Tom, the Community Apgearance Board reviewed the abave referenced
project on March 30, 1994
The following concerns were expressed by the Board regarding this
proposed project:
1. that the project needed taller galms on the south side to
buffer the buildinq;
2. that a landscape �erm should be installed along the front
property line at the road right-of-way and on both sidQs
of the entrance drive;
3. that the piqeon glum should be chanqed out to Ligustrum

4. that an additional Ligustrum tree should be planted in the
parking island under the Sabal palms; .

Buildinq Official Comments: This praposed project is Phase I of a
two phase project. Only Phase I is being rPViewsd for approval at
this time. Phase II, the proposed five unit townhome phase is being
c�r:+_es±ed by certain individua.ls and associations on Beach Road and
is �urrPnt ly in 1 it igat ian. Phase I, the e ight story. T7 �anit mult i-
family residential building can be built as a stand alone pr�ject,
with vz without Fhase II, the townhomes. Fver being con�tructed.
Staff recommends approval of Phase I only at this time.

An eiqht story multi-family residential building.
This letter is to conf irm the act ion of the Vil lage of Teqvesta
Community Appearance Board at the 'March 30. 1994 meeting approving
your application for the above ref erenced pro]ect as submitted and
subject to the followinq changes to the landscape plans:
o with sabal or coconut palms along the south propert� line;
o adding a landscape berm along the street tight-of-way on both
sides of the entrance drive;
o changing the pigeon plum to ligustrum trees; and
o addinq one ligustrum in the parking island underneath the
sabal palms.
As yau are aware, this proposed project must be reviewed by the
Village Council at Site Plan Review. Upon receipt of f ifteen sets of
the revised landscape plans, by noon on Tuesday, April 5, 1994, the
above refe=enced , pro3ect can, be placed on the ,a�enda, .of �;t
meeting schedvled for Thursday, April ' 14, 1994, beginninq at 7:00 P.M.
in the Villaqe Hall. 357 Tequesta,Drive, Tequesta. Yov and/or your
representative must be in attendance at this meeting to present your
application and answe= any questions the Council map,have. If a

I. CALL TO ORDER AND ROLL CALL
The Tequesta Community Appearance Board held a regularly
scheduled meeting at the Village Hall, 357 Tequesta Drive,
Tequesta, Florida, on Wednesday, March 30, 1994. The meeting
was called to order by Chairwoman Leslie Cook at 9:35 A.M.
Community Appearance Board members present were: Paul Coben,
Ruth Maitland, Claudette Dalack, Stephen Parker, sitting in as
a Regular Member of the Board, and Scott D. Ladd, Clerk of the
Board.
II. APPROVAL OF AGENDA
The Agenda was approved as submitted.
ZII. APPROVAL OF PREVIOUS MINUTES
The recording secretary noted the changes to be made to the
March 2, 1994 minutes as specified by Boardmember Coben.

425 Beach Road, Tequesta.
Mason Simpson referred the Board to the color version of the
building explaining that it is eight stories of apartment
units, with . one ,.level of parking, etc.., and described,;:the

parking spaces .: He indicated the building. meets .all : set ��a,�ks '

Mr. Simpson briefly described the II townhomes, and�that
that portion of the project is currently in litigation, and
will not be addressed until it is resolved.

Boardmember Dalack did not like the contemporary design of the
building and prefers the Key West or Bermuda look. Mr.
Simpson explained some of the architectural details of the
building. Boardmember Maitland said that she was very
impressed with the building, and that it fits in perfectly
with what is on the island. Boardmember Maitland said that
while it is true that in Tequesta, they want the Mediterranean
and Bermuda feel, the island is almost completely
contemporazy. Chairwoman Cook did not like the way the
garages looked and asked if they could be hidden in some way.
Mr. Simpson said it could not be changed due to the 60 foot
set back.requirements. Boardmember Coben suggested using
shrubbery to enhance the south side of the driveway.
Mr. Parker asked about doing some banding of the colors on the
building. Mr. Simpson said it was not feasible and everyone
agreed.
Chairwoman Cook suggested the building be more heavily
landscaped due to the look of the parking spaces. Mr. Simpson �
explained in detail that the parking spaces had to be built
the way they were in order to not need variances.
Chairwoman Cook and Mr. Parker discussed the landscaping,
making changes to the landscape plan, to be given to Mr.
Simpson for implementation.
Chairwoman Cook called for comments from the audience. A few
members of the audience expressed their concern about going
ahead with Phase I when Phase II.has not been settled. Mr.
Simpson assured everyone that Phase I would be :built
regardless of the outcome of Phase II.
Mr. Parker made a motion to approve the project with sabal or
coconut palms along the south.side, berming along the street
right-of-way, both sides`of entr'ance drive, �hange the pigeon
plum to ligustrum trees, and add one ligustrum in the parking
island underneath the sabal palms as per the changes on the
plan. Boardmember Coben seconded the motion. The vote on the

Chairwoman Cook read a letter she composed to Dottie Campbell
thanking her on the fine job she did on the landscaping at
Gallery Square Narth. Boardmember Maitland suggested this be
put in the newsletter.
1 Chairwoman Cook feels that developers design what they want
and get approval for same before checking with the Village to
see what its overall design is. Boardmember Maitland said a
policy has to be put into the Community Appearance Board
Manual with regard to architecture and style of structures.

Chairwoman Cook took comments from the public under New
Business.

Requirements
This project complies with the comprehensive plan and concurrency requirements for the
Village of Tequesta. There are no impacts of which we are aware for which there is
insufficient capacity to serve the project. Under the zoning code in an R-3 multi-family
dwelling district, we are allowed 12 dwelling units per acre which equates to 32 total
units for this property. Since we are proposing only 22 units, we are considerably below
the maximum allowed within this zoning district and the comprehensive plan.
Item E- Statements of Prelimi.nary Review of Other A.gencies
Preliminary inquires have been made of Palm Beach County Department of
Environmental Resource Management (DERM) and South Florida Water Management
District (SFWMD). Barbara Conmy of DERM visited the site and indicated no
problems with development as long as any infringement into mangrove is permitted by
DERM. No infringement of this type is envisio�ed in our plan. ; SFWMD indicates that
we must meet minimum first floor criteria and positive outfall drainage requirement,
which we do.

North La Mar Condominium & Townhouses
Environmental Assessment
The services of Cotleur Hearing, Inc. have been retained to provide an environmental
assessment for the proposed North La Mar condominium and townhouse project. The site is
tocated on Jupiter Island on the west side of State Road 707 in Township 40, Range 43, Section
31. The parcel incfudes Lot 193 and part of Lot 194 of the plat of Gomez Grant and Jupiter
Island as recorded in Plat Book 1, Page 80, Palm Beach County, Florida public records and that
part of the submerged land lying east of the bulkhead line as recorded in Plat Book 28, Pages
154 & 155. The land is cunently vacant. To the south, land use consists of the La Mar
Condominium Complex. Land to the north is a portion of Coral Cove Park and consists of
roadside parking and a narrow fringe for �ecreational use.
Encompassing a total of 2.724 acres, the size cbntains 1.332 acres of upland area with the
remainder consisting of submerged land within the Intracoastal Waterway. Probably having been
p�eviously graded, the upland portions of the site are retatively flat and level with a definite g�ade
change at the shoreline. The�e is substantial erosion along this top of bank and several existing
Seagrape (Cocoloba uvifera} have fallen over. The upland areas of the site have been previousty
cleared and vegetation consists of seeded grass and a few low weedy herbs. A concrete
bulkhead amnors a portion of the Lot 194 shoreline. The remainder of the shoreline along this
site is vegetated by a fringe of Mangrove, predominately Red Mang�ove (Rhizophora mangle),
but also including a few Black Mangrove (Avicennia germinans) and White Mangrove
(Laguncularia racemosa) along the upper edge. One very large Black Mangrove was identified
with a d.b.h. (diameter at breast height) of 19 inches; however, probably as a result of cold kill,
the lateral branches of the tree were dead and rotted with live growth consisting only of young
shoots sprouting off the trunk. The tree is in definite decline.
Submerged lands watervvard of the Mangrove fringe does consist of subsiantial area of quality
seagrass beds. Mangrove species extend 6 to 8 feet landward of the mean high water line
shown on the Boundary Survey prepa�ed by Dailey & Associates dated November 2, 1993. The
remaining slope to the top of the bank is primarily vo�i of vegetation with c�nly a#ew P�d Appte
(Annona glabra), Green Buttonwood (Conocarpus erectus) and Coin �ne (Dalbergia
ecastophylium). Herbaceous. growth is Gmited to Spanish Needfes (Bidens pilosa).
' The ladc of upland vegetation predudes am/ utilization by wildl'rfe and no evidence of ar�y use
was identrfied. There was no svidence of Gopher Tortase on the site nor is the habitat fett to be
suitabte for any such use. Wetland areas of the site may �eceive some utilization by aquatic
species; howeve�, these areas are not p�oposed to be impacted and the narrow width of the
habitat makes it unlikely that they provide any signficaM value.

