LEASE AGREEMENT
Tequesta Shoppes
THIS LEASE, (the "Lease") made and entered into as of the �� af /►i� v,��r d�2 2003, by and between Inland Southeast
Propeity Management Corporation ("Landlord"), and Tmpicale Equities, Ine. ("Tenant").
WITNESSETH: '
ARTICLE I
REFERENCE PROVISIONS, AND ENUMERATION OF EXIi1BITS
. Section 1.1 REFERENCE PROVISIONS. Where used in this Lease, the designated terms hereinafter set forth shall have the meanings
ascribed by the provisions of this Section 1.1:
(a) "SHOPPING CENTER" — That certain real property generally lrnown as Tequesta Shoppes (the "Shopping Center") more particularly described
in Exhibit "A" attached hereto and by this reference incorporated herein together with all improvements now located or hereafter erected thereon, less any
deletions pursuant to this Lease, plus such additions as the Landlord may from time to time designate as comprising part of the Shopping Center.
(b) uCOMMON AREA" — All areas and facilities in the Shopping Center designated for the general use, in common, of occupants of the Shopping
Center, including the Tenant hereunder, its officers, agents, empioyees and customers. Common Areas shall include the parking areas, sidewalks, canopies,
roadways, loading platfonns, washrootns, ramps and landscaped areas.
(c) �ANCHORS" — All tenants occupying bays in the Shopping Center in excess of 8,000 square feet.
(d) "TENAN'T'S TRADE NAME" — EaYsy's Cafe.
(e) "LEASED PREMISES" — That certain space known as Bay 159 located in a building erected or to be erected on the Shopping Center containing
approximately 2,800 square feet as shown Exhibit "B" attached her�to as well as adjacent courtyard garden, which Tenant will utilize as an outdoor eating area.
and which shall be the TenanYs sole responsibility to maintain in accordance witli Landlords guidelines and local municipal codzs.
(� "FLOOR AREA" — The actual number of square feet�of floor space within the Leased Premises and any area outside the I,eased Premises which is
exclusively appropriated for use by Tenant; subject, however, to the limitations as herein provided. The F7oor Area of the Leased Premises shall be finaily
determined by Landlord on or before the "Rental Commencement Date" (as herein below defined), and shail be calculated by measuring from the center line of
interior or party walls and from the exterior faces of exterior walls.
(g) "LISE" — Tenant shall use the Leased Premises solely for the putpose of a gouimet cnfc and grill serving food, beverages and alcohol in accordance
with lacal mnnicipatities.
(h) �TERM" — The period commencing as of the date h,ereof and ending, unless extended or sooner terminated as herein provided, at 12 o'clock
(midnight) Five (5) Years after the last day of the month in which the Rental Commencement Date occurs as herein below defined.
(i) KRENTAL COMMENCEMENT DATE" — Rent shal] commence on lune ] 5"', 2004. In the event the Rental Commencement Date shali not have
occurred within three (3) years of the date hereof, this Lease shall be automatically null and void and of no force and effect. The Landlord shall confinn said
date in wriring by sending notice thereof to the Tenant within thirty (30) days. If the date designated in such notice as the Rental Commencement Date is not
disputed by Tenant within ten (10) days of receipt, such date shail be deeined the agreed upon Rental Commencement Date.
(j) "MINIMUM REN'f" — The Minimum Rent shall be $4,666.67 each month initially payable on the Rental Commencexnent Date and payable
thereafter on the first day of the month for the balance of the Lease Term or extensions thereof.
(k) i°SHARE OF OPERATING EXPENSES" — This is a fully net lease and Tenant shall pay its pro rata share of Operating Expenses as set forth in
Section 2.6. Initially, Tenant shall pay $1,S 16.67 monthly toward Tenant's share of Operating Expenses which is due on the first day of the month along with
the Minimum Rent.
(1) �PERCENTAGE RENT AND BREAK POiNT" - There shall be no Percentage Rent due under tliis Lease. All references to Percentage Rent
are hereUy deleted.
(m) °°MERCHANTS ASSOCIATION DUES" - Ther� are n� Merchants Association Dues.
(n) uINITiAL DEPOSIT" - The arnount of $13,554.33 shall be paid to Landlord upon Tenant's racecution of this Lease of which $7,000.00 is to be a
Security Deposit applied as provided in Section 11.3. The balance of $6,554.33 represents the first full month's Minimum Rent, Tenant's share of Operating
Expenses, Merchants AssociaHon Dues (if applicable) and $371.00 (6,00%) sales tax. �
!a) "ADDRESS FOR PAYMENTS" — Unless otherwise dixected hy Landlorcl, all payments hereunder or required by this L.ease shall be made to:

