginning any new plant installations.
Protection of Preserved Trees During Construction: Trees which are to be preserved on
site shall be protected from damage during construction process according to appropriate
tree protection techniques. In determining the appropriateness of particular techniques,
the Contractor shall use the current edition of the `Tree Protection Manual for Builders
and Developers ", published by the Division of Forestry, State of Florida Department of
Agriculture and Consumer Services.
Irrigation: All landscaped areas to be irrigated with an automatic underground sprinkler
system providing 100% coverage minimum, based on manufacturers radius to radius
head spacing recommendations. Contractor shall provide shop drawings depicting
proposed system layout including heads, valves, piping (mainlines and laterals),
controller(s) and water source specifications. Entire system shall be installed in
accordance with local codes. Contractor shall be responsible to secure all permits and
pay all one time fees related to this work. Adjustment features of all sprinklers shall be
used to eliminate overthrow onto paved surfaces. Contractor shall perform hydrostatic
and operational tests upon completion of irrigation system installation and as required for
Owner's final acceptance of work. Provide Owner with as -built drawings if requested.
A rain sensor or soil moisture sensing device shall also be provided with the ability
