r-~ ~ ~ ', ORDINANCE N0. 21a.6 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, PROHIBITING CERTAIN TRUCK TRAFFIC FROM TRAVELING ON TEQUESTA DRIVE AND COUNTRY CLUB DRIVE WITHIN THE VILLAGE OF TEQUESTA; PROVIDING FOR ENFORCE112ENTS; AND PRESCRIBINB PENALTIES FOR THE VIOLATION OF ITS PROVISIONS. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. That from and after the effective date of thi: Ordinance it shall be unlawful for any through traffic trucks to travel over Tequesta Drive or Country Club Drive within .the Village of Tequesta. Section 2, Through traffic trucks are defined as trucks originating from a point other than from properties abutting or adjacent to Tequesta Drive or Country Club Drive within the Village of Tequesta which have a destination point other than to properties adjacent to or abutting Tequesta Drive or .Country Club Drive within the Village of Tequesta. Trucks as regulated by this Ordinance are every motor vehicle designed, used or maintained primarily for the transportation of property, including trailers and truck tractors but not including pick-up trucks, sedan panel trucks, station wagons or similar light vehicles designed for carrying small loads of property or small loads of property and passengers interchangeably. Such light vehicles shall not be subject to the regulations of this Ordinance unless they have been so altered or modified as to materially :increase their cargo capacity, in which case such vehicle: shall be classified as trucks for the p~zrposes of this Ordinance. Section 3, This Ordinance shall not prohibit: a) The operation of trucks upon Tequesta Drive or Country Club Drive where necessary to the conduct of business at a destination point, provided streets upon which such traffic is permitted are used until reaching the intersection nearest the destination .point. b) The operation of emergency vehicles upon said streets. c) The operation of trucks owned or operated by the Village, public utilities, any contractor or materia.-i.- JOHN570N SASSER & RANDOLPH 910 OKEECHOBEE RD. The Chief of Police is hereby directed to post signs at the intersection of Tequesta Drive and U.S. 1, Tequesta Drive and Old Dixie Highway, and Country Club Drive and the Palm- Beach-Martin County line or other intersections deemed necessary to effect the terms of this ordinance which shall read: "NO THROUGH TRUCKS". Section 5. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. Section 6. That any person, firm or corporation violating any of the provisions hereof shall, upon conviction thereof, be punished by a fine of not exceeding Five Hundred Dollars ($500.00) or by imprisonment in the County Jail for not to exceed six (6) months, or by both such fine and imprisonment in the discretion of the Judge of the Circuit Court of Palm Beach County, Florida. Section ?. This Ordinance shall take effect upon its passage and approval as provided by law. THE FOREGOING ORDINANCE was offered by Council Member Howard F. Brown who moved its adoption. The Ordinance was seconded by Council Member Peter Baron and upon being put to a vote, the vote was as follows: FOR ADOPTION: Peter Baron Howard F. Brown Dorothy N1. Campbell Stephen R.
