PUBLIC HEARING MEETING MINUTES
DECEMBER 10, 2012
CALL TO ORDER AND ROLL CALL
The Village of Tequesta Board of Adjustment held a regularly scheduled Public
Hearing at the Village Hall Council Chambers, 345 Tequesta Drive, Tequesta,
Florida, on Monday, December 10, 2012. The meeting was called to order at 6:00
p.m. A roll call was taken by Deanna Mayo, Assistant to the Village Clerk. Present
were: Chair Steve Pullon, Vice Chair Paul Brienza, Board Member Randy Kaye
Garvey who arrived at 6:02 p.m., Board Member Matt Belger, Alternate Ward
Bertholf, and Alternate Leslie Dasher. Board Member Jon Newman was absent
from the meeting. Also in attendance were Community Development Director
Nilsa Zacarias, Attorney Jennifer Gaston, Assistant to the Village Clerk Deanna
Mayo, and Community Development Staff Member Gina Lawrence.
APPROVAL OF AGENDA
1. Approval of Previous Meeting Minutes
MOTION
Board Member Belger moved that the minutes for the meeting of August 13, 2012 be
approved as submitted. Vice Chair Brienza seconded the motion. The motion
carried by unanimous 5-0 vote.
2. NEW BUSINESS
Attorney Gaston read the following request for variances into the record:
V 10 —12
Request for variances in order to construct additions onto an existing single-family
structure: Relief from Sec. 78-95 to allow enlargement of a non-conforming building;
Relief from Sec. 78-143 to allow a front setback of 24.4 feet where the code requires
a minimum of 25 feet. The applicant is Richard Black. The address of the property
is 387 Evergreen Ave., Tequesta, Florida 33469. The legal description is Lot 8, Block
17, Jupiter in the Pines, Section "B". The property is located in zoning District R-1.
A. Swearing-In of Witnesses
Attorney Gaston swore in Mr. Richard Black, Mrs. Carly Black, and
Community Development Director Nilsa Zacarias.

Chair Pullon, Vice Chair Brienza, Board Member Garvey, and Board Member
Berthoff each disclosed that they had visited the site but spoke to no one.
Board Member Betger reported he had spoken to no one and had not visited
the site.
C. Testimony of Witnesses and Cross Examination, if any
Richard Black commented he wanted to enclose the back porch and add a
bedroom beside it. He explained that when the house was built it extended
eight inches into the 25 foot setback required by current code. It was
unknown what the code had been at the time the house was built.
Community Development Director Zacarias explained many properties in the
Village had the same problem, and the Village was in the process of
changing the code so that these properties would not need variances in the
future if they extended into the setback or for finish floor elevation.
Community Development DirectorZacarias reported she had spoken to one
neighbor who lived at 390 Evergreen and answered her questions, and she
was fine with the variance request, and also with a neighbor concerned with
the hours of work on the project.
D. Finding of Fact Based Upon Competent Substantial Evidence
MOTION
Board Member Berthoff moved to approve the request for a variance to allow
enlargement of the non-conforming building and a front setback of 24.4 feet on the
property located at 387 Evergreen, Tequesta, Florida. Board Member Belger
seconded the motion. The vote on the motion was:

Paul Brienza - for
Randy Kaye Garvey — for
Matt Belger - for
Ward Bertholf - for
The motion was therefore passed by unanimous 5-0 vote.

There were no comments from the public.

BOARD COMMENTS
Board Members indicated they had code supplements but needed the code books.
Assistant to the Village Clerk Mayo indicated she would supply books to those who needed
them.
ADJOURNMENT
MOTION
Vice Chair Brienza moved that the meeting be adjourned at 6:12 p.m. Board Member
Belger seconded the motion. Motion carried by unanimous 5-0 vote.
