HomeMy WebLinkAboutOrdinance_271_07/24/1979• ORDINANCE N0. 271 • I A ZONING ORDINANCE OF THE VILLAGE OF !~ TEQUESTA, FLORIDA, ADOPTING A COMPRE- j HENSIVE PLAN, ITICLUDING A FUTURE LAND USE ELEMENT, PURSUANT TO THE LOCAL .E i~ GOVERNMENT COMPREHENSIVE PLANNING ACT ~ OF 1975. f WHEREAS, the Village Council of the Village of Tequesta, i~ Florida, has prepared a Comprehensive Plan after hearings held l upon due public notice; and ~~ WHEREAS, the said Comprehensive Plan contains all of the ~f elements required under Chapter 163.3177 of the Florida Statutes, ~f including a future land use plan element; and i WHEREAS, the Village Council of the Village of Tequesta, ~~1 after due notice and public hearings, deems it to be in the best ``~ interest of the public safety, health and general welfare to adopt, by Ordinance, the Comprehensive Plan of the Village of G Tequesta; NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL b OF THE VILLAGE OF TEQUESTA, FLORIDA: p. Section 1. That the Code of the Village of Tequesta, ~~ Florida, is hereby amended by adding a Chapter to be entitled i ~I Comprehensive Plan, which said Chapter reads as follows: ~" "~ COMPREHENSIVE PLAN r 6 $ Article I 1 3 Q STATUTORY AUTHORIZATION, PURPOSE AND OBJECTIVES A. Statutory Authorization. i The legislature of the State of Florida has enacted I jI Chapter 163.3161, Florida Statutes, entitled the Local Government ;i Comprehensive Planning Act of 1975. The Act requires municipal '~ corporations including the Village of Tequesta, to prepare and '( adopt Comprehensive Plans for each such minicipality. The I purpose of the Act is to utilize and strengthen the existing role, process and powers of municipal governments, in the establishment ii and implementation of comprehensive planning programs, to guide and control future municipal development. i ,~ ~• B. Purpose and Objectives. The Village of Tequesta, in adopting its Comprehensive Plan by this Ordinance, intends thereby to comply with all of the require i~ ~~~, ments of the Local Government Comprehensive Planning Act of 1975 andjl to obtain the following objectives. ~I 1. To preserve and enhance its present advantages; to encourage the most appropriate use of land, water and resources i consistent with the public interest; to overcome present handicaps; ~' and to deal effectively with future problems that may result from '; I I! the use and development of land within its jurisdiction. i 2. To preserve, promote, protect and improve the public health, safety, comfort, good order, appearance, convenience, law enforcement and fire prevention, and general welfare. 3. To prevent the overcrowding of land and avoid undue concentration of population; to facilitate the adequate and effi- cient provision of transportation, water, sewerage, schools, parks, recreational facilities, housing and other requirements and services; and to conserve, develop, utilize and protect natural ,r resources within its jurisdiction. 4. To encourage cooperation between the Village and Palm Beach County as well as with its adjoining municipalities and counties, and to encourage and assure coordination of its planning ', and development activities with those of all units of local govern- ment, with those of the regional agencies and with those of the State of Florida, in accord with the applicable provisions of law. 5. To obtain the legal status for its Comprehensive Plan I 'I ~~ which is provided under the Local Government Comprehensive Planning ~i ~ Act of 1975 and to insure that no public or private development !~ shall be permitted except in conformity with its Comprehensive Plan I, ii ' or elements or portions thereof which have been prepared and adopted in conformity with said Act. ii l 6. To protect human, environmental, social and economic ,, resources of the Village of Tequesta, and to maintain, through orderly growth and development, the character and stability of its ': present and future land use and development. i` • • Article II ADOPTION OF COMPREHENSIVE PLAN A. Adoption. The Comprehensive Plan, including all maps, graphs, exhibits forming a part thereof, and all the elements thereof, ~f including a future land use element, a copy of which Plan is attached hereto, marked Exhibit "A", and made part of this Ordinance by reference, is hereby adopted as the Comprehensive Plan for the Village of Tequesta, Florida, in conformity with and in furtherance of the Local Government Comprehensive Planning Act of 1975. The aforesaid Comprehensive Plan shall apply to the entire area now and hereafter under the jurisdiction of the Village of Tequesta and shall be the basis of all present and future regula- tions and zoning districts contained in the Village's Zoning Ordinance. All prior Zoning Ordinances and enactments of the Village of Tequesta are hereby ratified and confirmed as being in conformance with said Comprehensive Plan. B. Copy of Plan. A copy of the Comprehensive Plan, which is attached and made part of this enactment by reference, shall be kept permanently !. on file in the office of the Village Clerk and shall be available for the use, information and inspection of the general public and all interested parties at all reasonable times, but the same shall not be codified in the published edition of the Village Code of Ordinances. C. Review of Comprehensive Plan. The Village Council, as the designated Local Planning Agency, shall prepare periodic reports on the Comprehensive Plan at least once every five (5) years from the date of adoption hereof, or more often as the Council may require. In the preparation, handling, review and disposition of such reports, the Village Council shall follow the provisions and requirements of Chapter 163.3191 of the Florida Statutes. ~ •: D. Legal Status of Comprehensive Plan. The Village of Tequesta Comprehensive Plan shall have the legal status as set forth and contained in Chapter 163.3194 of the Florida Statutes, together with such further additional powers, authority and obligations as may thereafter be created by law. Section 2. Permission to codify this Ordinance is hereby granted. Section 3. This Ordinance shall take effect immediately upon its adoption. The foregoing Ordinance was offered by Council Member W. Harvey Mapes, Jr. who moved its adoption. The motion was seconded by Council Member ~t James H. Ryan and upon being put to a vote, the vote was as follows: FOR ADOPTION Howard F. Brown Leslie A.
