HomeMy WebLinkAboutOrdinance_264_10/24/1978s ORDINANCE N0. ?_h4 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA ASSESSING AN ADDITIONAL ONE DOLLAR ($1.00) AGAINST PERSONS CONVICTED OF VIOLATIONS OF LAW FOR LAW ENFORCEMENT EDUCATION EXPENDITURES FOR TEOUESTA LAW ENFORCEMENT OFFICERS WHEREAS, The Village Council of the Village of Tequesta deems it necessary and advisable to levy an additional $1.00 as court costs to be assessed against law violators as permitted by Chapter 943.25 (5), Florida Statures, 1977; NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF TEQUESTA, FLORIDA: Section 1. That the Village of Tequesta hereby assesses an additional one dollar ($1.00) as court costs for law enforcement education expenditures for Tequesta law enforcement officers and support personnel against every person convicted for violation of a State penal or criminal statute or convicted for violation of a municipal or county ordinance committed within the Village limits of Tequesta. However, no such assessment shall be made against any person convicted for violation of any State Statute, Municipal Ordinance or County Ordinance relating to the parking of vehicles. Section 2. That the Village Clerk is hereby directed to send certified copies of this Ordinance to Administrator, Palm Beach County Courts and Clerk of the Circuit Court, Palm Beach County. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. If any section, subsection, sentence, clause or phrase of this Ordinance is held invalid by any court of competent jurisdiction, such section, subsection, sentence, clause or phrase shall be deemed severable from the remaining portions of this Ordinance and such remaining portions shall not be invalid or otherwise effected thereby. r • Section 5. This Ordinance shall upon adoption be codified and become a part of the Official Code of Ordinances of the Village of Tequesta. Section 6. This Ordinance shall. take effect upon its passage and approval as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember W. Harvey Mapes _, who moved its adoption. The Ordinance was seconded by Councilmember ! Joseph D. Yoder, Jr; and upon being put to a vote, the vote was as follows: FOR ADOPTION AGAINST ADOPTION Howard F. Brown Leslie A. Cook W.