(p) "RENT INCREASE" — The Minimwn Rent shall increase per the attached Rent Schedule. ,

Section 1.2 GRANTING OF THE LEASED PREMISES. Landlord hereby leases to Tenant and Tenant hereby rents from Landlord the Leased
Premises. Provided Tenant is not in default hereunder, Tenant shall be entitled to use the Common Areas in common with the Landlord and the other tenants
of the Shopping Center tluroughout the Term of this Lease. Landlord may make limited relocation of the Leased Premises and may increase, reduce or
change the number, diraensions or location of the improvements comprising the Shopping Center or any of them in any manner whatsoever as Landlord
shall dee�n proper. lt is expressly understood and agreed that nothing herein contained shall be construed as a grant or rental of or a conveyance of any rights
in the roof or exterior of the building or buildings of which the Leased Premises constitute a part; the air space (occupied or not) above a horizontal elevation

The measurement from the front door of the Church to the front
c�oor r�f the proposed Ca#'e is 722 feet based on GIS measurements
(please refer to the map and aerial photo attached).
Research into the area confirmed that there are several other
� restaurants tihat have receiv+ed. variances for bezng situated within
1000 feet of St. Jude's Chureh. These current and past
restaurants include:
I. The Heidelberg Restaurant located in Fashion
Sq�are Mall, serves beer and wine and is applying
for a liquor lic�nse.
� 2. Poncho and Pepe's Mexican Restaurant, also located
in the Fashion Square Mall, serves beer and wine.
3. �acimo's was a'restaurant that served alcohol and �
w�s located in the same tenant space as the applicant
prior to Opie's ,{which did not s�rve alcohal).
4. A restaurant known as Brandywine Downs served
alcohol and was located in the far northern space of
the Tequesta Shoppes.
Stai� Recommendations:
Pre�vi.c�us variances for this ordir�ance addressed the hours of o�eration
and the transferability of the v�riance. Staff recammends that the
. variance be approved with these canditions:
z. The VilTage Council shoulci address the hours of operation. The
Village of Tequesta's Code of (�rdi.nances Article IV Division 2,
Chapter 3 Alcoholic Beverages, Section S-1, Hours of Operation
states:

2. Th.at the variance be deemed non-transferable, that is, that the
variance remain tied to bo�h the exact location (159 U.S.
Highway One) and to the exac� owner of the tenant space (John
Corsilia). This will ensure that if another tenant takes over the
space, the new own�r will be required to f le for a variance. It
will also ensure that if the current owner (John Corsilia) moves
the Cafe to another location within 1000 feet of any church,
school or youth cen�er, the Vil�age Council will be able to
r�search the new restaurant before allowing another variance.

The Six criteria of the Village of Tequesta zoning code section X111(e)
(1)(b)1-6 Which are attached to this application have been met.
1) Variance to the extent of 1,000 feet from a Church; please note that the State requirement is
SOQ feet;
2) the special conditions and circumstances do not result from the actions of the applicant;
3) Granting the variance requested will not confer on the applicant any special privelege that is
denied by this ordinance to other lands, buildings or structures in the same zoning district;
The follawing Restaurants are serving alcoholic beverages within 1,000 feet from a church. I.e.
Olivera, Heidelberg, McCarthy,Pancho Pepe '
and it is my understanding that the previous tenant to Opie's (Jacimo's)
also served Alcoholic beverages at the same address as th�e applicant.
4 The literal interpretation of the provisions of the ordinan�ce would deprive the applicant of the
rights commonly enjoyed by other properties in the same zoning district under the terms of the �
ordinance and would work unnecessary and undue hardship on the applicant;
5) That the variance granted is the minimum variance that will make possible the reasonable use of
the land,building or structure;
6) That the grant of the variance will be in harmony with the general intent and purpose of the
ordinance and tha.t such variance will not be injurious to the area urvolved or otherwise
detrimental to public welfaxe).
