Subject: Amendment to Village Manager's Employment Agreement approved Nov 14, 2002
1) The "Senior ManagementJUepartment Head.s Pay and Compensa.tion Stud�' approved by Council on
Ju1y 10, 2002 ("Study") contained a recommendation that the beaefits package, specifically the ,
retirement contnbution, for the Villa.ge Manager, be increased in the rar�ge of $6,000 to be equitable v�ith ,
other comm.unities. No percentage of base pay was included. in this recommendation. �
2) On Ju1y 23, 2002, the Study Contractor issued a clarification memorandum to explain that the

retirement conlnbution for the Village Manager shduld be increased by an ad.ditional 6% of ba�e pay. . '
Due to administrative workload. at tha.t time, this cla.rifica.tion was not distri'buted to hold�rs of the I i
approved Study for attachment as an amendment to the applicable paragraph i
3) Based on the clarification me�r.�orandum and prior Coun.cil approval of the Study, the Village Hwman
Resources Coordinator executed a Personnel Action Form increasing the Village Mana.ger's retirement ,
contriibutian from 6% to 12% in Ju1y 2002. However, through inadvertent ovErsight, this change
in retirement contnbution was not submitted as a formal amendment of the Village Manager's
Employment Agreement, itn effect at that time. Thus, the increase in the retiremem contn'bution was not
recognized during review of the prior Employment Agreement, nor incarporated in the Villa.ge Manager's
current Employment Agreement approved by Counc�. on November 14, 2002.
4) Upon implementa.tion of the Village l�sanager's curren�t Employment Agreement, it was noted. that the
new Agreement did not include the increase in the retirement contnbution from 6% to 12%. At that
time the 12% retirement contnbution, executed in July, was reduced back to 6% pending formal
amendment of the Village Mauager's current Employment Agreem,ent.
5) After consultation with Mr Kurtz, Village Labor Attorney, ft was agreed, that in light of the Village
Manager's current (new) Employment Agreement, the Study contractor be requested to reissue his
recommendation for a 6% increase in the retirement contn'bution as well as certification of its cou#inued
applicability to the Village Manager's current Empioyment Agreement .
6) The Study Contractor has, in a memorandum attached hereto, reconfirmed, with justification, his
recommenda.tion for the increase in retirement contnl�ution from 6% to 12% and certification of its
continued applicability to the Village Managex's current Employment Agreement. .
'n It is therefore recommended. that Section 10 of the Village Manager's Employment Agreement
1� amended to state, in part ---------- "The Village agrees to pay a� amount equal to twelve
per cent (12%) of Micha.el R Couzzo Jr.'s annual base salary into the ICMA- RC"

I was recently meeting with Mr. Couzzo with regard to our contract to provide services to the
Village of Tequesta.. Our firm has been hired. to review the Village's existing employee �
evalua.tion criteria and procedures. 'I

During my interview, Mr. Couzzo in.dicated. his desire to incorporate pay for performance
standards in our analysis. Mr. Couzzds current Employment Agreement dated November 1�,4, ,�
2002, was provided for review of performance recogni.tion lan.guage contaaned therein. !

Additionally, in response to your request, I also reviewed. the deferred. compensation package Xn
the Employment Agreement and noted that it was not consistent with the intent of o�ar
recommenda.tions as approved by the Coun.cil. Therefore, I would like to clarify o�.ir
recommendation so that appropriate modifications to Mr. Couzzo's Employment Agreement c�n �,
be made. The original recommendatioa was: �
