HomeMy WebLinkAboutOrdinance_134_09/29/1967ti ORDINANCE NO. 134 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR AND ESTABLISHING SCHEDULE OF WATER RATES FOR PROPOSED OPERATION OF WATER DISTRIBUTION SYSTEM TO BE PURCHASED BY VILLAGE; AND PROVIDING FOR AND ESTABLISHING CHARGES FOR FIRE PROTECTION, CONNECTION, RECONNECTION; AND PROVIDING FOR NO FREE WATER SERVICE. WHEREAS, the Village of Tequesta on August 14, 1967, did make and enter into a certain purchase and sale agreement with Tequesta Water Company, Inc., in and by which the Village did agree to purchase all of the assets of said Tequesta Water Company, Inc. involved in and related to the distribution of potable water in the Village of Tequesta, and other incorporated and unincorporated areas in the Counties of Palm Beach and Martin, Florida; and WHEREAS, as a pre-requisite to the validation of the Water Revenue Certificates to be used in the consummation of said purchase and the payment of the purchase price, it is necessary that an appropriate schedule of water rates be adopted by the Village Council; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: Section 1. That, if, as and when, the Village shall have completed the purchase of the water distribution system of Tequesta Water Company, Inc., the following schedule of rates for water furnished by the waterworks system, including monthly service charge, monthly meter rate, fire protection charge, connection charge, and re-connection charge, is hereby adopted and established, and the Village covenants that the amounts in such schedule will not be reduced, except as hereinafter provided in this Ordinance. Each monthly bill shall be rendered for the amount of monthly service charge set forth plus the monthly charge for metered water. • • In addition, where private fire lines are provided, the following monthly service charge for fire protection shall be included. Section 2. The schedule of rates and charges be, and the same are hereby, determined as follows: A. Monthly Service Charge: Size of Meter 5/8 in. x 3/4 in. 3/4 in . 1 in . 1 z in . 2 in . 3 in . 4 in . 6 in . Service Charge Per Month $ 2.50 3.62 6.40 14.40 25.60 57.70 103.00 231.00 A meter shall be installed in each water connection to each parcel of property, whether public or private, except private connections. B. Monthly Meter Rate: Applicable to all retail quantities of water shown by monthly meter readings to have been delivered: 35 cents for each 1000 gallons or fraction thereof. C. Fire Protection Charge: The following monthly service charge shall apply to private fire lines for sprinkling systems or other fire protection systems: SIZE CHARGE 2" $ 2.56 3" 5.77 4" 10.30 6" 23.10 8" 41.10 The expense of all connections to the water mains shall be borne by the user. No taps will be allowed which may be used for other than fire protection purposes, and there shall be no connection with any other source of water. D. Connection Charge: All water service connections shall be made in accordance with rules and regulations which shall be adopted from time to time by the Village Council, which rules and regulations shall provide for a - 2 - • • charge for making any such new connection in such reasonable amount, not less than the following schedule: 5/8" or 3/4" Connection - $115 1" Connection - 165 1~" Connection - 295 2" Connection - 510 Water service connections made in sizes larger than 2" shall be made at costs not less than the actual cost to the Village including material, labor, equip- ment, inspection and overhead. E. Reconnection Charge: If any bill shall not be paid within thirty (30) days from the original date of billing, service shall be disconnected. In the event that service is discontinued for nonpayment of bills, the premises shall be disconnected from the waterworks system. There shall be a charge of $10.00 for resetting any meter up to and including 1" size meters which shall have been removed from service. A resetting charge equal to a one month service charge shall be charged for 12" size and larger meters. Section 3. There shall be no free services rendered by the waterworks system and, except as otherwise provided in this Ordinance, all users receiving service from the waterworks system shall pay therefor at the established rate charge. Section 4. The Village covenants that the monthly meter rate and monthly service charge for water furnished by the water- works system outside the corporate limits of the Village will at all times be not less than 125% of the rate and charge for water furnished by the waterworks system within such corporate limits. Section 5. In the case of any building having separate units which are used for the housing of two or more families or for commercial purposes, or for both such purposes, each such unit shall be metered individually or as one unit. Where a single meter is installed in the water connection to any single unit, each monthly bill for water furnished to such unit shall be based on the established monthly service charge and monthly meter rate. - 3 - • s Where a single meter is installed in the water connection to serve two or more such units, each monthly bill for water furnished to such units shall be rendered for an amount not less than $2.50 per equivalent single family dwelling unit plus the monthly meter rate for water used. Fire protection charges for private fire lines shall be separately included. Section 6. The Village shall pay for the privilege of taking water from the waterworks system through its fire hydrants for the prevention and extinguishment of fires a fire hydrant charge at a rate not less than One Hundred Dollars ($100.00) per hydrant per annum. All water used by the Village itself for municipal purposes (other than for the prevention and extinguishment of fires, water reasonably necessary for testing fire hydrants, and water reasonably necessary for practice of firemen) and all water used by any other political subdivision or public agency shall be paid for at the established monthly rate and charge. Revenues received for water furnished to the Village and all hydrant charges payable by the Village shall be deemed to be revenues derived from the operation of the waterworks system and shall be applied and accounted for in the same manner as other revenues derived from the operation of said system; provided, however, that nothing herein contained shall be construed as requiring the Village to avail itself of the facilities or services afforded by said system. Section 7. The Village shall fix, establish, maintain and collect rates, charges, fees, and rentals for the service and facilities of the waterworks system, and to revise the same from time to time whenever necessary, as will always provide revenues in each year sufficient to pay all cost of operation and maintenance - 4 - • ~ of said waterworks systems in such year, together with One Hundred Twenty-Five Per Centum of the maximum debt service requirements of said waterworks system, and that such rates, charges, fees and rentals shall not be reduced so as to be insufficient to provide adequate revenues for such purposes as certified by the Consulting Engineers of the waterworks system. Section 8. All ordinances and sections thereof in conflict herewith are hereby repealed. Section 9. This Ordinance shall take effect immediately upon its passage and approval as provided by law. BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: Section 1. Ordinance No. 134 of the Village of Tequesta is hereby amended at. Section 2 to read as follows: "Section 2. The schedule of rates and charges be, and the same are hereby, determined as follows: "A.
