HomeMy WebLinkAboutOrdinance_244_11/23/1976,. .- ORDINANCE NO . 241, AN ORDINANCE OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, CREATING A UNIFORM MAXIMUM PENALTY WHICH MAY BE IMPOSED FOR ANY MISDEMEANOR VIOLATION OF ALL ORDINANCES OF THE VILLAGE OF TEQUESTA, FLORIDA, EXCEPT WHERE EXPRESSLY PROHIBITED BY STATE LAW WHEREAS, the Constitution of the State of Florida abolished the Florida Municipal Courts effective January 3, 19??, and WHEREAS, the County Court of Palm Beach County, shall assume the jurisdiction previously reposed by said municipal courts and WHEREAS, it is necessary in preparation for and in conjunction with the abolishment of the Florida Municipal Courts to make certain amendments to existing ordinances of the Village of Tequesta to provide for the uniformity required by the County Court of Palm Beach County. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section _l. A fine of not more than Five Hundred Dollars ($500.00) or term of imprisonment not in excess of six (6) months or both such fine and imprisonment shall constitute the maximum penalty which may be imposed upon any person who shall be adjudged to have violated any ordinance of the Village of Tequesta, Florida, provided however that this ordinance shall not conflict with any provision for penalties imposed for any offense under the laws of the State of Florida. Section 2. This Ordinance shall supersede any other penalty provision contained in the Charter and ordinances of the Village of Tequesta, Florida. Section 3. Severability In the event that any section, subsection, clause, sentence or provision is held invalid, the remainder of this ordinance shall not be affected by such invalidity. .. ;~ • • Section 4. Repeal of Conflicting Ordinances and Resolutions. All ordinances and resolutions of the Village of Tequesta in conflict herewith are hereby repealed. Section 5. Effective Date. This Ordinance shall take effect on January 3, 1977. THE FOREGOING ORDINANCE was offered by Councilmember Howard F. Brown who moved its adoption. The Ordinance was seconded by Councilmember Joseph D. Yoder, Jr, and upon being put to a vote, the vote was as follows: FOR ADOPTION: Howard F. Brown Dorothy M. Campbell Stephen R. Huggins AGAINST ADOPTION: Peter Baron Joseph D.
