HomeMy WebLinkAboutOrdinance_247_02/08/1977 ORDINANCE NO . 21~ 7 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, PROPOSING TO AMEND THE OFFICIAL CHARTER OF THE VILLAGE OF TEQUESTA AT ARTICLE II SECTION 2.01 RELATING TO SELECTION, TERM AND COMPENSATION OF VILLAGE COUNCILMEMBERS, CHANGING THE ELECTION DATE FROM THE THIRD TUESDAY OF MARCH OF EACH YEAR TO THE SECOND TUESDAY OF MARCH OF EACH YEAR AND CHANGING THE TERM OF OFFICE OF EACH COUNCILMEMBER FROM THE FOURTH TUESDAY OF MARCH FOLLOWING HIS ELECTION TO THE NEXT COUNCIL MEETING SUBSEQUENT TO THE DATE OF SAID COUNCILMEMBER'S ELECTION; AND TO AMEND ALL PORTIONS OF THE CHARTER REQUIRED TO BE AMENDED TO CONFORM TO THE INTENT OF THIS ORDINANCE. WHEREAS, Section 166.021 of the Florida Statutes jrequires that any proposed charter change or amendment relating to the terms of elected officers and the manner of their election be approved by referendum of the electors as provided in Section 166.031 of the Florida Statutes, 1975, and WHEREAS, it is the desire of the Village Council of It he Village of Tequesta, Florida, to provide for a uniform election date within Palm Beach County, Florida; NOW THEREFORE BE IT ORDAINED BY THE VILLAGE COUNCIL ~F THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. The Village Council submits to the elector; of the Village of Tequesta at the next election within the Village this proposed amendment to its Charter. Section 2. Article II of the Village Charter relating to selection, term and compensation of councilmembers shall be amended to read as follows: "ARTICLE II The Village Council Section 2.01 Selection, Term and Compensation The Village Council of the Village of Tequesta JOFINSTON SASSER & RANDOLPH 310 O!(EECH06EE HD. V.~i_ST PALM BEACH. FLA. i 33402 ~ (shall consist of five members who shall be elected at large to Seats 1,2,3,4 and 5. The Councilmen in Seats 1,3 and 5 shall be elected in the even years, and the Councilmen in Seats 2 sand 4 shall be elected in the odd years. The election shall be held on the second Tuesday in March of each year. Only qualified electors, as prescribed herein, shall be entitled to vote at such elections. • • The term of office of each Councilman shall commence the next council meeting subsequent to the date of his election nd shall continue for two years thereafter and until his successor is elected and qualified." Section 3. Any provision of the Charter of the illage of Tequesta in conflict herewith is hereby repealed and ded to conform to the intent of this Ordinance. Section 4. This Ordinance shall take effect immediately upon its passage and approval as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember Howard F. Brown who moved its adoption. The motion was seconded by Councilmember Stephen R. Huggins , and upon being put to a vote, ~e vote was as follows: ADOPTION AGAINST ADOPTION Peter Baron Howard F. Brown Dorothy M.
