DORIS AND MINKI THOMAS, Respondents. RE: Violation of Chapter 30 Article II Section 30 -33 of the Code of Ordinances of the Village of Tequesta. Address: 414 Cypress Drive Unit D Tequesta, Florida 33469 Legal Description: CYPRESS VILLAS UNIT D BLD TR 1 OF PAR A PCN: 6043- 40- 30 -34- 001 -0014 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on the 25 day of April, 2013, and based on the evidence and testimony presented, entered an Order Finding Repeat Violation and Imposing Fine. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT 1. The Respondents, Doris and Mikki Thomas, were not present at the hearing; however, there was a finding of proper notice. 2. Based upon the evidence and testimony presented, the Special Magistrate finds that the Respondents have been in violation of Section 30 -33 of the Code of Ordinances of the Village of Tequesta from April 5, 2013, through April 25, 2013, a period of twenty -one (21) days, and that the violation continues to exist. 3. This is a repeat violation of the same Village Code section from an "Order Assessing Fine" dated August 27, 2012. Page 1 of 2 CONCLUSIONS OF LAW Based on the above - stated facts, Respondents are in repeat violation of Section 30 -33 of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Special Magistrate that a Fine of Five Hundred and Twenty -five Dollars ($525.00) is hereby assessed at Twenty -five Dollars ($25.00) per day for this repeat violation, which existed on the property from April 5, 2013, through April 25, 2013, a period of twenty -one (21) days, and such fine amount shall continue to accrue at Twenty -five Dollars ($25.00) per day until compliance is achieved. Respondents also are assessed the Village's administrative costs in the amount of $244.40. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes. Upon complying in any code compliance matter, it is always the responsibility of the Respondents to contact the Code Compliance Division at (561) 768 -0506 to request a re- inspection of the property.
