RESOLUTION 1413
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, CALLING FOR A
SPECIAL MUNICIPAL ELECTION TO BE HELD TUESDAY,
AUGUST 27, 2013 FOR THE PURPOSE OF HOLDING TWO
SEPARATE ANNEXATION REFERENDUMS PURSUANT TO
SEC. 171.0413, FLORIDA STATUTES; REQUESTING THE
PALM BEACH COUNTY SUPERVISOR OF ELECTIONS
CONDUCT THE ELECTION; DESIGNATING POLLING
LOCATIONS; NAMING THE CANVASSING BOARD;
ESTABLISHING ELECTION PROCEDURES; PROVIDING AN
EFFECTIVE DATE; Al�iD FOR OTHER PURPOSES.
WHEREAS, Sec. 171.0413, Florada Statutes provides for annexation of unincorporated
areas into a municipality by referendum; and
WHEREAS, the Village Council of the Village of Tequesta desires to have a special
election on August 27, 2013 for the purpose of holding two annexation referendums, and
requests the Palm Beach County Supervisor of Elections conduct the special election; and
WHEREAS, Chapter 2, Article 5 of the Village Code of Ordinances provides that the
Village Clerk, or designee, alon� with the Pa1m Beach County Supervisor of Elections, or
designee, and one Council Member (which can include the Mayor) whose position is either not
scheduled to be voted upon or who is unopposed at the election being canvassed, shall be
appointed to serve as the Canvassing Board for all Village elections; and
WHEREAS, Chapter 2, Article V of the Village Code of Ordinances further provides
that the Village Clerk may appoint or hire as many inspectors of election, and other election
workers as deemed necessary to conduct elections in the Village; and
WHEREAS, tl�e Village Council of the Village of Tequesta desires to designate polling
locations, and establish election procedures for the Special Election on August 27, 2013.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Seetion 1. Notice is hereby given that a Special ElectiQn is scheduled to be held on Tuesday,
August 27, 2013. The polling locations will be:
Precinct 1096
First Baptist Church of Tequesta
423 Tequesta Drive
Tequesta, FL
Precinct 1114
Tequesta Terrace Assisted Living
400 N. US 1
Tequesta, FL
The polls will be open from 7:00 a.m. to 7:00 p.m.
Section 2. In accordance with the provisions of Section 3.04 of the Village Charter, the Village
Clerk shall be the Clerk of Elections and sha11 supervise the conduct of the Special Election in
accordance with the State of Florida. Election Laws and the Village of Tequesta Code of
Ordinances.
Section 3. The Palm Beach Cou.nty Supervisor of Elections is hereby requested to conduct
the election pursuant to the Vote Processing Equipment Use and Election Services Agreement,
effective January 1, 2013.
Section 4. Pursuant to Chapter 2, Article V of the Village Code of Ordinances, the Village
Clerk, or designee, along with the Pa1m Beach County Supervisor of Elections, or designee, and
one Council Member (which can include the Mayor) whose position is either not scheduled to be
voted upon or who is unopposed at the election being canvassed, shall be appointed to and
constitute the Village of Tequesta.'s Canvassing Board for the purpose of conducting the General
Municipal Election and, if necessary, the Runoff Election.
Section 5. The provisions of the Florida. Elections Code relating to absentee ballots shall apply
to the Special Election allowing the Palm Beach County Supervisor of Electians to canvass the
absentee ballots, and attend the Logic and Accuracy Test, for the Village of Tequesta,
Section 6. The Palm Beach Cou.nty Supervisor of Elections is hereby designated to tabulate the
ballots cast at the August 27, 2013 Special Election.
Section 7. The Village Clerk is hereby directed to post this Resolution in the Village
Administrative Offices immediately after passa.ge, and provide a certified copy to the Pa1m
Beach County Supervisor of Elections.
