RE: Future Land Use Ma,p/Comprehensive Plan
Amendment —(Referred to as the Morgan property)
The Spear Group, through theix agen Gentile, Holloway, O'Ma.honey, and Associa.tes, Inc., are
requesting a Residential I.ow Density (max�im.um 0-5 dwelling units/acre) land use designa�ion
on a 0.29 acre pareel of Iand generally deseribecl as lying north of Riverside Drive; and west of
and adjaeent to a 15.23 acre parcel recently annexed irtto the Village and which will be
combined with that parc�l as an overall proposed development project, if approved. The
Res�;�i�tial Low Density use request is consistent with the current County la.nd use of LR-S
whi�� allows three (3) uruts per aere and up to four (4) units to an aere with a PUD. The
eventual c#evelopment of this parcel will � consis�ent with thi.s density and will be of a similar
Iand use densify assignec�. ta its adjaeent properties. The fut�xre Ia.nd use request wi11 require a
change to the FuEure Land Use (fLU) Ma.p. Because this pareel was recently annexed, the FLU
Ma.p will. have to reflect the new municipal boundaries with the Residential Low Density
designation. The entire FI,U Map Series eonsisting of the General Sails Ma.p, Flood Zone map,
Coastal Zone and Conservation Ma.p and Hurricane Surge Map will ha,ve to refleet the
municipal boundary ehange as well. The pro�sed FIsU request is consis�Eent wYth the Goals,
Objectives and Polieies of the Village of Tequesta Comprehensive P1an. This F'LU Map/
Comprehensive Pla.n Amendrnent is a small-scale amendment. It will 1� transmitEed i�
approved to the State DCA and other appropriate review agencies for informational purposes,
if approved..
T'he applicant has demonstrated that the impacts of this proposal will not adversely impaet
utilities and the road system in the Villa.ge. Attaehed to this applieat�ion are Ietters froxn
ENCON (sewer), the Palrn Beach County Solid Waste Authori�Ly (solid waste), and the Village
Utilities Department (water) indica.ting that there are adequate utility cap�.cities to
accommodate this proposal. Additiona.11y, the Village Traffie Consultant has reviewed the
potential impacts of tlus fufi�.re land use and has determined that the traffie generated would
be withi.n the transportation level of serviee standa.rds adopted in the Comprehensive Pla.n.
It is reeommended that the Village Couneil approve this proposed Future Land
Use/Cc�mprehensive Pla.n Amendment applieation.

WI�EREAS, the Locai Flanning Agency of the Village of Tequesta has held a ,
public heaxing to rnal�e reco�endation to the Village Councal and has �
recommended the adopt�on of the amendrnents to the Coinpreh�a��ive Pi�,n
c�ntained h�rein; and
W�iEREAS, th� Village Council wishes to approve and adopt a s�aall scale �
amendment to the Land TJse 1VIap of th� Village a.� se� forth on Exhibit "A"

Secrion 1. The Village Council of the Village of Teques�ta, Florida, does hereby
amend the Comprehensive Plan of the Village in accordance with the Loca.l
Government Comprehensive Planning and Land Development Regulation Act, as
amended, adopting a sma11 scale amendment to the Future Land Use Map in the
area designated on the attached exhibit, applying a residential low density land
use classification to a portion of real property Iocated on the north side of
Rivea�side Drive, west of and adjacent to a 15.23 acre parcel referred to as the
Rood Property , containing appro�umately 0.29 acres.
Section 2. S�verability. If any provisaon of this Urdinance or the application
thereof is held invalid, such invalidity shall not affect the other provisions or
applica.tions of this Ordinance, which can be given effect without tbe invalid
provisions or applications, and to this end, the pravisions of this Ordinance, are
hereby declared severable.
Section 3. Repea,l of Ordinances in Conflict. .All other ordinances of the
Village of Tequesta, Florida, or parts thereof which conflict with this or any part
of this Ordin�.�ace are hereby repealed.
Section 4. Codification. This Ordinance shall be codified and made a part of
the official Code of Ordinances of the Village of Tequesta.
Section 5 Effective Date. This Ord°u�ance shall take effect immediately upon
its passage and approval, as provided by law.
