3. BACKGROUND
On May 27, 2011, Tequesta Towers filled an application to demolish a 410 Sq. Ft. pool cabana and
construct a new Pool/Fitness Building in the R-3 zoning district. On September 1, 2011, the Planning
and Zoning Advisory Board recommended approval of the subject application.
On October 13, 2011, the Willage Council approved the application to demolish a 410 Sq. Ft. pool
cabana and construct a new 2,904 sq. ft. Pool/Fitness Bui{ding. Please see attached Development
Order and Staff Report.
The building permit to construct the structure was issued on October 2012. Tequesta Towers
decided to contract Taveras Engineering to oversee the structural construction of the building. Mr.
Tommy Taveras, PE, designed the structure of the building, and he also conducted Structural Field
Inspections. Please see his inspection reports that were submitted to the Building Department (see
attachment). Also, please se�e attached Inspection History provided by the Building Department.
On October 10, 2013, I met with Mr. Steve Thomson, current contractor of the subject application.
Mr. Thomson explained that the roof line that was bui{d is different from what was approved by the
Village Council in 2011. Mr. Thomson also indicated that the changes were perforrr�ed under the
previous contractor, Mr. Chris Parisileti who passed away in August 2013. Mr. Thomson signed
contract with Tequesta Towers on October 8, 2013.
Please see attached staternent provided by the applicant in reference to the subject Site Plan
Modification.
4, STAFF REVIEW
7he present Site Pian Modification application is eliminating the rcof terrace and spiral staircase and
madifying the roof line previously approved (SFR 3-11). The requested mo�ifications were bui�t and
are part of existin� conditions (pfease see beiow pictures).
The pool/fitness building is an accessory structure i� the R-3 Multiale-Family Dwelling Zoning District.
:n terms of height, Sec. 78.143 provides "11 stories!101 ft. measured from the average height of the
crest of the sand dune line, for main building or str�acture east of Beach Road, and measured from
gra�e west of Beach Road. 2 stories/20 ft for any a�cessary I�uilding or structure".
The current roof line tnat was build is in com�lian::e with code. it is a two-story accessory building
which height is 19'6". The attached letter from Mr. Scott Baruch, architect that designed the
building, described the roof line modification and related changes to comply with code height.
Tr�e current appiication does not alrere� code requieements previousiy approved in terms of
setbacks, 4ot coverage, open space, landscape (s°e attached staff report from 2011).
5. FINAL REMARKS
This development application met the requirements set on Section 78-334 notice of hearing. The notice
of nearing was aavertised on November 11, 2013.

Regarding the above referenced project, as a cost savings measure, the roof terrace was removed
fi the project. The roof 1?nes �r.c� t! were modified so that the hipped roof continued to
slope to a peak in the location of the roof terrace. Understanding that the approved design was
near the height Iimit for the buiiding, and that the modi�ied roof increased the midpoint of the
roof to grac?e anci average crest of dune measurements, the height of top of the masonry �vall and
spring line for roof irusses was reduced in �rder to maintain the same roof height diinensions
indicated in the origina? germitted dra��ings. The 19'-6" from the midpoint of the roof dimension,
and the 23'-0" midpoint of roc,f to grade dimensions do not change.

Per your request, I respectfully submit the following statement explaining the circumstances vv�t,h reference to
roof modification of Tequesta Towers Poo1/Fitness Building.
In the form of background; The 'Tequesta Towers' Poolhouse/Fitness Building is designed by: Scott Baruch,
Architect, J. Scott Baruch & Associates : 78 Beacon, Jupiter, FL 33469, and the structural designs and plans
for the project are by Tommy Taveras, a Structural Engineer. Further, both Scott Baruch and Tommy Taveras
were retained to oversee the construction of the project, with respect to their area of expertises and the
relationship would continue until the project is complete.
Mr. Pariseleti as the GC, handled all construction issues and matters involving building codes including but not
limited to modifications and inspections.
The roof modifications were approved by Scott Baruch after a new survey ordered By 1�1r. Pariseleti certified
that the overall height of bu.ilding would remains unchanged and Mr. Pariset_eti assumed responsibility for
reporting the change for appr�val to the Village Building Department.
We/Tequesta Towers and Scott did not know that this was not done until on or ahout 10-24-2013 at which time
Steve Thornson reported to me ihat no application for this modification had been received by the Vilage of
Tequesta Planning & zoning.