SUBJECT: REMOVAL OF EXOTIC VEGETATION IN TEQUESTA
Dear Mr. O'Donnell:
we have been contacted by Southport Dredging (County contractor for the estuarine
and dune restoration projects at Coral Cove Park) and Mr. Mason Simpson (property
owner adjacent to the southern boundary of the park) ccncerning the removal of
exotic vegetation adjacent to a mangrove fringe (see map). As this area is
immediately south of one of our recently completed restoration projects, the
removal of these exotics (Australian Pines and Brazilian Pepper) would help to
reduce the spread of undesirable vegetation to other areas including our newest
restoration site. The exotics are generally found within a transitional area
between the uplands and mangrove fringe and are out-competing the mangroves for ,
sunlight and space. -
�
The work will be performed by the same contractor that cleared exotics for the
County. To help avoid any potential impact to the existing mangroves waterward .
of the exotics, our staff will provide oversight during the�clearing of this
vegetation. This work is proposed to begin Monday moming, September 27, and
should be completed within a couple of days.

multi-family project is proposed to consist of 22 units.
A trip generation analysis was conducted to determine the number of trips which would
result from the proposed pmject.
� Table 1 shows the trip generation rates used, Table 2 the number of trips generated. 1�ip
generation showed that the proposed units would generate 154 daily trips, �vith 14 and 16
trips during the AM and PM peak hour respectively. Since Beach Radd h� �xcts,5,; c�p��c;ity
available, these 154 trips will not inopact this road.
Since the new trips are less than 200, per the Palm Beach County I,and Development Code
Section 7.9 �raf�c Ferformance Standard, a traffic study is not required if you have any

Storm drainage will consist of an underground collection system which will receive .
all drainage from impervious surfaces including the roofs of buildings and garages.
This wiil be channeled into an underground exfiltration trench whose eapacity will
be calculated to be consistent with cunent South Florida Water Management
District Guidelines.

Sanitary sewer will be collected from each dwelling unit within the buildings and
carried by gravity lines to the existing lift station on site. It is possble that this
lift station may be relocated on our property. We have had preliminary
discussions with ENCON regarding this and, with their approval, it can be done at
our cost. At this time a final decision has not been made with regard to moving
it.

This will be done with a water supply coming from the main located on the east
side of County Road 707 and will be distributed through the buildings in the

