Mr. Thomas J. Paterno, 327 River Drive, has indicated to the Department of Community
Develapment that he would like to serve on the Board of Adjustment as Alternate (see attached
application). The current membership of the Board of Adjustment is as follows:

In accordance with Florida Statutes Section 761.80, the requested membership of Thomas Paterno on
the Board of Adjustment keeps its membership representative of the Village of Tequesta's overall
population as described in the 2000 Census.
It is recommended that the Village Council wnsider the appointment of Thomas Patemo to the Board
of Adjustment effective April 9, 2004, with said three year term expiring Apri19, 2007. Presenfly,
there are no other applications pending for the Board of Adjustment.

APPLICATION FOR VILLAGE OF TEQUESTA BOARD OF ADJUSTMENT
The BOA reviews applications for a variance to the Tequesta. Zoning Cade for a11 residential properties. The BOA shall consist of five
regular members appointed by the Village Council who shall serve without compensation and for a term of three years. In addition to
the regular BOA members, two additional members, to be designated as Alternate No. 1 and Alternate No. 2, shall be appainted to serve
in that order at meetings of the BOA when necessary for any reason and to have at all times tl�ree voting members on said BOA as a
quorum. Alternate members shall be appointed far two-year terms. Members of the BOA may be removed from office by the Village
Council upon written charges and after public hearing.

Re-Zoning Subsequent to Annexation
Turtle Beach Construction
?urtle Beach Construction Inc., owner of the subject property, is requesting
a"Commercial" land use designation for a site located on the east side of
U.S. Highway One between Palm Court and Harbor Road South, Jupiter
Heights Subdivision, Palm Beach County. The property is voluntarily being
annexed into the Village. The site contains several lots that are to be
developed as one overall site. The site is proposed to be developed with a
two-story office building. The subject parcel consists of Lots I-9 of Jupiter
Heights, having a current County land use designation of Commercial High
(C/5) and a County zoning of Commercial General (CG). The proposed
zoning for the property after annexation is Community Commercial, C-2.
The "Commercial" land use being requested pursuant to the Future Land
Use element of the Village of Tequesta Comprehensive Plan is consistent
with the current use of the surrounding properties that front on U.S.
Highway One. The future land use request will reauire a change to the
Future Land Use Map. Because this property is being annexed into the
Village, the FLU Map will have to be amended to reflect the new
"Commercial" designation.

?he proposed Future Land Use amendment request is consistent with the
Goals, �bjectives and Policies of the Village of ?equesta Comprehensive
Plan. The FLU/Comprehensive Plan amendment is a"small-scale"
amendment. It will be submitted to the State Department of Community
Affairs (DCA) and other appropriate agencies for informational purposes, if
approved.
The newly appointed Planning and Zoning Board, sitting as the Local
Planning Agency (LPA), will hold a duly advertised public hearing regarding
this proposed Future Land Use/Comprehensive Plan amendment on April
21, 2004.

AN ORDINANCE OF THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH
COUNTY, FLORIDA, AMENDING THE ADOPTED
VILLAGE COMPREHENSIVE PLAN, PURSUANT TO
CHAPTER 163, FLORIDA STATUTES, AND
CHAPTERS 9J-5 AND 9J-11, FLORIDA
ADMINISTRATIVE CODE, APPLYING A
COMMERCIAL LAND USE CLASSIFICATION TO A
PORTION OF REAL PROPERTY LOCATED ON THE
EAST SIDE OF U.S. HIGHWAY ONE BETWEEN
PALM COURT AND HARBOR ROAD SOUTH,
CONTAINING APPROXIMATELY 0.495 ACRES,
PROVIDING FOR A REVISION TO THE VILLAGE'S
FUTURE LAND USE MAP; PROVIDING FOR
CODIFICATION, SEVERABILITY, AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the Village Council of the Village of Tequesta has received an application
for an amendment to the Future Land Use Element/Map of the Village Comprehensive
Plan from the owner of real property more particularly described in Exhibit "A" attached;
and
WHEREAS, the Local Planning Agency has reviewed the proposed amendment to the
Comprehensive Plan, applying a future land use classification of "Commercial" to the
subject property, has held a properly noticed public hearing, and has recommended
adoption; and
WHEREAS, the Village Council, pursuant to Chapter 163, Florida Statutes, has
reviewed the proposed amendment, has held two properly noticed public hearings, and
has found that the amendment furthers the public health, safety and welfare; is consistent
with the requirements of Chapter 163, Florida Statutes, and Rules 9J-5 and 9J-11, Florida
Administrative Code; and are consistent with other elements of the Village
Comprehensive Plan, the Strategic Regional Policy Plan, and the State Comprehensive
Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, FLORIDA AS FOLLOWS:
SECTION 1.: INCORPORATION OF RECITALS
The above recitals are incorporated as though fully set forth herein.
SECTION 2.: FINDINGS
The proposed Comprehensive Plan Amendments as more particularly described in
Exhibit "A" is determined by the Village Council to be consistent with the public health,
safety, and welfare, consistent with the requirements of Chapter 163, Florida Statutes,
consistent with the requirements of Rules 9J-5 and 9J-11, Florida Administrative Code,
and consistent with all the elements of the adopted Village Comprehensive Plan,
Strategic Regional Policy Plan, and the State Comprehensive Plan.
SECTION 3.: REPEAL OF INCONSISSTENT ORDINANCE PROVISIONS
All Ordinances or provisions thereof in conflict herewith are hereby repealed.
SECTION 4.: SEVERABILITY
If any section, subsection, sentence, clause, or phrase of this Ordinance, for any
reason, is held to be unconstitutional, void or otherwise invalid, the validity of the
remaining portions of this Ordinance shall not be affected thereby.
SECTION 5.: EFFECTIVE DATE
This Ordinance shall become effective when the Florida Department of
Community affairs issues a final order determining this Comprehensive Plan Amendment
to be in compliance with the State Comprehensive Plan, Florida Statute Chapter 163 and
Rules 9J-5/9J-11, Florida Administrative Code.
READ AND APPROVED on First Reading by the Village Council on the 8` day
of August, 2004.
