Ree Zoning-in-Progress/Adult Video Arcades
Pursuant to Mr. Randolph's letter of February 27, 2004 and discussion with Community Development, I
am requesting a Zoning-in-Progress be declared for Adult Vdeo Arcades (Adult Arcade Amusement
Center, or other similar entertainment enterprise or business at which electronic, mechanical, coin-
operated, computer, video, or other similar games of amusement, chance or skill are played}. At
present, no occupational licenses are being issued as this subjed is under study.
Mr. Randolph is presently drafting an ordinance to regulate these types of arcades, but until passage, a
Zoning-in-Progress would preclude the opening of Adult �deo Arcades within the Vllage. Community
Development has had numerous in-office inquiries into opening these Arcades.
Attached are several recent artiGes of iMerest regarding Adult Vdeo Arcades. Please feel free to
corrtact me if I can be of further assistance.

Dear Jeff:
This is a follow up to my conversation yesterday in which I suggested that the Village
Council give consideration to declaring zoning in progress in regard to the matter of
adult arcades. This is an issue of some concern throughout the state, as evidenced by
the articles I enclose for your information.
The purpose of declaring zoning in progress will be to allow time for the Village to give
consideration to language to be incorporated within the Village zoning code which will
allow for the regulation of these types of arcades.
I will begin drafting an ordinance so it can be made available to the Council for its
consideration at its earliest convenience.

gambling laws in the late 1990s, mini-casinos have been popping up from South Daytona to Port Charlotte. .

entering 577 Deitona Blvd. Piush carpeting, flashing video screens, belis, beeps and free food and drink are part
of the atmosphere at Gold Dust Casino. �

"Yes, this is Florida, and these are slot machines. And they're apparently pertectly legal. 5ince the state rewrote

"The sudden proliferation of these 'adult arcades' has caught most cities by surprise. The stores aren't filled with
video games and kids. They look more like a Bally's o� Harrah's. And the idea of having a little of the Las Vegas
strip in a strip mall has not gone ovet well.

legitimate businesses.

The aiy of Casselberry approved an emergency ordnance Monday night that places a 90-day
moratorium on casino-like establishments.
"We kind of followed their (Sartford) lead in trying to establish parameters," said Frank Ciifton, ,
Casselberry city manager.
Aithough no applications have been received by the ciiy for an adult arcade, offiaals' interest
in the matter peaked when neighboring Longwood got a request for an adult arcade.
"Our response basically was to put a moratorium on that type of activities until we can develop
some guidetines," Clifton said.

investigating the matter and initially perceives the adult arcades would be covered under the
1996 charter amendment that ou�aws gaming in the county without a voter referendum.
Operatocs of the casino-tike estabiishments contend that their busines,ses are legal for two
reasons: first, the gaming machines, whiefi reserr�t+le sfat machines, require sidil, not ch2�ce, � .
because a player must push a button to stop each spinning wheel; and second, the machines .
pay off not in cash but in 6ckets worth up to 75 cents that pn be redeemed for g'rft cards, trips
or other prizes. • ,
Muniapal offiaals disagree with the operators' arguments. First, they say the games are. too
sophisticated to rely on skill. With more than 30 images per second flashing on the video
screens, the machines �equire more luck than skill, opponents say. They also point out that
the state statute allowing ticket redemption, also known as the "Chuck E. Cheese" euemption,
was aimed at child-oriented arcades with cheap toys and stuff animals given away as prizes.
' It is estimated that about 30 "adult arcades" are operating throughout the state. Local
municipalities began taking notice ofthe businesses when Sanford approved a 90-day
morato�um for all amusement-rHated business licenses. A group off business people, led by .-
Rosemarie Hall, planned to open Joker's Palace at 207 Magnolia Avenue, next to the Helen
� Stairs Theatre. Hall said in addition to operating the gaming business, she planned ta otfer
ftee food and drinks to patrons.

RE: ADULT ARCADE OCCUPATIONAL LICENSURE
At the advice of our Attomey, I am directing you not to accept applications
for adult video arcade occupational licenses. The matter is currendy under
study by our legal counsel and the Village Council for the purpose of amending
our zoning ordinance to regulate such businesses.
