HomeMy WebLinkAboutResolution_33-13_10/10/2013 RESOLUTION NO. 33-13 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, APPROVING A ONE TIME PERFORMANCE BASED RECOGNTTITION COMPENSATION AMOUNT FOR THE VILLAGE MANAGER FOR FISCAL YEAR 12/13 IN ACCORDANCE WITH SECTION 4. OF THE SECOND EMPLOYMENT AGREEMENT BETWEEN THE VILLAGE MANAGER AND THE VILLAGE OF TEQUESTA DATED AUGUST 5, 2010; PROVIDING AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the Village of Tequesta has entered into a Second Employment Agreement with its Village Manager, Michael IL Couzzo, Jr. dated August 5, 2012 (the "Agreement" ); and WHEREAS, said Agreement provides for additional compensation for the Village Manager based on the past year's performance and is known as "Performance Recognition Compensation" C'PRC') according to Section 4 of the Agreement; and , the PRC is solely at the option of the Village Council to be based on performance; and WHEREAS, the Village Council of the Village of Tequesta has carefully reviewed the Village Manager's performance for the past year and hereby finis the PRC is in order due to the negotiation of a new fire/rescue agreement with the Town of Jupiter Inlet Colony, as well the compilation of a fiscally conservative budget; and WHEREAS, the Village Council of the Village of Tequesta believes that the above - stated accomplishments along with a myriad of other examples of resourceful cost saving measures warrant the award of the PRC and that such an award is in the best interests of the citizens of the Village of Tequesta in order to maintain quality management and ensure stability in the Village. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1 The PRC as provided for Section 4 of the Village Manager's contract is hereby authorized in the gross amount of Three Thousand Dollars ($3,000.0). Section 2 This Resolution shall become effective immediately upon passage. 1 The foregoing Resolution was offered by Vice Mayor Arena who moved its adoption. MAYOR OF TEQUESTA Abigail re rinan ATTEST: — 15 • Lori McWilliams, MMC ; Village Clerk 1.4�t� alz c� 'rr= �''�- ••• �ld� 'gip: -' 2 MEMORANDUM OF UNDERSTANDING THIS MEMORANDUM OF UNDERSTANDING is made this '✓ �day of October, 2013 between the Village of Tequesta, a municipal corporation with offices located at 345 Tequesta Drive, Tequesta, Florida 33469, herein referred to as the VILLAGE; and Michael R. Couzzo, Jr., an individual, herein referred to as COUZZO; hereinafter collectively referred to as the PARTIES. Whereas, the PARTIES have previously entered into a "Second Employment Agreement" which provides for, among other things, an annual 4% salary increase for COUZZO; and Whereas, COUZZO has advised the VILLAGE of his desire to forego the annual 4% salary increase for the 2013 -2014 contract year; and Whereas, the VILLAGE does not object to COUZZO's request to forego the annual 4% salary increase for the 2013 -2014 contract year and desires to effectuate same. Now Therefore, in consideration of the mutual covenants contained herein, the receipt and sufficiency of which are hereby acknowledged, the VILLAGE and COUZZO agree as follows: 1. For the 2013 -2014 contract year, COUZZO will forego the annual 4% salary increase as provided for in the Second Employment Agreement between the PARTIES. 2. In all other respects, the Second Employment Agreement shall continue uninterrupted as previously agreed and executed by the PARTIES. This MOU is not intended, and in fact does not serve to re- negotiate any terms of the Second Employment Agreement. 3. This Memorandum of Understanding shall have no force or effect on any term or condition contained in the Second Employment Agreement in any subsequent contract year, and the Second Employment Agreement shall continue uninterrupted in full force and effect as originally negotiated and agreed to by the PARTIES in all subsequent contract years.