3. �ACKGROU�D
The proposed application to demolish existing �10 Sq. Ft. pool cabana and construct a new Pool/Fitness
Building in the R-3 zoning district was filed at the Village May 27, 2011. The Development Review
Cornmittee (DRC) reviewed the application in terms of compliance with Village's Code, law enforcement,
fire safety, and public works requirements (June 8, 2013).
Also, the applicant had prEViously submitted a differ��nt application to build a poolJfitness buildir�g in
�December 2008. The following is a summary of the previous application timeline:
� January 8, 2009- Pfanning and Zoning Board Advisory Board (P&ZAB) held a meeting to hear
application. Board recommended that additional information be provided.
� April 30, 2009- Appiicant met with residents and neighbors to discuss plans at Tequesta 1'owers.
� July 2, 2009- After a disc�ssion by P&ZAB, the application was tabled to a time certain of
8/20/09.
� August 20, 2009- P&ZAB approved the application with a condition "Village staff scrutinize the
information presented by both Counsels and affirming that Village standards were met, to be
determined by Village staff'.
The "Condominium Associations" (Cliveden Jupiter is[and Condominium Association, Inc.; Island House
Southwest Condominium Associatian, Inc.; Island House Northeast Condominium Association, Inc.; and
LaMar Condominium Association, Inc.) retained Lewes, Longman & Walker, P.A. to represent them and
to review the proposed site plan previously filed in 2008. The "Condominium Associations" filed for an
appeal to challenge P&ZAB approval.
The applicant withdrew the previous application, and filed a new application that is part of the current
pet9tion vvhich was schedu[ed to be heard by P&ZAB at the July 2011 public meeting. Erin L, Deady, Esq.
filed an appeal on behalf of the Condominium Associations July 7, 2011. The appeal was to be heard by
Vil{age Council at the August 11 Public Hearing. The appeal was withdrawn August 8, 2011.
The application was heard by the Planning and Zoning Advisory Board on September 1, 2011. The Board
recommended approval 5-0 (See attached meeting minutesj. Also, please see attached power point
print out presented at P&Z meeting. Graphics incfude detai! analysis of Village Code height provisions
related to this application in the R-3 zoning district.

All construction, additions, and/or a.lterations within the Village, except in districts R-lA and R-1, must be
reviewed by the Planning & Zoning Advisory Board. The Planning & Zoning Advisory Board meets the
third Thursday of every month at 5:30 p.m., as needed in the Village Ha11 Council Chambers, 345 Tequesta
Drive. The applicant will be infonned �y letter of their scheduled meeting date.
The Planning and Zaning Advisory ]3oard shall have general authority as outlined in Sec. 2:?.53. Powers and
duties. After review and recommendation by the Planning & Zoning Advisary Board, applications will be
heard by the Vi11_age Council for final approval. After approval by the Village Council, a btu.lding permit can
be issued by the Building Department.

` The applicant will submit to the Village of Tequesta Planning and Zoning Department the following
documents for Planning & Zoning Advisory Board review, forty-five (45) days prior to the meeting
date:
1) For new construction or additions, Fifteen (1S) sets of professionally prepared site plans showing
a11 existing and proposed structures, setbacks, parking and load.ing layout, ingress and egress,
sidewalks and walkways, exterior lighting layout, dimensions of street frontages and property
lines and a11 signage.
2) Fifteen (15) sets of Landscaping Plans in accordance with Villag., of Tequesta Code of
Ordinances, Division IV, Landscaping.
3) Fifteen (15) sets of multi-dimensional color renderings andlor photographs are to be provided.
The Planning & Zoning Advisory Board needs to see an exact rendering of what is to be placed
on the site. Color photographs or prints as close to the actual colors to be used must be supplied.
Since color printers often do not display the correct color, it is recommended that samples of the
paint chips, as well as a sample of the support materials (i.e., can�as, wood, metal, etc.) be
provided. a
4) One (1) set of Plans 11x17 size and One (1) disk.
5) Any other documents that may help clarify the position of the applicant.

Regarding the above referenced project, as a cost savings measure, the roof terrace was removed
from the project. The roof lines and. trusses were modified so that the hipped roof continued to
slope to a peak in the location of the roof terrace. Understanding that the approved design was
near the height limit for the building, and that the modified roof increased the midpoint of the
roof to grade and average crest of dune measurements, the height of top of the masonry wall and
spring line for roof trusses was reduced in order to maintain the same roof height dimensions
indicated in the original permitted drawings. The 19'-6" from the midpoint of the roof dimension,
and the 23'-0" midpoint of roof to grade dirnensions do not change.

Demolish existing pool pavilion structure. Construct new Pool/ Fitness Building as indicated
as indicated.
' Due to the nature of the' work and the limited access and adjacent pool, underground
parking garage, retaining walls and landscaped areas the contractor shall use the utmost
care while removing, altering or demolishing any part of the structure and shall provide a
site logistics plan prior to commencing work.
The contractor shall take] all necessary safety precautions to insure the health & safety of
all persons and shall co ply with all OSHA requirements. All workers shall wear protective
safety equipment as req ired.
