MEETING MINUTES
May 16, 2013
1. CALL TO ORDER AND ROLL CALL
The Village of Tequesta Planning & Zoning Advisory Board sitting as the Local Planning
Agency held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta
Drive, Tequesta, Florida, on Thursday, May 16, 2013. The meeting was called to order
at 5:3Q p.m. A roll call was taken by Gina Lawrence, Gommunity Development Clerk,
who noted the following were present: Chair James Hackett, Vice Chair Michael
Schmidt, Board Member Elizabeth Schauer, Board Mernber Steven Eagen, Board
Member Janet Strand, Alternate Sebastian Loaiza, and Alternate Ashley Warren. Also
presert were Community Development Director Nilsa Zac�rias, Village Attorney Keith
Davis, and Community Development Clerk Gina Lawrence.

MOTION
Board Member Schauer moved to approve the agenda as submitted. Board Member
Eagen szconded the motion, which carried by unanimo�rs 5-0 vote.

5. ORDINANCE NO. 11-13
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
the Village Code of Ordinances at Chapter 22, Community Development, by
Planning � Zoning Advisory Board Sitting as the
Locai Planning Agency

amending this Chapter to provide internal consistency, to provide final decision-
making authority to the Planning and Zoning Advisory Board for certain Site Plan
Modi�cations; to provide procedures; collection of Administrative Fees; and to
clarify certain aesthetic definitions and policies; providing that each and every
other Section and Subsection of Chapter 22 shall remain in full force and effect as
previously adopted; providing a conflicts clause, a severability clause and
authority to codify; providing an effective date; and for other purposes.
The Village Attorney read Ordinance No. 11-13 into the record and provided a
description. Community Development Director Nilsa Zacarias distributed and reviewed
a new ordinance containing revisions by Village Council, providing authority to staff to
handle certain building requests and removing the need to go to Planning and Zoning.
Chair Hackett described for new Board Members the role of the Local Planning Agency
and Planning and Zoning Board regarding recommendations to the Village Council.
Attorney Davis clarified this Ordinance would impact Planning and Zoning, and not the
Local Planning Agency.

Board Member Schauer moved to approve Ordinance No. 11-13 as revised by Village
Council. Vice Chair Schmidt seconded the motion which carried by unanimous 5-0
vote.

speciai exception and �ther conc�rns. Comrr��nity Development Qirector Nilsa Zacarias
clarified that the existing ar�imal hr�spital located or 364 Cypress Dr. was permitt�d in
2009. i/i!iage Attorney Davis summari�ed the Bc�ard's cornrrzents, indicating the �oard
recommendation to ap�rove this use as a special exception use; outdoor facilit�es must
be fenced, contained, and buffered from residential concerns; no outside/overnight
boarding; and outdoor activities would be limited from dawn to dusk.

MOTION
Board Member Schauer moved to approve Ordinance No. 15-13 with recommendation
to the Village Council to amend the verbiage to change permitted use to special
exception; to require outdoor facilities to be fenced, contained, and buffered from
residential concerns; to prohibit outside%vemight boarding; and to limit outdoor
activities from dawn to dusk. Board Memb�r Strand seconded the motion, which
carried by unanimous 5-0 vote.
7. PUBLIC COMNIENT –
Tequesta resident Dr. Joy Sutton advised she wanted to open a veterinary clinic with no
outdoor areas in the C-3 District.
8. ANY OTHER MATTERS
Board Member Schauer expressed concern that hurricane season was near and
telephone poles requested to be fixed six months ago had not been fixed. Attorney
Davis advised he would discuss this mafter with the Village Manager the nexi day.
