Box 727 Jupiter, Florida 33453 Dear Jan: Re: Water Service Heritage Oaks Subdivision We have reviewed the above referenced. matter with the Water Department Consulting Engineer and Village Attorney and reviewed the past correspondence and meeting minutes as pertaining to the referenced subject. Our records indicate that on January 26, 5.977, we submitted pages from the December 14 and 26, 5.976 Council Meeting minutes in regard to the subject. The minutes of the December 26, 1976 Council Meeting made the provision of water service for the subdivision subject to the construction of the water main on County Line Road and. across the north fork of the Loxahatchee River as discussed at the December 26, 1976 Council Meeting and in Mr. Sydow's December 22, 1976 letter. As you are aware, water provided is for domestic water supply only and not for irrigation purposes. The Water Department Consulting Engineers have been authorized to proceed with the preparation of the plans and specifications for the construction of a 12 inch water main on County Line Road and across the north fork of the Loxahatchee River. December 22,,',1976 1 Mayor and Councilmen Village of Tequesta,�� Pest Office Box 3273 Tequesta, Florida 33458 Re: Heritage Oaks Subdivision @� Request for Water Service Dear Mayor Campbell and Councilmen: In accordance with your instructions, we have made a study of the feasibility of the Village providing water to the Heritage Oaks Subdivision. The subdivision is bounded on the north by Jonathan Dickinson State Park, on the east by the North Fork of the Loxahatchee River and on the south by Turtle Creek. The subdivision consists of 194 single family lots, plus a small parcel of land to be used for recreational purposes. The lots are large, averaging about 19, 000 square feet in area. The proposed development was discussed with Mr. L. E. Lindahl, the developer's engineer. Mr. Lindahl stated that the requested water supply was for domestic use only and that a separate supply ,% of water for lawn irrigation was to be obtained within the develop- `� ment. Mr. Lindahl estimates that the water demand will not exceed 88, 200 gallons per day. His estimate is reasonable. The estimated building construction rate is 40 houses per year. Mayor and Councilmen Village of Tequesta December 22, 1976 - Page Two When the facilities to be constructed under the $2, 500, 000 bond issue, (including the water main on County Line Road and across th-e North Fork) are completed the project can be provided with a domestic water supply, including fire protection. This can be done without jepordizing the existing and potential customers within the existing service area. Water for irrigation purposes can not be provided. If the Council decides to provide water to Heritage Oaks, it is our recommendation that it be done with the following constraints: 1. The water distribution system be deeded to the Village to- gether with the necessary easements upon completion of construction. 2. That plans and specifications be approved by the Village Water Superintendent and the Village Engineer prior to construction. 3. That water meters and service be sized to supply adequate water based on the number of plumbing fixtures in each house. Requests for meters over 1 inch in size shall be approved by the Village Engineer. It should be pointed out that if Heritage Oaks is served, no addi- tional customers can be served outside of the existing service area west of the North Fork until an additional source of water is obtained and additional improvements to the distribution system are made. Council discussed the December 22, 1976 letter from Gee & Jenson Engineers on the study of the feasibility of the Village providing water to the Heritage Oaks Subdivision. Mr. Sydow stated that Mr. Lindahl's estimates that the water demand will not exceed 88,200 gallons per day is reasonable. There were four (4) constraints put on the supplying of water to Heritage Oaks, suggested by Mr. Sydow, Gee & Jenson. It was also pointed out that if Heritage Oaks is served, no additional customers can be served outside of the existing service area west of the North Fork until an additional source of water is obtained and additional improve- ments to the distribution system are made. There was input from the floor from Mr. Paul Thompson and Mr. Joe Blizzard. After discussion, Mr. Brown moved "that the Village of Tequesta provide potable water when available to the Village, on a retail basis for no more than 230 equivalent single family residential connections in Heritage Oaks Subdivision