ORDINANCE NO. 2~9

AN ORDINANCE OF THE VILLAGE OF TEQUESTA,
FLORIDA ANNEXING CERTAIN PARCELS OF LAND
TO THE TERRITORIAL LIMITS OF THE VILLAGE
OF TEQUESTA
WHEREAS, Subsection 29 of Section 4.02 of Article IV of the
Charter of the Village of Tequesta grants the Village Council the power
to annex any lands adjoining or within three miles of the territorial
boundaries of said municipality and lying within the "natural boundaries"
of said municipality upon the petition of the owner or owners thereof;
and
WHEREAS, Thomas H. Daly and Virginia W. Daly and Daniel A.
DeNicola, the owners of certain parcels of land situated in Palm Beach
County, Florida, have filed petitions with the Village Council requesting
that their lands described therein be annexed to the territorial limits
of the Village of Tequesta, Florida:
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF TEQUESTA,
FLORIDA, AS FOLLOWS:
Section 1. That the parcel of land owned by Thomas H. Daly and
Virginia W. Daly and more particularly described as follows:
The North 100 feet of the South 300 feet of Government Lot 1
lying West of and contiguous to the West right-of-way line
of U.S. Highway No. 1, Section 30, Township 40 South, Range
43 East, Palm Beach County, Florida, less the North 35 feet
thereof; and
Section 2. That the parcel of land owned by Daniel A. DeNicola
and more particularly described as follows:
That part of the South 200 feet of Government Lot No. 1, in
Section 30, Township 40 South, Range 43 East, Palm Beach
County, Florida, which lies West of the right-of-way of U.S.
Highway No. 1.
are hereby annexed and incorporated into the Village of Tequesta, Florida,
with the same force and effect as though the same had originally been
incorporated into the territorial boundaries thereof.

Section 3. That said lands shall be subject to all of the
ordinances, regulations and codes of the Village of Tequesta.
Section 4. That this Ordinance shall take effect upon its
approval and passage as provided by law.
THE FOREGOING ORDINANCE was offered by Councilmember I"~r-~=`t.
who moved its adoption. The Ordinance was seconded
by Councilmember - Ma~e_.~__.~_ and upon being put to a vote,
the vote was as follows:

THE UNDERSIGNED, being the owners of the following premises

lying and being in Palm Beach County, Florida, and described as
follows: (Enter full legal description. Attach additional page if
necessary;
That part of the South 200 feet of Government Lot ~~1, in Section 30,
Township 40 South, Range 43 East, which lies West of the right of way
of United States Highway No. 1. Subject to all easements, restrictions,
and reservations of record and taxes subsequent to the year 1971, and
any and all ordinances or regulations relating to zoning by the County
of Palm Beach.
hereby respectfully request that said property, which is contiguous
to the territorial limits of the Village of Tequesta, Florida, be
annexed to and included within the territorial limits of the Village
o.f Tequesta, and that said property be zoned C-1 Retail __Comm~r_oiaLDistrict
zoning classification.
