We shall then wait approximately three weeks before re- installing tiles. Work shall be done in the following fashion on the following area(s). 1. Exploratory tile field leak on rear side above center flat deck. This leak repair may require more man hours to complete leak repair if stains continue up toward ridge and or down to roof edge below beyond a 4x6 area. I estimate 16 -20 flours for this repair. c' 2p 42 b ` -* l �c �JoT -0 Z.%') C,r- All work shall be done on a time and material basis with rate set at $69.00 per man hour for all time spent for job. This includes drive time; time spent picking up materials as well as disposing of debris from your job and any time spent due to your job. NOTE: In some cases tiles are no longer made and in most cases tiles will not match existing tiles even if the exact tile in the same color is found due to fading of tiles, therefore we have no choice but to paint the tiles with the closest match we can get to your specific tile. We shall paint tiles only when necessary to get the closest match we can, however it will not be perfect. Payment is due on a percentage of completion method as we bill you. Any changes in payment schedule made by Duren Roofing or lack of getting a deposit is in no way evidence of this not being a true, legal contract once signed by both parties. Thank you for the opportunity to bid your work. If you have any further questions feel free to contact us further. Signing this proposal constitutes a contract. Contract cost estimates are valid for thirty days after the date on the authorized representative's signature line. Upon client signature, contract is in effect until completion of work. In the event that customer cancels the contract before any work has commenced, or during work at or for the property, customer shall be liable for liquidated damages in the amount of $ 1,000.00 if the job is a repair, and $ 5,000.00 if the job is a re -roof. In addition, homeowner shall be liable for all time and materials spent in connection whether on or off site (with rate set at $74.00 per man hour), for this job. In any legal action or proceeding related to, connected with or arising from this agreement, the prevailing party shall be entitled to reimbursement of its costs, including all reasonable attorneys' fees, whether incurred in or out of court, on appeal, arbitration or in any insolvency or bankruptcy proceedings. Any warranties, if listed on body of contract, are only to fix the defective roof area, and our liability is limited to that. We are not liable for consequential damage due to said roof leak. Our bills are due when sent without exception. Any bill not paid within fifteen days of completion shall be subject to a 1.5% per month finance charge in addition to any monies spent for bill collection. These finance charges shall continence from date of invoice(s) and interest shall accrue on all balances due. Any homeowner's association or architectural review board fee (or any fee besides permit & landfill fees) will be billed directly to client. Duren Roofing, Inc. is not responsible for any driveway or gutter damage. While we exercise reasonable care, damage to gutters is inevitable during the construction process. WAIVER OF JURY TRIAL: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES ANY AND ALL RIGHTS IT MAY HAVE TO A TRIAL BY JURY. Any work done by others to a reanof or a repair by non Duren Roofing employees voids any warranty provided by Duren Roofing. Any written notes on our contracts that are not initialed by our salesman and the contract signer with a date is void and not agreed to by Duren Roofing and while we may choose do the job it does not signify our agreement to said note. July 25, 2013 Village Hall Exploratory Tile Field Leak ADDENDUM Public Records: In accordance with Sec. 119.0701, Florida Statutes, the Contractor must keep and maintain this Agreement and any other records associated therewith and that are associated with the performance of the work described in the Scope of Services. Upon request, the Contractor must provide the public with access to such records in accordance with access and cost requirements of Chapter 119, Florida Statutes. Further, the Contractor shall ensure that any exempt or confidential records associated with this Agreement or associated with the performance of the work described in the Scope of Services are not disclosed except as authorized by law. Finally, the Contractor shall retain the records described in this paragraph throughout the performance of the work described in the Scope of Services, and at the conclusion of said work, transfer to the Village, at no cost to the Village, all such records in the possession of the Contractor and destroy any duplicates thereof. Records that are stored electronically must be transferred to the Village in a format that is compatible with the Village's information technology systems.
