CALL TO ORDER AND ROLL CALL The Village of Tequesta Planning & Zoning Advisory Board sitting as the Local Planning Agency held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta Drive, Tequesta, Florida, on Thursday, June 20, 2013. The meeting was called to order at 5:45 p.m. A roll call was taken by Community Development Director Nilsa Zacaris, who noted the following were present: Chair James Hackett, Board Member Elizabeth Schauer, Board Member Janet Strand, and Alternate Ashley Warren. Also present were Community Development Director Nilsa Zacarias, Village A�torney Keith Davis, and Village Manager Michael R. Couzzo, Jr. 2. APPROVAL OF AGENDA MOTION Board Member Schauer moved to approve the agenda as submitted. Board Member Strand seconded the motion, which carried by unanimous 4-0 vote. 3. APPROVAL OF PREVIOUS MEETING MINUTES MOTION Board Member Strand moved to approve the minutes of the May 16, 2013 meeting as submitted. Board Member Warren seconded the motion, which carried by unanimous 4-0 vote. 4. MOTION TO RE-ORDER AGENDA MOTION Board Member Schauer made a motion to re-order the agenda to move item 6, Ordinance No. 22-13 to the second item on the agenda. Board Member Strand seconded the motion, which carried by unanimous 4-0 vote. 5. ORDINANCE NO. 22-13 An Ordinance of the Village Council of the Village of Tequesta, Florida, amending the Village Code of Ordinances at Chapter 78, Zoning, Article I, in General, Sec. 78-4, Definitions, by amending the definition for "Rehabilitation Facility" to provide for the limited provision of outpatient treatment, and the limited collection of insurance payments for patient care; and by amending Article VI, � Planning & Zoning Advisory Board Sitting as the Local Planning Agency . MEETING MINUTES June 20, 2013 Page 2 of 5 Schedule of District Regulations, Sec. 78-180(i)(16)MU Mixed Use District. Special Exception Uses, Rehabilitation Facilities, to require both monthly reports and an annual independent audit be provided to the Village regarding compliance with funding, occupancy and treatment requirements; and at Article X, off-street and on-street parking and loading regulation, by increasing the parking requirements for rehabilitation facilities that provide outpatient treatment; providing that each and every other section and subsection of Chapter 78 shall remain in full force and effect as previously adopted; providing a conflicts clause, a severability clause and authority to codify; providing an effective date; and for other purposes. The Village Attorney introduced Ordinance No. 22-13 into the record and provided a description of changes proposed to rehabilitation facilities. Mike Holloway, Futures of Palm Beach, who had requested these changes, described why they were needed. Village Manager Couzzo reported the new language had been crafted to assure it continued to provide the safeguards as provided in the original ordinance, and had been adopted by DCF. This would go forward to Village Council for special exception reading plus two readings of the ordinance. MOTION Board Member Schauer moved to recommend approval to Village Council of Ordinance No. 22-13 as submitted. Board Member Strand seconded the motion, which carried by unanimous 4-0 vote. 6. ORDINANCE NO. 18-13 An Ordinance of the Village Council of the Village of Tequesta, Florida, amending the Village Code of Ordinances at Chapter 62, Planning and Development, by amending this Chapter to provide internal consistency and consistency with the Village's Comprehensive Development Plan, to update certain references to State law, and to repeal the requirement for an annual concurrency report; providing that each and every other section and subsection of Chapter 62 shall remain in full force and effect as previously adopted, providing a conflicts clause, a severability clause, and autharity to codify; providing an effective date; and for other purposes. The Village Attorney described proposed changes and answered questions from the Board. Board Member Strand seconded the motion, which carried by unanimous 4-0 vote. 7. ORDINANCE NO. 19-13 An Ordinance of the Village Council of the Village of Tequesta, Florida, amending the Village Code of Ordinances at Chapter 30, Environment, by renaming this Chapter "Environmental Control; Nuisances" and by clarifying certain language, providing for internal consistency, updating enforcement procedures in conformance with the Village's Code Enforcement process; relocating vegetation obstruction regulations to Chapter 50; relocating construction debris and construction site maintenance regulations to Chapter 14; revising abatement procedures related to certain private property violations; and updating noise enforcement regulations in accordance with recent changes to the law; providing that each and every other section and subsection of Chapter 30 shall remain in full force and effect as previously adopted, providing a conflicts clause, a severability clause, and authority to codify; providing an effective date; and for other purposes. The Village Attorney explained the proposed changes in Ordinance No. 19-13 and answered questions from the Board. MOTION Board Member Schauer moved to recommend approval to the Village Council of Ordinance No. 19-13. Board Member Warren seconded the motion, which carried by unanimous 4-0 vote. 8. ORDINANCE NO. 20-13 An Ordinance of the Village Council of the Village of Tequesta, Florida, amending the Village Code of Ordinances by relocating the Village's Land Clearing and Construction Debris Control Code from Article VII of Chapter 30 to the newly created Article VI9 of Chapter 14; and by relocating the Village's Construction Site Maintenance Code from Article VIII of Chapter 30 to the newly created article VIII of Chapter 14, providing a conflicts �lause, a severability clause, and authority to codify; providing an effective date; and for other purposes. The Village Attorney explained the proposed changes in Ordinance No. 20-13 and answered questions from the Board. MOTION ' Planning � Zoning Advisory Board Sitting as the Local Planning Agency . Board Member Warren seconded the motion, which carried by unanimous 4-0 vote. 9. ORDINANCE NO. 21-13 An Ordinance of the Village Council of the Village of Tequesta, Florida, amending the Village Code of Ordinances at Chapter 50, Natural Resource Protection; by amending this Chapter to provide internal consistency, to update certain permitting requirements and appeal requirements, to make reference to State Mangrove Protection Laws and County Wellfield Protection Regulations; to relocate Vegetation Obstruction Regulations from Chapter 30; and to provide Code Enforcement Penalties for unlawful tree removal; providing that each and every other section and subsection of Chapter 50 shall remain in full force and effect as previously adopted, providing a conflicts clause, a severability clause, and authority to codify; providing an effective date; and for other purposes. The Village Attorney explained the proposed changes in Ordinance No. 21-13 and answered questions from the Board. Hedge heights and traffic sight triangles were discussed. MOTION Board Member Schauer moved to recommend approval to the Vil/age Council of Ordinance No. 21-13. Board Member Warren seconded the motion, which carried by unanimous 4-0 vote. 10. PUBLIC COMMENT - None 11. BOARD COMMENT Chair Hackett reported his conversation with Cornmunity Development Director Zacarias regarding the staff initiated application at the last meeting, and commented he thought the Board had handied the situation well. ADJOURNMENT There being no further business to come before the Board, upon motion by Board Member Schauer, seconded by Board Member Warren and carried by unanimous 4-0 vote, the meeting was adjourned at 6:27 p.m. - Planning & Zoning Advisory Board Sitting as the ; Local Planning Agency .