in Martin County, Florida, upon completion of the inter connection with Tri- Southern Utilities, and all other necessary improve- ments to _the water d,igtrihution System sUhig2t to all rules and regu lations - er subject to recommendations of December 22, 1976 letter of Gee & Jensen and subject to there being no legal or other impediments which would preclude the Village from servicing said area. All engineering and legal fees expended in regard to this matter shall be paid by the developer of the project ". Huggins seconded and vote on the motion was: Brown For Campbell For Huggins For Yoder For and was therefore passed and adopted. The next item on the agenda was a decision on a petition for waiver of Mr. Charles P. Martyn III of Section 2 (b) Ordinance No. 2.39 (vehicle parking). There were people from the Country Club who objected to any waiver of the Ordinance. Brown moved, "that the variance not be granted ". Yoder seconded. Vote on the motion was: Brown For Campbell Against Huggins Against Yoder For and the motion was therefore denied. 12� -14 -76 -2 Brown moved that Mr. William Wag be " gn a ppointed to a two (2) year term as a regular member. of the Zoning Board of Adjustment and Mr. Jacob J. Blair be appointed as the alternate ". Huggins seconded and the motion was adopted. Mr. Alexander Reynolds, Beach Road Association read a letter to the Council from the Beach Road Association in reference to their concern on beach erosion. Council talked at some length on the matter and heard comments from the floor. Yoder moved, "to authorize the Village Attorney to prepare a Resolution expressing to Palra Beach County Commission our concern with the beach erosion taking place in our beaches and request that they research the situation ". The motion was adopted with Campbell. opposing. Mr. .William B. Scott, U.S.G.S. presented to Council the U.S.G.S. Annual Report and review to the Council and audience with a slide projector and was asked several questions by Council. Mr. L.B. Lindahl, Jr., Lindahl, O'Brien & Browning, Inc. was present to represent his client EPCO- Tequesta Associates, Inc. and informed Council of plans for the Heritage Oaks development. There are some proposed 1% single- family lots and they would like to purchase water :from the Village of Tequesta Water System. The subdivision is bounded on the north by Jonathan Dickinson State Park, on the east by the North Fork of the Loxahatchee River and on the south by Turtle Creek. The water supply would be for domestic use only and a separate supply water for lawn irrigation was to be obtained within the development. Council directed Mr® William Sydow, Gee & Jenson, to prepare a brief on the request and report back to Council, with the cost to be incurred by Mr. Lindahl's client. Brown moved, "we are generally in favor of going- forward with point No. 1 as contained in the letter,be dependent upon a favorable report from our engineering and legal :firm ". Huggins seconded. The motion was adopted. Yoder moved, "they get it (annual distribution for employees Christmas) ". The motion was adopted. Brown moved, "that it be closed (Village office closed 2 day December 23, 1976 and all day December 24, 1976 and 2 day December 30, 1976 and all day December 31, 1976, which would complete the eight (8) paid holidays for the year)". The motion was adopted. Huggins asked that the County Commissioners be notified that the Village of Tequesta would appreciate the construction of alternate A1A be done with speed. The Council was in agreement. E. Lindahl, the Engineer for Jupiter Hills Village, setting forth the following projected water use: 75 Single family units @ 400 gpd = 30,000 gpd 285 Multi- family units @ 300 gpd = 77,400 gpd 2 Club Houses @ 3000 gpd = 6,000 gpd TOTAL 113,400 gpd It is Mr. Lindahl's opinion that the projected water use is the maximum that can be anticipated for the proposed development. inasmuch as irrigation of lawns and orna- mentals will be furnished by a separate system, we con- cur with Mr. Lindahl's estimate. With the completion of the pumping and storage facilities at Well Field No. 4, the Village water system will be capable of furnishing the requested water. The recently completed improvements to the water distribution system on County Line Road between U.S. Highway No. 1 and Sea- brook Road are capable of providing for these anticipated water demands. It is our opinion that the Jupiter Hills Village would be a desirable customer for the Village water system and it is recommended that the Village water system serve Jupiter Hills Village.
