HomeMy WebLinkAboutOrders_Variances_04/08/2013_VAR 02-13 , , ORDER OF THE VILLAGE OF TEQUESTA BOARD OF ADJUSTMENT REQUEST FOR VARIANCE CASE NO.: VAR 02-13 IN RE: Stephen Parker, Parker-Yannette Design Group, Inc., as agent for owners Michael and Donna McCarthy PROPERTY LOCATION: 16 Yacht Club Place, Tequesta, Florida 33469 LEGAL DESCRIPTION: TEQUESTA REPL OF PT LT 604 PARCEL CONTROL NUMBERS: 60-42-40-26-02-000-6040 VARIANCE REQUESTED: Relief from Sec. 78-284 to a11ow the installation of a six feet high pedestrian gate with two 6' 6" high stone veneer columns and a 4' 8" high garden wall at the front entrance of the residence, where the code prohibits walls and fences exceeding six feet in height and no wall or fence shall be permitted to extend forward of the adjacent or nearest portion of the building front regardless of the actual, allowed building setback line, on any lot or parcel. ORDER DENYING VARIANCE APPLICATION This cause came to be heard upon the above application and the Village of Tequesta Board of Adjustment having considered the evidence presented by the applicant and other interested persons at a hearing called and properly noticed, and the Board of Adjustment, being otherwise duly advised, THEREUPON, THE TEQUESTA VILLAGE BOARD OF ADNSTMENT FINDS AS FOLLOWS: 1. The subject property is located in the R-lA - Single-Family Dwelling District in the Village of Tequesta. 2. The applicant has submitted all documents required by the Village's Code of � Ordinances for variance review. 3. The application and all supporting documentation and presenta.tion materials as reviewed by the Village of Tequesta Board of Adjustment at its Apri18, 2013 meeting, and as kept on file by the Village, are attached hereto as Exhibit "A" and are incorporated by reference. 4. According to Section 78-61 of the Village Code of Ordinances, variance approval by the Village of Tequesta Board of Adjustment is required. 5. The applicant has applied for a variance to allow the installation of a six feet high pedestrian gate with two 6' 6" high stone veneer columns and a 4' 8" high garden wall at the front entrance of the residence, where the code prohibits walls and fences exceeding six feet in height and no wall or fence shall be permitted to extend forward of the adjacent or nearest portion of the building front regardless of the actual, allowed building setback line, on any lot or paxcel. 6. Under the provisions of the Village Code of Ordinances, the Village of Tequesta Board of Adjustment has the right, power and authority to act upon the request herein made. IT IS THEREUPON CONSIDERED, ORDERED AND ADNDGED BY THE VILLAGE OF TEQUESTA BOARD OF ADJUSTMENT AS FOLLOWS: The application for Variance, Case No. VAR-02-13 with reference to the above described property within the Village of Tequesta, Palm Beach County, Florida, to permit the following: Installation of a six feet high pedestrian gate with two 6'6" high stone veneer columns and a 4'8" high garden wall forward of the building front in accordance with the variance application attached hereto as Exhibit "A" is hereby DENIED since the Village of Tequesta. Board of Adjustment finds that the applicant does not meet the criteria of the existing law for variance approval as set forth in Section 78-65 of the Tequesta Zoning Code.
