HomeMy WebLinkAboutOrdinance_248_02/22/1977• i ORDINANCE N0. 24$ AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING ORDINANCE N0. 211 THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE OF TEQUESTA, AS AMENDED, AT ARTICLE IV, DEFINITIONS, BY AMENDING THE DEFINITION OF LOT COVERAGE, AND BY ADDING TO SAID DEFINITIONS THE DEFINITION OF STRUCTURE, BY AMENDING THE DEFINITION OF SWIMMING POOL; AND AT ARTICLE XVI SECTION 16.2 (6) SO AS TO ELIMINATE THE REQUIREMENT THAT UNCOVERED SWIMMING POOLS OR PATIOS BE CONSIDERED IN COMPUTING THE LOT COVERAGE REQUIREMENTS OF THE ZONING ORDINANCE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA,AS FOLLOWS: Section 1. That Ordinance No. 211, the official zoning ordinance of the Village of Tequesta, Florida, be amended as follows: a) Article IV Definitions, lot coverage shall be amended so as to read as follows: "Lot coverage: That portion of a lot which when viewed directly from above, would be covered by a building or any part of a building exclusive of its eaves, and any portion of such building covered by a roof which qualified as open space, or any terrace, balcony, breezeway, or porch or portion thereof not included in the floor area of a building shall be included in lot coverage. For example, a lot containing ten thousand (.10,000) square feet has principal and accessory buildings planned or existing whose area is two thousand five hundred (2500) square feet; thus the lot coverage is twenty-five (25%) percent. Unscreened patios or swimming pools shall not be considered in computing lot coverage. Screened-in pools or patios shall be considered in computing lot coverage but shall be computed as only fifty (50%) percent of their actual coverage." b) Article IV, Definitions, is amended by adding the word structure and defining same as follows: "Structure: That which is built or constructed; an edifice or building cif any kind or any piece of work artificially bui'.~: up or composed of parts joined together in some definite manner. This includes, but is not limited to, platforms, radio • • towers, sheds, storage bin,, tents, and display signs. Fences and walls of less than three feet in height and walkways and other landscaping elements, such as birdbaths, fountains and like items of less than three feet in height; flagpoles, lamp posts basketball backboards; and mai~ boxes shall not be considered as structures." c) Article IV, Definitions, swimming pool, shall be II amended so as to read as follows: "Swimming pool:` Any structure designed for swimming, wading or other aquatic recreational purposes, capable of I containing a body of water eighteen inches (18") or more in depth and forty (40) square feet or more of water surface area." d) Article XVI, Section 16.2 (6) is eliminated from ~~ the Zoning Ordinance. Section 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. II Section 3. That this ordinance shall take effect upon its passage and approval as provided by law. II THE FOREGOING ORDINANCE was offered by Council Member I Peter Baron who moved its adoption. The Ordinance was seconded by Council Member Howard Brown and upon being put to a vote, the vote was as follows: FOR ADOPTION: AGAINST ADOPTION: Peter Baron Howard Brown Dorothy M. Campbell Stephen R. Huggins Joseph D. Yoder, Jr. The Mayor thereupon declared the Ordinance duly passed and adopted this 22 day of Februaix'V A.D., 1977.
