ZONIlVG. AT ARTICLE I. IN GENERAL. BY AMENDING SEC. 15-6. SUPPLEMENTAL DISTRICT REGULATIONS. CREATING AN ENTIRELY NEW SUB-SECTION (i). TO BE ENTITLED "MAILBOXES". PROVIDING REGULATIONS FOR MAILBOX AESTI�TICS; PROVIDING FOR ARCHITECTURAL C4MMITTEE REVIEW UNDER CERTAIN CIRCUMSTANCES; RE- LETTERING THE EXISTING SUB-SECTION (i) AS SUB-SECTION (j); ALSO AMENDING SEC. 15-10(e). TI-� ARCHITECTURAL COMMITTEE. TO PROVIDE FOR ARC REVIEW OF CERTAIN CURBSIDE MAILBOX DESIGNS; PROVIDING THAT EACH AND EVERY OTI-�R SECTION AND SUBSECTION OF CHAPTER 15. ZONTNG. SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Atlantis desires to provide for regulations regarding mailbox aesthetics; and WHEREAS, the City Council of the City of Atlantis believes that Architectural Committee review of non-traditional or atypical mailbox aesthetics will help enhance the general appearance of the City streets; and WHEREAS, the City Council of the City of Atlantis believes that a zoning text change to implement such mailbox aesthetics regulations would be in the best interest of the health, safeTy and welfare of the citizens of Atlantis NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ATLANTIS, FLORIDA, THAT: Section 1: Chapter 15. Zoning. of the Code of Ordinances of the City of Atlantis, Florida, is hereby amended at Article I. In General. at Section 15-6. Supplemental District Regulations. by creating an entirely new sub-section (i) entitled "Mailboxes" providing aesthetics regulations for mailboxes; providing for Architectural Committee review u.nder certa.in circumstances; providing that Section 15-6. shall hereafter read as follows: -1- Sec.15-6. Supplemental District Regulations. (a) —(h) (Sha11 remain the same as previously adopted.) � Mailboxes. All curbside mailboxes within the Ciiv are subiect to the followin�: 1� All curbside mailboxes sha11 comnlv with USPS STD 7A. or the otherwise current United Sta.tes Postal Service regulations which �overn the desi�n of curbside mailboxes. 2� Curbside mailboxes. includins the mountin� nos� mav be black. white. or anv other color or colors that match the colors of the urincinal structure located on the nronertv. 3� Anv curbside mailbox that is not the traditional dome-rectanQUlar shane, mounted on a sinsle nost of traditional desim. or anv curbside mailbox tha.t is decorated other than as set forth in nara.granh (2l above. must be reviewed and annroved bv ARC nrior to insta.11ation. 4� Anv lawfullv existin� mailbox at the effective date of this sub-section re�ardin� mailboxes that could not be built under the terms of this sub-section or that could not receive ARC annroval under the terms of this sub-section and Sec. 15-10(e)(41c. of the Citv's zonin� code mav continue so lon� as it remains otherwise lawful subiect to the followin� nrovisions• a. No such mailbox mav be enlarsed or altered in anv wav which increases its non- conformitv; b. Should such mailbox be destroved bv anv means to an extent of more than fiftv 501 nercent of its assessed value at the time of destruction. or fall into a sta.te of disrenair such that it is found to be in violation of the Citv's minimum uronertv standards bv the Code Enforcement Board or Snecial Ma�istrate it sha11 not be reconstructed or renaired excent in conformitv with the nrovisions of this sub- section: c. Should such mailbox be moved for anv reason for anv distance whatever. it sha11 thereafter conform to the vrovisions of this sub-section. �} � Preapplication conference. (Sha11 remain the same as previously adopted.) Section 2: Chapter 15. Zoning. of the Code of Ordinances of the City of Atlantis, Florida, is hereby amended at Article I. In General. at Section 15-10. Administration, enforcement and building permits. at sub-section (e) The architectural committee. to provide for -2- .ARC review of certain curbside mailbox designs; and to provide for review criteria; providing that Section 15-10. sha11 hereafter read. as follows: Sec.15-10. Administration, enforcement and building permits. (a) —(d) (Sha11 remain the same as previously adopted.) (e) The architectural committee. (1) -(2) (Shall remain the same as previously adopted.) (3) Powers and duties; plans and spec�cations. The architectural committee sha11 review every application for a permitt to erect a building, sign, or structure of any kind, whatsoever, includin� non-traditional (see Sec. 15-6(ill curbside mailboxes or to alter, remodel, repair, or change the exterior of any structure within the city, including satellite dish applications. The architectural committee shall also review every application for the installation of permanent emergency electrical generators on any properiy within the city. For purposes of this chapter, any such generator sha11 be considered as equipment and not as a"struciure;" however, a building permit for installation is required and a11 building code requirements shall be met. Every application for permit shall be accompanied by two (2) sets of detailed plans and/or detailed specifications. No application for a permit sha11 be deemed proper before the azchitectural committee until a11 plans and specifications, when required, including landscape plans, have been provided as herein set forth and reviewed by the building official. The architectural committee shall function as the final decision-making authority with regard to approval of matters set forth in this section. If an applicant disagrees with the decision of the architectural committee, such applicant may appeal this decision to the city council. When a decision is so appealed, the city council shall act as the final decision making authority with regard to the matter appealed but may not waive requirements specifically set forth in the code. The applicant shall have thirty (30) days from the day of the decision of the architectural committee, exclusive of the day the decision is rendered, in which to notify the city manager, in w�iting, that the applicant desires to appeal. The city council shall act upon the appeal within forty-five (45) days of the date notice is furnished to the city manager, exclusive of the da.y on which the notice is furnished. If the applicant is seeking a variance from code requirements as opposed to review of the architectural -3- committee's decision, application must be made to the Atlantis Board of Adjustment in a timely manner as set forth in section 15-9 of the Atlantis Zoning Code. (4) Criteria for board action. a. (Sha11 remain the same as previously adopted.) b. (Shall remain the same as previously adopted.) c. T'he architectural committee shali likewise review a�lications for nermits to install "non-traditional" mailboxes nursuant to Sec. 15-6(i) above. Prior to an�rovin� the annlication. the committee sha11 confirm the followin�: i. The nroDOSed mailbox should accentuate and comnliment the architecture of the nrincinal structure located on the nronertv. ii. The nronosed mailbox should be of a aualitv such as not to cause the nature of the local environment or evolvin� environment to materiallv denreciate in apnearance and value. iii. The nronosed mailbox should be harmonious with the surroundin� landscanins and develonment in the area. and in �eneral. contribute to the image of the citv as a nlace of beautv. snaciousness. harmonv. taste. fitness broad vistas and hi�h aualitv. (5) —(6) (Sha11 remain the same as previously adopted.) Section 3: Each and every other Section and Subsection of Chapter 15. Zoning. shall remai.n in full force and effect as previously enacted. Section 4: All Ordi.nances or parts of Ordinances in conflict herewith be and the same are hereby repealed. Section 5: Should any Section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder of this Ordinance. Section 6: Specific authority is hereby granted to codify and incorporate this Ordinance into the existing Code of Ordinances of the City of Atlantis.
