The A.N.T. Program uses all natural products on the interior of the home. YOUR COOPERAT Your cooperation is important to ensure the most effective results from Nozzle Nolen, Inc. In the event you have to reschedule the service, please notify Nozzle Nolen, Inc. within 24 hours in advance. AC CESSIBILITY : Please make sure pets /animals are secured and accesses to the property /gates are unlocked for service. If for any reason the pets are not secured and /or the gates are locked, prohibiting access and preventing service from being performed, the service amount will be due frorn the customer. We will not be obligated to make up or add an additional service at the property. DA MAGES : This agreement does not guarantee against, and Nozzle Nolen, Inc. shall not be liable for, any consequential damages of whatever nature, including damages to persons, animals, or property resulting from fire ants, pharaoh ants. carpenter ants, rodents, spiders, or any other pests and /or chemical applied to control that pest. REMEDIAL MEASURES: Circumstances may warrant additional work to install and initialize the VIP Platinum Plan. Proximity to existing Rodent Harborages and /or existing infestations may require remedial measures to be performed at the beginning of this agreement. Such conditions shall be described by the Nozzle Nolen representative and approved by the customer. If the customer does not want some /all of these measures dealt with, Nozzle Nolen will not guarantee those pests for more than 30 days after initiation of the contract. These additional services will be a separate charge and written on a separate agreement, and must be approved by the customer before the services are performed. TERM OF SALE: In consideration of the above service packages, the undersigned agrees to pay in a timely manner. The initial /first payment is due at signing of the agreement. Service may have tax included, depending on local, state law. Terms of sale are net at the time of service. A 1.5% per month, (18.00% annual) service charge will be imposed for delinquent accounts. Buyer may cancel this transaction (in writing) at any time prior to midnight the third business day after the date of this transaction. The buyer acknowledges that he /she has read and understood this agreement and will abide by its terms. The "Auto Debit" payment plan authorizes Nozzle Nolen, Inc. to automatically withdraw the monies due after each service is rendered. Checks returned for any reason will be charged a $25 reprocessing fee. Necessary price adjustments may be negotiated anytime after the first year. NOZZLE NOLEN, INC. OW OF .EQUIPMENT The Customer understands that all components used for the elimination and /or prevention of the covered pests will remain the property of Nozzle Nolen, Inc., unless otherwise purchased separately by the Customer. The Customer has no rights to any of the components. other than the right to their use as installed by Nozzle Nolen, Inc., on the Customer's premises under this agreement On expiration or termination of this agreement, Nozzle Nolen, Inc. is authorized by the Customer to retrieve the components from the Customer's premises. This service and its components are fully transferable to the new owner should a sale of the premises necessitate ADDITI ALTERATIONS AND OTHER_ CHANGES: This Agreement covers the Structure(s) identified on the service agreement as of the date of the initial service. The customer will immediately notify Nozzle Nolen, Inc. in writing of any changes to the square footage of the Structure. Failure to notify Nozzle Nolen, Inc. in writing may void this agreement. Any changes to the square footage of the Structure may warrant an adjustment in the annual fee to guarantee a pest -free environment. HOLIDAYS; If your service date falls on a holiday in most cases, your service will be done the business day prior or after the holiday. RENEWAL OF AGREEMENT- This agreement will automatically renew each year (subject to price increase) unless cancelled in writing by either party on thirty (30) days notice. CANCELLATION OF THE AGREEMENT: It is understood that should this agreement be cancelled, for any reason, before the first year of service is completed, above account will pay a cancellation fee at the charge of one regular service visit. Nozzle Nolen, Inc. and Owner agree that as to any civil action or legal proceedings arising out of or relating to this Agreement, the laws of the State of Florida apply and venue shall be in Palm Beach County. Nozzle Nolen, Inc. October 1, 2013 Annual Pest Solutions Agreement ADDENDUM Public Records: In accordance with Sec. 119.0701, Florida Statutes, the Contractor must keep and maintain this Agreement and any other records associated therewith and that are associated with the performance of the work described in the Scope of Services. Upon request, the Contractor must provide the public with access to such records in accordance with access and cost requirements of Chapter 119, Florida Statutes. Further, the Contractor shall ensure that any exempt or conf'idential records associated with this Agreement or associated with the performance of the work described in the Scope of Services are not disclosed except as authorized by law. Finally, the Contractor shall retain the records described in this paragraph throughout the performance of the work described in the Scope of Services, and at the conclusion of said work, transfer to the Village, at no cost to the Village, all such records in the possession of the Contractor and destroy any duplicates thereo£ Records that are stored electronically must be transferred to the Village in a format that is compatible with the Village's information technology systems.
