HomeMy WebLinkAboutOrdinance_276_11/16/1979 ORDINANCE N0. 276 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ANNEXING CERTAIN PAP.CELS OF LAND TO THE TERRITORIAL LIMITS OF THE VILLAGE OF TEQUESTA WHEREAS, Subsection 29 of Section 4.02 of Article IV of the Charter of the Village of Tequesta grants the Village Council the power to annex any lands adjoining or within three miles of the territorial boundaries of said municipality and lying within the "natural boundaries" of said municipality upon the petition of the owner or owners thereof; and WHEREAS, Heinz VonZabern, President, JIB Club, Inc., the owner of a certain parcel of land situated in Palm Beach County, Florida, has filed a petition with the Village Council requesting that his land described therein be annexed to the territorial limits of the Village of Tequesta, Florida, NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. That the parcels of land owned by JIB Club, Inc., Heinz Von Zabern, President, and more particularly described as follows: Parcel No. l: Lot B, Jupiter Inlet Beach Colony, according to the plat thereof on file in the Office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book 24, Page 139 less that part of Lot B, said plat of Jupiter Inlet Beach Colony lying southerly of the westerly extension of the north right-of- way line of Lighthouse Drive. Parcel No. 2: A parcel of land in Section 31, Township 40 ^ South, Range 43 East, GOMEZ GRANT, Palm Beach County, Florida, being more particularly described as follows: Beginning at northeasterly corner of Lot "B", JUPITER INLET BEACH COLONY, according to the plat thereof, recorded in Plat Book 24, Page 139, Public Records of Palm Beach County, Florida; thence, westerly along the northerly line of said Lot "B" to its intersection with the southerly right-of-way line of State Road No. 707, accord- ing to the right-of-way map thereof recorded in Road Plat Book 2, Pages 70, 71 and 72, said point of intersection being ~_n the arc of a curve concave to the northwest and having a radius of 337.94 feet; thence, northeasterly along said right-of-way line, and along the arc of said curve, to a point in a line parallel to and 13 feet • • northerly from (measured at right angles to) the northerly line of said Lot "B", which is also the westerly extension of the northerly line of Lot 1 of said JUPITER INLET BEACH COLONY; thence, easterly along said parallel line to its intersection with the northerly extension of the westerly right-of-way line of Colony Road; as shown on said plat of JUPITER INLET BEACH COLONY; thence, southerly along said northerly extension to the north- east corner of said Lot "B", and the point of beginning. Said described parcels of land containing 2.74 acres, more or less. !,fare hereby annexed and incorporated into the Village of Tequesta, I ,Florida with the same force and effect as though same had I originally been incorporated into the territorial boundaries thereo: Said properties shall be zoned R-3 multiple family dwelling (district upon the termination of two (2) years from the effective date of this annexation ordinance or earlier if granted by the governing body of Palm Beach County, Florida; as provided in F.S. X171.062. Section 2. That said parcels of land shall be subject to all of the ordinances, regulations and codes of the Village of Tequesta, except as hereinabove provided. Section 3. That this Ordinance shall take effect upon Zits approval and passage as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember VJ. Harvey P~Tapes who moved its adoption. The Ordinance was seconded by Councilmember James H. Ryan and upon being put Ito a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Howard F. Brown W. Harvey Mapes James H.
