HomeMy WebLinkAboutOrdinance_240_10/29/1976~ ~ Wl~ ORDINANCE N0. 210 AN ORDINANCE OF THE VILLAGE OF TEQUESTA AMENDING SECTION 2, ORDINANCE N0. 134, AS Ab~NDED, AMENDING SECTION 4, ORDINANCE N0. 134, AS AMENDED, WHICH ESTABLISHED A SCHEDULE OF WATER RATES FOR THE OPERATION OF THE WATER DISTRIBUTION SYSTEM OF THE VILLAGE; AND PROVIDING FOR AND ESTABLISHING CHARGES FOR FIRE PROTECTION, METER INSTALLATION, CONNECTION CHARGES, RECONNECTION. tiVf-IEREAS, the Village of Tequesta now owns, operates, and maintains a water system and has operated said system since March 1, 1968, and it is now necessary to finance improvements to said water distribution system and pro- vide an interconnection with Tri-Southern Utilities, Inc. as a source of a potable water supply, and WHEREAS, it is necessary to revise the rates, charges and fees for the services of the water system in accordance with the requirements of Ordinance No. 138, and Ordinance No . 237. Now, therefore, be it ordained by the Village Council of the Vil- lage of Tequesta, Florida: Section 1. Section 2, Ordinance No. 134, as amended, be amended to read as follows: "Section 2. The schedule of rates and charges be, and the same are hereby determined as fol- lows: A. Minimum Monthly Service Charge: Minimum Service Charge Meter Size Per Month 5/8" x 3/4" 8.30 1" 20.75 1 1/2" 41.50 2" 66.40 3" 124.50 4" 207.50 6" 415.00 Where a single meter is installed in a water connection to a building having two or more units, the minimum monthly service charge shall be not less than an amount equal to the number of units multiplied by the minimum charge for a 5/8" x 3/4" meter. A meter shall be installed in each water connection whether public or private, except for private fire connections. B. Quantity Rate: Applicable to all quantities of water shown by meter readings to have been delivered: $0.80 for each 1,000 gallons or fraction thereof. • • C. Fire Protection Charge: Village of Tequesta $100.00 per hydrant per year Other Areas $ 0.50 per meter per month, except for services used solely for irrigation purposes Private Fire Connections: The following monthly service charges shall apply to private fire lines for sprinkling systems or other fire protection systems: RTPtPr Sipe Amount 2 inches $ 6.00 3 inches 14.00 4 inches 25.00 6 inches 60.00 8 inches 100.00 The expense of all connections to the water mains shall be borne by the user. No taps will be al- lowed which may be used for other than fire pro- tection purposes, and there shall be no connection with any other source of water. D. Meter Installation Charge: All water meters shall be installed by the Village of Tequesta and the charge for making such meter installations or a replacement of a meter of a different size upon request of the customer, shall be as follows: Meter Size Amount 5/8" x 3/4" $125,00 1" 180.00 1 1/2" 325.00 2" 550,00 The charge for water meter installations of sizes larger than 2" shall be not less than the actual cost, including material, labor, equipment, in- spection and overhead. All meters installed re- main the property of the water system. E. Interrupted Service 1. Reconnection Charges: There shall be a reconnection charge in the amount of four times the minimum monthly service charge for the resetting of any meter which shall have been removed from service if resetting is done during regular working hours. 2. Transfer of Service (not including meter re- placement There shall be a charge of $10.00 during regular working hours. 3. If the customer requests that the work in items 1 or 2 abcve~: be done outside regular working hours, the charge shall be twice the stated amount. r ~ F. Capital Improvement Charge: Each new connection t o the water system, after the effective date of this Ordinance, shall pay a capital improvement charge of $400 for each 5/8" x 3/4" meter, or equivalent thereof, at ''; the time of the application for a new connection. Such payments shall go into a capital improvement fund, which shall be a separate fund to be used for capital improvements to the water system or for payment of debt service on the Water Revenue Certificates, Series 1976, or subsequent issues. Applicants which have applied for new service connections pursuant to Ordinance No. 219, shall be required to make a new application within ninety (90) days after the effective date of this Ordinance, for which the capital improvement charge shall be $200 for each 5/8" x 3/4" meter, or the equivalent thereof, which shall be non- transferable and non-refundable. In the event that the applicant fails to apply for water meter installations of an equivalent number of meters within 365 days from the date of application, and pay the meter installation charges therefor, the application for new service connections shall be voided without refund. G. Non-Payment of Service Charges: If any bill for water service has not been paid within thirty (30) days from the date of billing, service shall be disconnected after due notice thereof. H. Security Deposits: There shall be a security deposit equivalent to three times the minimum monthly service charge for each account established after the effective date of this Ordinance, to be paid at the time of ap- plication for service. The security deposit is intended as security for .payment of any final bill prior to disconnection. In computing the final bill for an account, the meter deposit shall be credited to that account. The deposit will not bear interest. I. Relocation of Meters, Fire Hydrants, or Other Customer Facilities: If a customer requests that a meter, fire hydrant or other facility be relocated for his convenience, the customer shall pay the actual cost of such re- location including material, labor, equipment, in- spection and overhead." Section 2. Section 4 of Ordinance No. 134, as amended, be and the same is hereby deleted in its entirety. Section 3. The remaining provisions of said Ordinance No. 134, as amended, shall remain in full force and effect and are hereby ratified and confirmed. • • Section 4. All Ordinances and Sections thereof in conflict here- with, are hereby repealed. Section 5. This Ordinance shall take effect on the first day of the first month that is more than ten (10) days after passage of this Ordinance. The foregoing Ordinance was offered by Council member Howard F. Brown who moved its adoption. The motion was seconded by Council member Joseph D. Yoder, Jr. and upon being put to a vote, the vote was as follows: FOR ADOPTION Howard F.