PURP'OSE AND SCOPB
� The purpose of this study is to establish design criteria for a practical and economical
system to drain and control the storm water runoff in the area hereinafter described
under the paragraph LOCATTON AND DESCRII''TION. This system will be designed
to provide a reasonable level of protection for the site improvements and 100 year storm
protection for the residential units. The design will not adversely impact any adjacent
facilities.
The scope of this study is to provide a design basis for a functional positive delay
drainage system. Facilities that will be provided include an exfiltration trench system
for retention/detendon storage, a collection system, and an outfall structure, all meeting
the applicable regulatory requirements.
LOCATION AND DESCRIPTION
The site of the proposed development is located in Sections 30 and 31, Township 40
South, Range 43 East, and lies in the Village of Tequesta, Florida. Containing a total area
of approximately 2.72 acres, the parcel is bordered on the east by State Road 707; on the
west by the Intracoastal Waterway; on the south are existing residential units; the north
end tapers to a very thin strip of land bordered by the Intracoastal Waterway and State
Road 707. Attached herewith is an aerial on which the approximate limits of the project
are noted. �
EXISTING .CONDITIONS
The present conditions of the 2.72 acre site is open undeveloped space. A portion of the
property lying along the Intracoastal Waterway is submerged lands. This area is �
approximately 1.39 acres.
There are no existing drainage facilities on the site. Topographical information shows
that the upland portion of the site varies from an elevation of 2.0 (msl typ.) at th�
Intracoastal Waterway to an elevation of 7.5 at the south end of the site. A review of
the Soil Conservation Service Soil Survey for Palm Beach County indicates that the soil
type for this area is Urban Land Complex which will be suitable for the proposed
development provided proper construction practices are utilizQd.
� Presently, rainfall on this site is discharged to two areas. Some rainfall percolates into
the ground, runoff to the west enters the Intracoastal Waterway and to the east Qows
into the road swale system.

Water management rules require that water quality requirements a�1d/or pre/post
development discharge (on a total volume basis) be contained in the retention system
prior to discharge. Calculations of these volumes will be done and the retention system
sized to accommodate the required volume.
The discharge to the Intracoastal Waterway will be by a"spreader swale" facility. This
is the method preFerred by the South Florida Water Management District for facilities
connecting to the Intracoastal. That method provides for the least impact on the existing
river bed.
The elevation that will be used for determining the minimum finished floor will be
based on the Federal Emergency Management Agency Flood Insurance Rate Map for this
area. A preliminary review of that map indicates that minimum elevation of 6.0 msl
will be necessary in this area.

project or clarified.
1. Buiidings are required to have a supervised automatic fire protection sprinkler system. System shall
have a water flow device and control valves for each floor.

3. A fire alarm system utiGzing an emergency voice/alarm communication shall be installed, with a two
way telephone communication system in accordance with NFPA # 72.

Dear Jim:
This will reiterate our discussions regarding the above captioned project and your memorandum
of March 23, 1994, which included comments regarding the fire rescue and life safety aspects of
it. As I understand it, our discussion was as follows:
1. The building will have a supervised automatic fire protection sprinkler system with
a flow detector switch device and control valve for each floor. This will be
detailed on the working drawings.
2. The building will have a Class III standpipe system with fire pump and this will be
detailed on the working drawings. We will provide one riser through the north
portion of the stairs (next to the elevator shaft) and that riser will have a cabinet
and, at the same level, we will provide a 2 1/2" hose valve at the landing of the
other stair. This will save a second riser. We will detail this on the working
drawings.
3. A fire alarm system utilizing emergency voice/alarm communication will be
insta.11ed with a two-way tetephone communication system in accordance with
NFPA # 72. This will be detailed on the working drawings.
4. We v�iil provide an emergency generator to operate the emergency lighting, the
fire alarm system, the fire pwnp, the central control statian equipment and
lighting, the fire control room, garage door openers, the elevators and mechanical
equipment for smoke proof enclosures. This will be detailed on the working
drawings. .

western edge of the property. lf we continue with the site plan currently under
review, this hose valve will not be required.
, 11. The entrance canopy .will be designed to have an overhead clearance of 11'.
12. The requirement of Section 18 - 2.4.1 of the Life Safety Code will be met if we
add double doors to the den. This will be done.
13, Buildings will have lightning protectio.n in accordance with NFPA #78. This will
be evidenced on the working drawings.
In addition to the above, we spent some time discussing the placement of speaker strobes,
smoke detectars, firefighter's jacks and other equipment related to the fire protection system.
These devices will be located by Rick Eickler as agreed during our meeting.
