Bids for the Demolition �of Tequesta Plaza, Retail Building, Phase I, were opened on Wednesda.y,
August 30, 20�. Two coirtractors submitted alternate bids: Thomas B. C�shing Demolition of
West Palm Beach, Florida, and ACT, Inc. (Enviromnental and Construction Servicss) of Land Q'
Lakes, Florida. Upon review of the bids and the coutractors' credentials, Harry Beuort, P.E.,
Project Manager, Gee 8c 7enson, has recommended bid awazd to Thomas B. Cushing Demolition.
(See attached letter from Mr. Benoit dated September 7, 2000.) Cushing Demolitioan, a
well-known, reputable demolition compa,ny, has completect many demolition projects throughout
Palm Beac,1� Couniy including the demolition of the Lighthouse Plaza. in Te,questa (curreut sit� of
Tequesta Oaks). •
Subsequent to the bid opening, Thomas and N�cy Cushing (Cusl�ing Demolition), Hazry Benzoit,
Russell V4hite, Facilities Supeivisor, and I negotiated successfully to bring Cushing's coutract
within the V'illage's budget. The amount of the Bid Awazd for the Demolition of Tequesta. Plaza
R.efia� Bu�ding, Phase I, is $87,750.
This project has been bid in two Phases in consideration of the existin�, viable businesses in
Teque.sta. Plaza. These businesses have the option of moving i�o Bu�ding A, presentty under
eonstrtiction on the northeast parcel of Tequesta V'illage Ceuter, once completed, or reloca�ing to
ather space. The demolition of Phase I of the retail bw�ding will allow for these businesses to
remain "open for business" during the demolition period and to continue operalang just prior to
Phase II demolition anticipat� for April l, 2001.
It is recommended that the V'il�a Council� approve th� Bid Award for the Demolition of
Tequesta Ptaza Refiail �3v�ding, Phase I, to Thom�s B. C�sbing D�mo�tion of Wast Palm Beach,
Florida.. �

Re: Tequesta Plaza Demolition
Dear Ms. Manganiello:
We are forwarding an evalua.tion of the cost of the various alternatives available to the Village of
Tequesta. in accepting a bid for demolition of Tequesta Plaza.
The low bid of ACT, Inc. is shown in Column 1 and includes ac]�owledged irregularities.
Specifically, the sum of items No. 1 through No. 10 ($160,690.00) does not equal the unit price
bid total($160,000.00), and Item No. 5($2,500.00) does not equa.l altemate No. 2($25,000.00).
ACT, Inc. has submitted an amended bid sheet correcting the above irregularities. .Their
amended ,bid., figures are shown in Column 2.
The Village of Tequesta is under no obligation to accept either the low bid with irregularities or
the amended low bid. The options open to the Village are as follows:
1. Accept the low bid with irregularities (note that the irregularities result in a favorable cost
to the Village)
2. A�ccept the low bid as amended.
3. Accept the low bidder with a negotiated cost between the low bid and the amended bid.
4. Reject the low bid and accept the second lowest bid, which does not include any
discrepancies.
5. Reject all bids and rebid the project.
We tvvi.ce requested a list of subcontractors and a list of references from ACT, Inc. They faxed a
list of refer but not a list of their subcontractors. Their reference list includes only one
project in excess of $80,000 and that reference is for a consfiruction contxactor. We suspect that
ACT, Inc. is a specialty contractor in the removal of asbestos and normally works as a
subcontractor to general contractors.

In view of the fact that ACT, Tnc. submitted a bid with irregularities and has been unresponsive
regarding their proposed subcontractors, we recommend that this contract be awarded. to the
second low bidder, Thomas B. Cushi.ng Demolition. We further recommend that negotiations be
in.stituted if necessary, to bring Cu.shing Demolition contract within the Village's budget.
