BACKGROUND On May 27, 2011, Tequesta Towers filled an application to demolish a 410 Sq. Ft. pool cabana and construct a new Pool/Fitness Building in the R-3 zoning district. On September 1, 2011, the Planning and Zoning Advisory Board recommended approval of the subject application. On October 13, 2011, the Willage Council approved the application to demolish a 410 Sq. Ft. pool cabana and construct a new 2,904 sq. ft. Pool/Fitness Bui{ding. Please see attached Development Order and Staff Report. The building permit to construct the structure was issued on October 2012. Tequesta Towers decided to contract Taveras Engineering to oversee the structural construction of the building. Mr. Tommy Taveras, PE, designed the structure of the building, and he also conducted Structural Field Inspections. Please see his inspection reports that were submitted to the Building Department (see attachment). Also, please se�e attached Inspection History provided by the Building Department. On October 10, 2013, I met with Mr. Steve Thomson, current contractor of the subject application. Mr. Thomson explained that the roof line that was bui{d is different from what was approved by the Village Council in 2011. Mr. Thomson also indicated that the changes were perforrr�ed under the previous contractor, Mr. Chris Parisileti who passed away in August 2013. Mr. Thomson signed contract with Tequesta Towers on October 8, 2013. Please see attached staternent provided by the applicant in reference to the subject Site Plan Modification. 4, STAFF REVIEW 7he present Site Pian Modification application is eliminating the rcof terrace and spiral staircase and madifying the roof line previously approved (SFR 3-11). The requested mo�ifications were bui�t and are part of existin� conditions (pfease see beiow pictures). The pool/fitness building is an accessory structure i� the R-3 Multiale-Family Dwelling Zoning District. :n terms of height, Sec. 78.143 provides "11 stories!101 ft. measured from the average height of the crest of the sand dune line, for main building or str�acture east of Beach Road, and measured from gra�e west of Beach Road. 2 stories/20 ft for any a�cessary I�uilding or structure". The current roof line tnat was build is in com�lian::e with code. it is a two-story accessory building which height is 19'6". The attached letter from Mr. Scott Baruch, architect that designed the building, described the roof line modification and related changes to comply with code height. Tr�e current appiication does not alrere� code requieements previousiy approved in terms of setbacks, 4ot coverage, open space, landscape (s°e attached staff report from 2011). 5. FINAL REMARKS This development application met the requirements set on Section 78-334 notice of hearing. The notice of nearing was aavertised on November 11, 2013. The roof 1?nes �r.c� t! were modified so that the hipped roof continued to slope to a peak in the location of the roof terrace. Understanding that the approved design was near the height Iimit for the buiiding, and that the modi�ied roof increased the midpoint of the roof to grac?e anci average crest of dune measurements, the height of top of the masonry �vall and spring line for roof irusses was reduced in �rder to maintain the same roof height diinensions indicated in the origina? germitted dra��ings. In the form of background; The 'Tequesta Towers' Poolhouse/Fitness Building is designed by: Scott Baruch, Architect, J. Scott Baruch & Associates : 78 Beacon, Jupiter, FL 33469, and the structural designs and plans for the project are by Tommy Taveras, a Structural Engineer. Further, both Scott Baruch and Tommy Taveras were retained to oversee the construction of the project, with respect to their area of expertises and the relationship would continue until the project is complete. Mr. Pariseleti as the GC, handled all construction issues and matters involving building codes including but not limited to modifications and inspections. The roof modifications were approved by Scott Baruch after a new survey ordered By 1�1r. Pariseleti certified that the overall height of bu.ilding would remains unchanged and Mr. Pariset_eti assumed responsibility for reporting the change for appr�val to the Village Building Department. Ft. pool cabana and construct a new Pool/Fitness Building in the R-3 zoning district was filed at the Village May 27, 2011. The Development Review Cornmittee (DRC) reviewed the application in terms of compliance with Village's Code, law enforcement, fire safety, and public works requirements (June 8, 2013). Also, the applicant had prEViously submitted a differ��nt application to build a poolJfitness buildir�g in �December 2008. The following is a summary of the previous application timeline: � January 8, 2009- Pfanning and Zoning Board Advisory Board (P&ZAB) held a meeting to hear application. Board recommended that additional information be provided. � April 30, 2009- Appiicant met with residents and neighbors to discuss plans at Tequesta 1'owers. � July 2, 2009- After a disc�ssion by P&ZAB, the application was tabled to a time certain of 8/20/09. � August 20, 2009- P&ZAB approved the application with a condition "Village staff scrutinize the information presented by both Counsels and affirming that Village standards were met, to be determined by Village staff'. The "Condominium Associations" (Cliveden Jupiter is[and Condominium Association, Inc.; Island House Southwest Condominium Associatian, Inc.; Island House Northeast Condominium Association, Inc.; and LaMar Condominium Association, Inc.) retained Lewes, Longman & Walker, P.A. to represent them and to review the proposed site plan previously filed in 2008. The "Condominium Associations" filed for an appeal to challenge P&ZAB approval. The applicant withdrew the previous application, and filed a new application that is part of the current pet9tion vvhich was schedu[ed to be heard by P&ZAB at the July 2011 public meeting. The roof lines and. trusses were modified so that the hipped roof continued to slope to a peak in the location of the roof terrace. Understanding that the approved design was near the height limit for the building, and that the modified roof increased the midpoint of the roof to grade and average crest of dune measurements, the height of top of the masonry wall and spring line for roof trusses was reduced in order to maintain the same roof height dimensions indicated in the original permitted drawings.
