THIS INDENTURE, made this 31st day of January , 198�+;,
between VILLAGE OF TEQUES�A, Florida, a Municipal Corporation exzsting
under the laws of the State of Florida, hereinafter caXled the "Grantor",
and the LOXAHATCHEE RIVER E�TVIRONMENxAI. CONTROL DISTRICT, an Agency of the
State of Florida, created hy a Special Act of the Legislature, Chapter
71-822 as amended, of P. 0. Box 396, Jupiter, Florida 33468-0396, its
successors and ass�gns, herein called the "Grantee". _

That the Grantor for and �n consideration of the sum of TEN DOLLARS
($10.00), to it in hand paid by the sazd Grantee, together with all o�her
covenants made by the Grantee and contained herein, has granted, bargained
and sold to the Gran[ee, a permanent Easement, for ingress, egress,

THIS INDENTURE, made this 31st day of January , 19 84,
abetween VILLAGE OF TEQITESTA, FLORIDA, a municipal corporatio, hereinafter
called the "Grantor", and the LOXAHA.TCHEE RIVER ENVIRONriENTAL CONTROL
DISTRICT, an Agency of the State of Florida, created by a Special Act of
the Legislature, Chapter 71-822 as amended, of P. 0. Box 396, Jupiter,
F�orida 33468-0396, its successors and assigns, herein called the �
"Grantee".
W I T N E S S E T H
WHEREAS, Grantee temporarxly requires ingress and egress over a �
portion of the property of Grantor, for the purposes of the construction
and installation of sewer facilities and appurtenances o�x property adjacent
to that of Grantor�s; �
NOW, TFiEREFORE, for and in consideration of the sum of TEN DOL7�ARS
($14.00) paid to Grantor 'by Grantee the Grantor does hereby gxant to the
Grantee a temporary easement aver the�property described in Bxhxbit "A"
attached hereto and made ;a gart he�eo� for. the purposes of ing�ess, �
egress for th� constructi�on, rep�ir, installat�.on and saaintenance of sewer
faciliti�es and facilities foz the transport of secondarily treated waste,
other liquid form product of Grantee's sewage treatment plant, or sew�rage,
including but not limited to tiransmission maius, manholes, Iift stations,
collection lines, mete.rs, and all other related appurtenances having the
capaczty for the use in connection with the collection or transmission of
wastewater vf any nature or originating froBr any source either on ar off
� -. the property of Grantee; grovided that this easement is limited to such
ingress and egress rights for the purpose of installing sewer improvements�
on adjacent property, and Grantee shall not constructt or install any such
improvements on or within the property described in�Exhibit "A".
• RESERVING unto the Grantor an easement over the described property for .
the purposes of ingress and egress to Grantors property, and further : � _
providing that this tempoi-ary easement shall terminate and be of no
further force or effect upon the earlier to occur of twelve (12) months
from date of recordation hereof, or upon the recordation of an affidavit of
the Executive Director of Grantee certxfying that the construction af the_
proposed sewer improvements are suf�iciently complete for the purpose of
terminating this easemente � ' �
It shall be the duty of the Grantee to restore the gremises coverec� by
this easement to the similar condition that was existent thereon prior to
. the entry or entries thereon by the Grantee pursuant to this grant of
easement. •
