Due to the lack of enforcement over the last few years and to prevent selective enforcement, I suggested to the Chief that we do a sweep of all the commercial areas and all out door displays of advertising starting next week, July 2nd. As you may recall, from years past in enforcing the ordinance if we ask one business to remove their signs they will point to another business and it will create a snow ball effect. Therefore the sweep is necessary. The sweep will start with a courtesy notice that will be given to the business owner or manager either verbally (preferred) or by posting or door hanger. The courtesy notice will require compliance upon receipt if possible or 24 hrs at most. The sweep of the entire village should take about two business days. The following week, on July 8` and 9` a follow up inspection will be conducted to verify compliance. For those who do not achieve compliance, per F55 162 requirements, the property owner and registered agents per The Florida Department of State along with the addresses listed on the Property Appraisers and Tax Collectors Office as well as any property manager's listed in our records will receive a notice of violation via certified mail. The notice of violation will also be posted on the property (business door) or signed for by the business manager, all per FSS 162 requirements. The notice of violation will give 24 hrs to comply. Per FSS 162 requirements, after verifying proper notice was given to the property owner and all those with financial interest and or registered agents by verifying certified mail was delivered/refused/unclaimed ect. for each property, for those who fail to comply a notice of hearing will be issued the same way the notice of violation was issued (certified mail, posting ect.) per FSS 162 requirements. I gave a brief outline to help explain the process and that it may take some time to achieve total compliance. Keeping in mind the business owner is ultimately not responsible for the violation per FSS 162, but the property owner is and will receive fines and liens if necessary. After the initial courtesy notice we should receive about a 70-75 percent compliance rate going on past experiences from sweeps of the same violation. Those businesses who are cited in the sweep and fail to comply will most likely appear at the August 22" Code Enforcement Special Magistrate Hearing.
