HomeMy WebLinkAboutOrdinance_265_12/12/1978• • ORDINANCE NO. 265 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, REQUIRING THAT OFFAL OR EXCRETA OF ANY ANIMAL DEPOSITED ON PREMISES OTHER THAN THE PREMISES OF THE OWNER OF SUCH ANIP~iAL BE REMOVED IN A SANITARY MANNER; PROVIDING A PENALTY FOR A VIOLATION HEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR CODIFICATION. NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF TEQUESTA, FLORIDA: Section 1. Depositing of offal or excreta, allowing or abetting prohibited - removal required. (a) It shall be unlawful for any person to aid, abet, assist or allow any animal under their care, custody or control, or subject to their command, to deposit or place on any of the public or private sidewalks, parkways or walkways or parts of streets, or public parks or ways on the ocean front devoted to the use of the public, or upon premises owned by any person, firm or corporation other than the owner or custodian of such animal, any offal or excreta of such animal. (b) The owner or custodian of any animal is hereby required to remove and dispose of in a sanitary manner, the offal or ex- creta of any such animal deposited or placed in violation of this section. Removal of any such offal or excreta in a sealed container shall constitute prima facie compliance with this section. Section 2. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 3. Any person, firm or corporation found guilty of a violation of this ordinance shall be punished by a fine not to exceed $500.00 or 60 days in jail, or by both such fine and imprisonment in the discretion of the County Judge. Section 4. That this Ordinance shall take effect upon its approval and passage as provided by law. Section 5. This Ordinance upon approval shall be codi- fied into the Code of Ordinances for the Village of Tequesta. • • The foregoing Ordinance was offered by Councilmember James H. Ryan who moved its adoption. The motion was seconded by Councilmember Joseph D. Yoder , and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Howard F. Brown Leslie A. Cook W. Harvey Mapes, Jr. James H. Ryan Joseph D.
