S[TBJECT: Request for Temporary Sales Office; Agenda Item
Mr. Mason Simpson has requested Village Council permission to
construct a temporary sales office pursuant to Section X(K)(1)(b)
of the Zoning Ordinance, in association with the Cliveden
Condominium Project, 425 Beach Road, approved by the Village
Council at their Special Meeting on May 2, 1994. A copy of the
applicable Section of the Zoning Ordinance is attached for your
review.
It is not clear whether Mr. Simpson needs to have his building
permit in hand prior to requesting permission and/or receiving a
permit for a temporary sales office. If this is the case, at some
point in time, the Village Council may wish to reevaluate this
portion of the Zoning Ordinance as it relates to multi-family
development projects, since current lending institution practices
require a certain percentage of sales prior to approving financing.
This virtually dictates the need for a temporary sales office, on
site, before the issuance of a building permit, in order to
generate a sufficient amount of sales to secure necessary
financing.
At any rate, what is clear is that Village Council permission is
required in order to have a trailer, structure, or vehicles for
sales habitation or promotional purposes. As long as the Village
Council seeks appropriate conditions to their approval, such as a
clear time limit, I believe you can rest assured that Mr. Simpson
will provide a tasteful and first-class sales office to facilitate
his Project.
It is recommended that the Village Council grant permission to Mr.
Simpson in this regard.

Re: Cliveden Sales Trailer
Dear Mr. Bradford:
Pursuant to Appendix A, Section 10, Paragraph Kl{b) of the Tequesta Zoning Code, I
hereby request permission of the Village Council to erect a temporary sales trailer on the
Cliveden site. In this regard, I am attaching a copy of a site plan of the property
showing the proposed trailer location.

standing any other provision herein contained, f�ilure to
provide written notice to any adjacent property owners
shall not constitute a jurisdictional defect provided that
proper legal notice has been published.
(9) Filing f�ee. Upon filing an application for special exception,
the applicant shall pay a fee to the village at the time of filing of
such application. Said fee shall be in an amount as established in
Chapter 16 of the Village of Tequesta Code of Ordinances, �hall ,
not be reimbursable and is intended to defray costs of administer-
ing, processing, and reviewing the application.
(K) 1�ailers or Temporary Structures or Vehicles. ,
(1) On construction aites, trailera, temporary structures, or vehi-
cles used for construction officea on a con'struction site or in a
.. . .,.. . ., subdivision shall be permitted during the period of construction
only after a'building permit for the construction job has been
issued.
� (a) � Such trailers, temporary structures, or vehicles, must be
removed from the building site or subdivision in accord-
� ance with the prnvisions Chapter 5, Section 501 of the
� � � Standard Building Code/1985, and Section 103.6.1 of the
Palm Beach County Uniform Countywide Amendments to
the Standard Building Code.
(b) Such permitted trailers, structures, or vehicles, may be �
used for salea habitation o� promotional purpoees, only `,
upon permission of the village council and� shall be per-
mitted only after receiving a permit from the building .
official for each such trailer.
(c) A trailer, or temporary structure, or vehicle used for a
construction office on a construction site located within a
residentially zoned district of the village shall not have an
interiar dimension greater t�han ainety-sia (96) square feet.
The interior dimension restriction shall not agply to trail-
ers, or temporary atructures, or veluclea . which may be
permitted for subdivision infrastructure construction. Only
one (1) such trailer, or temporary atructure, or vehicle used
for �a construction office on a construction site shall be
{ _ permitted for each owner bu�der or prime contxactor within
a !`- Supp. No. 18 1183 ' .

any given subdivision for which the village has previously
accepted the tangible improvements required prior to the
granting of approval of the final plat. (Ord. No. 363, § 1,
4-28-88)
(2) The intermittent or continual placement or utilization of
any trailer, temporary structure, or vehicle for the use, such as
but not limited to, storage, shall be prohibited in all zoning
districts.
' (L) Commercial Vehicles and Trucks, Recreational Vehicles on�
Private Lots. •
� (1) No commercial vehicles or trucks over three-quarters (�4) ton
rated eapacity, may be parked on any property or right-of•way
within a residential area.
� � •. - (a) Residential areas include all .areas within the village other
than C-1, C}2, C-3, and RlOP.
(b) This restriction shall not apply to the temporary parking
of such vehicles on private property in residential districts
whereon construction is underway for which a current and
valid building permit has been issued by the Village of
Tequesta and said permit is properly displayed on the
premises.
(c) This restriction shall not apply to routine deliveries by
tra.d��smen or the use of trucks ; in making service calls,
provi�ing that such time period is actually in the courae of
business del!iveries or servicing, as the case may be.
, (d) This restriction shall not apply to the parking of emer-
gency vehicles, provided that the time parked is actuslly
� necessary for the emergency. Further, the restriction shall
not apply to volunteer emergency vehicles driven by resi-
. dents of the Village of Tequesta and parked on their property.
' - (e) This restriction shall not apply to a situation where such
vehicle becomes disabled and, as a result of such emergen-
cy, is required to be parked within a residential district for
longer than the time allowed herein. However, any such
vehicle shall;be removed from the residential district within
twenty-four (24) hours by wrecker towfng, if necessary, �
