We shall then wait approximately three weeks before re� instaliing iiies. Work shaii i�e done in ihe ioiiowing iashion on ihe iotiowing area(s). 1. Exploratory tile field leak on rear side above center flat deck. This leak repair may require more man hours to complete leak repair if stains continue up toward ridge and or down to roof edge below beyond a 4x6 area. I estimate 16-201�ours foi• this repair. All work shall be done on a time and material basis with rate set at $69.00 per man hour for all time spent for job. This includes drive time; time spent picking up materials as well as disposing of debris from your job and any titne spent due to your job. NOTE: In some cases tiles are no longei• made and in most cases tiles will not match existing tiles even if the exact tile in the same color is found due to fading of tiles, therefore we haVe no choice but to paint the tiles with the closest match we can get to yout° specific tile. We shall paint tiles only when necessary to get the closest match we can, however it will not be perfect. Payment is due on a percentage of completion method as w� bill you. Any changes in payment schedule made by Duren Itoofing or lack of getting a deposit is in no vvay evidence of tYus not being a true, legal contract once signed by both parties. In any legal action or proceeding related to, connected with or arising from this agreement, the prevailing pariy shall be entitled to reimbursement of its costs, inchiding alt reasonable attorneys' fees, whether incun'ed in or out of court, on appeal, arbitration or in any insolvency or bankruptcy proceedings. Any warranties, if listed on body of conhact, are only to fix the defective roof area, and our liability is limited to that, We are not liable for consequential damage due to said roof leak. Any Uill not paid within fifteen days of completion shall be subject to a I.5 % per month finance charge in addition to ' any monies spent for bill collection, These finance chazges shall conunence from date of invoice(s) and interest shall accrue on all balances due. Any homeowner's association or i architectural review boazd fee (or any fee besides permit & landfill fees) will be billed directly to client. Duren Roofing, Inc. is not responsible for any driveway or gufler damage, While we exercise reasonable care, damage to gutters is ittevitaUle during the consh'uction process. Upon request, the Contractor must provide the public with access to such records in accordance with access and cost requirements of Chapter 119, Florida Statutes. Further, the Contractor shall ensure that any exempt or confidential records associated with this Agreement or associated with the performance of the work described in the Scope of Services are not disclosed except as authorized by law. Finally, the Contractor shall retain the records described in this paragraph throughout the performance of the work described in the Scope of Services, and at the conclusion of said work, transfer to the Village, at no cost to the Village, all such records in the possession of the Contractor and destroy any duplicates thereof. Records that are stored electronically must be transferred to the Village in a format that is compatible with the Village's information technology systems.
