MEETING MINUTES
Septembert 19, 2013
CALL TO ORDER AND ROLL CALL
The Village of Tequesta Planning & Zoning Advisory Board sitting as the Local Planning
Agency held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta
Drive, Tequesta, Florida, on Thursday, September 19, 2013. The meeting was called
to order at 5:30 p.m. A roll call was taken by Joanne Burnsed, Planning & Zoning
Department, who noted the following were present: Chair James Hackett, Board
Member Elizabeth Schauer, Board Member Steven Eagen, and Board Member Janet
Strand. Vice Chair Michael Schmidt arrived at 5:44 p.m. Also present were Alternate
Ashley Warren who arrived at 5:37 p.m., Brandon Schaad, for Planning & Zoning
Director Nilsa Zacarias, and Village Attorney Keith Davis.
APPROVAL OF AGENDA
MOTION
Board Member Schauer moved to approve the agenda as submitted. Board Member
Strand seconded the motion, which carried by unanimous 4-0 vote.
1. APPROVAL OF PREVIOUS MEETING MINUTES
MOTiON
Board Member Strand moved to approve the minu�es of the August 15, 2013 meeting
as submifited. Board Member Eagen seconded the motion, which carried by unanimous
4-0 vote.
2. ORDiNANCE NO. 27-13
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
Chapter 78, Zoning at Article IX, Supplemen#al Regulations, Division � Garage �
Sales and other autdoor sales, by amending the t�tle of Division 8 and Sections
78�551 through 78-554 to clarify and revise existing regulations regarding these
activities, and by creating an entirely nevy �ectian 78-561, Special Event Permits,
#o provide regulations and application requiremenfis for conducting speciai
events within the Village; providing that each and every other section and
subsection of Chapter 78 Zoning shall remair� in fuil force and effect as
previously adopted, providing a co�flicts clause, a severability clause, and
authority to co.dify; providing an effective date; and for other purposes.

The Village Attorney introduced Ordinance No. 27-13 into the record, and explained this
woufd be discussed at the October Village Council Workshop in conjunction with the
sign code.
MOTION
Board Member Schauer moved to recommend approval to Village Council of Ordinance
No. 27-13 as submitted. Board Member Eagen seconded the motion, which carried by
unanimous 4-0 vote.
3. ORDINANCE NO. 38-13
An Ordinance of the Village Council of the Vilfage of Tequesta, Florida, amending
Chapter 78, Zoning, Article X, Off-Street and On-Street parking and loading
regulations, by providing new regulations for veterinary office uses, by adding
regulations regarding parking lot traffic calming devices and internal signage,
and regarding off-street yard area parking spaces; further revising certain parking
space, loading area and drive aisle parking requirements, and by providing for
internal consistency; further amending Chapter 78, Zoning, by repealing Article
IX, Supplemental Regulations, Division II, Parking of Commercial Vehicles,
Trucks, and Recreationa! Vehicles on private lots; providing that each and every
other section and sub-section of Chapter 78, Zoning, shall remain in full force and
effect as previously adopted, providing a conflicts clause, a severability clause,
and authority to codify; providing an effective date; and for other purposes.
The Village Attorney described proposed changes in Ordinance 38-13, and answered
questions from the Board. Chair Hackeft requested addition of a loading demand
statement.
MOTION
Board Member Sci�auer rrtoved tQ r�commend approval to Vil{age Council of Ordinance
No. 38-13 with recommendation to add a provision containing a loading demand
statement. Chair !-lackett seconded the mo�ian, which carried by unarrimous 5-0 vote.
4. QRDINANCE NO. 39-13
An Ordinance of the Yiitage �ouncil of the Vi�llage of Tequesta, Florida, am�nding
tl�e Village Code of Ordina�ce� at Chapter 7$, Zoning, Article IX, Supplemental
Reg�ulatiQns, Division 4, Landscaping. By amending this division to update
certain "Florida Friendfy Landscaping" requirements throughout the Village, to
clarify the application of s�ach regulations fio new construction and certain re-
development; to update code graphics and provide for interna! consistency;

providing that each and every other section and subsection of Chapter 78 Zoning
shall remain in full force and effect as previously adopted; providing a conflicts
clause, a severability clause, and authority to codify; providing an effective date;
and for other purposes.
The Village Attorney explained the proposed , Ordinance No. 39-13, and answered
questions from the Board.

Board Member Schauer moved to recommend approval to the Village Council of
Ordinance No. 39-13. Board Member Strand seconded the motion, which carried by
unanimous 5-0 vote.
5. ORDINANCE NO. 41-13
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
the Village Code of Ordinances at Chapter 46, Motor Vehicles and Traffic, at
Article III, Parking, stopping or standing, by creating an entirely new Division 2, to
be entitled "Parking of Commercial Vehicles, Trucks and Recreational V�hicles";
relocating and upda#ing said regulations from Chapter 78, Article IX; Division 11;
and also relocating and updating relevant definitions from Chapter 78, Article 1;
providing that each and every other section and subsection of Chapter 46 shall
remain in full force and effect as previously adopted; providing a conflicts clause,
a severability clause, and authority to codify; providing an effective date� and for
other purposes.
The Village Attorney explained the proposed changes created by Ordinance No. 41-13.
Chair Hackett stated for the r�cord that Vice Chair Schmidt and Alternate Ashley
Warren were both present.

Board Member Strand moved to recommend approvaf to the Village Council of
Ordin.ance No. 41-13. Board Mernber Eagen secondsd fhe motian, which carried by
unanimous 5-0 vote.
6. ORDINANCE NO. 42-13
An Ordinance Af the Viiiage Counc�l of the i0illage of Tequ�sta Floricla, arr��rrding
Chapter 78, Zoning, Article IX, Supplemental Regulations at Divasion 2, Site Plan
Review, to provide for internal consistency, to update the list of outside
regulatorry agencies, to bring level of service standards into conformar�ce vvith the
Village'� Comyrehensive Development Plan, to provide for the Village's
Planning & Zoning Advisory Board Sitting as the

Development Review Committee, to provide for an optional conceptual pre-review
process and to update certain application requirements including requirements
for the imposition of conditions of approval; and at Division 3, Special Exception
Uses, Section 78-365, to specify that conditions of approval associated with the
granting of a special exception must be related to the proposed development and
be roughly proportional to the anticipated impacts of the proposed development,
in accordance with recent rulings by the U�nited States Supreme Court; and at
Section 78-369, to update optional Special Exception Use Pre-Application Review
Process submittal requirements; providing that each and every other section and
subsection of Chapter 78, Zoning, shall remain in full force and effect as
previously adopted, providing a conflicts ' clause, a severability clause, and
authority to codify; providing an efFective date; and for other purposes.
The Village Attorney explained the how the proposed changes in Ordinance No. 42-13
would streamline the submittal process.
MOTION
Board Member Schauer moved to recommend approval to the Village Council of
Ordinance No. 42-13. Vice Chair Schmidt seconded the mction, which carried by
unanimous 5-0 vote.

There being no further business to come before the Bo�rd, upon motion by Board
Member Schauer, seconded by Vice Chair S�hmidt and carried by unanimous 5-0 vote,
