RE: Future La.nd Use Ma.p/Comprehensive Plan
Amendment —(Referred to as the Glendinning pro�rty)
The Spear Group, through their agent Gentile, Hollowa.y, O'Ma.honey, and Assoeiates, Ine., are
requesting a Residential Law Density (rnaximum 0-5 dwelling units/acre) la.nd ixse designation
on a 0.34 aere pareel of Ia.nd generally deseribed as lyi.ng north of Riverside Drive; and lying
west of and adjacent to a 15.23 acre pareel tha.t was recently annexed into tihe Village and
whieh will be part of an overall proposal development projeet, if approved. This parcel was
reeently volunta.rily annexed into Tequesta. The Residentia.I Low Den.sity use request is
consistent with the current Coun�Ey �.and use of LR-3 which allowed three (3) units per acre
and up to four (4) units to an aere with a PUD. The eventual development of this pareel will
be eonsistent with this density and will be of a similar land use density assigned to its adjaeent
properEies. The future land use request will require a ehange to the Future La.nd Use (FLU)
Map. Beca.use this parcel was recently annexed, the FLU Ma.p will have to reflect the new
municipal bounda.ries wit� the Residential Low Density d.esignation. The entire FLU Map
Series eonsisting of the General Soi1s Ma.p, Fl�d Zone rna.p, Coastal Zone and Conservation
Ma.p and Hurricane Surge Ma.p wi11 ha,ve to reflect the municipal baundary ehange as well.
The pro�sed F'LU request is eonsistent with the Goals, Objeetives and Polieies of the Village of
Tequesta Comprehensive Pla.n. This FLU Ma.p/ (Comprehensive Pla.n Amendment is a small
s�a1e amendment. It will be tra.nsmitted to the Sta.te DCA and other appropriate review
ageneies for informational purposes, if approved.
The applicant has demonsErated that the impacts of this proposal will not adversely impaet
utilities and the road system in the Village. Atta.ched to this applieation are letters from
ENCON (sewer), the Pa1rn Beach Couniy Solid Wa.ste Authority (solid waste), and the Village
Utilities Department (water) indicating tha.t there are adequate utility capaeities to
aecommodate this pro�sal. Additiona.11y, the Village Traffic Consulta.nt ha.s reviewed. the
potential impaets of this fixfixre land use and has determined tha.t the traffie generated would
}� within the transportation level of serviee standards adopted in the Comprehensive Plan.
The applieant's engineer has submitted a 1et�er assuring that drainage requirements w�ll 1� met
and stormwater mana.gement standa.rds will also be met.
It is recommended tha.t The Villa.ge Council approve this propased Future I.and
Use/Comprehensive Plan Amendment applieation.

VII..LAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING THE COMPREHENSIVE PLAN OF
THE VII.LAGE OF TEQUESTA, FLORIDA IN
ACCORDANCE WITH THE LOCAL GOVERNMENT
COMPREHElVSIVE PLANNING AND LAND
DEVELOPMENT REGULATION ACT, AS AMENDED,
ADOPTING A SMALL SCALE DEVELOPMENT
AMENDMENT TO THE FUTURE LANIII USE MAP IN THE
AREA DESIGNATED ON THE ATTACHEID EXHIBIT,
APPLYING A RESIDENTIAL LOW DENSITY LAND USE
CLASSIFICATION TO A PORTION OF REAL PROPERTY
LOCr�TED ON THE NORTH SIDE OF RIVERSIDE DRIVE,
WEST OF AND ADJACENT TO A 15.23 ACRE PARCEL
REFERRED TO AS THE ROOD PRQPERTY,
CONTAINING APPROXIMATEIdY 0.34 ACRES;
PROVIDING FOR SEVERABILITY; PRUYIDING FOR
REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
WI�REAS, pursuant to Section 16331G1 et seq., Florida Statutes, being the
Loca1 Govemment Comprehensive Planrring and Land Develapment Re,gulation
Act, the Village of Tequesta may adopt amendments to the Comprehe�si�e Plan;
and
WHEREAS, pursuant to Section 163.3179, Florida Statutes, the Village may
make sma11 scale development amendments pursuant to the provisions of said
statute; and
WHEREAS, the Local Planning Agency of the Village of Tequesta has held a
public hearing to make recommendation to the Village Council and has
recommended the adoptian af the amendments to the Comprehensive Plan
cantained herein; and
WI�REAS, the �illage Council wishes to approve and adopt a small sca.le
amendment to the La.nd Use Map of the Village as set foath on Exhibit "t�"
attached. hereto.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF
�� TTHE VII.,LAGE OF '1'EQUESTA, PALM BEACH COZJNTY, FLORIDA, AS
� FOLLOWS:
Section 1. The Village Council of the Village of Tequesta, Florida, does hereby
amend the Comprehen.sive Plan of the Village in accordance with the Local
CTovernment Comprehensive Pla.nning and Land Devel�pment Regulation Act, as
aanended, adopting a small scale amendment to the Future Land Use Map in the
area designated on the attached exhibit, applying a residerrtial low dsnsity land
use classification to a portian of real property located on the north side of
Riverside Drive, west of and adj acent to a 15.23 acre parcel referred to as the
Rood Property , containing approximately 0.34 acres.
Section 2. Severability. If any provision of this Ordina.nce or the application
thereof is held invalid, such invalidity shall not affect the other provisions or
applications af this Ordix�aiace, which can be given effect without the invalid
provisions or applications, and to this end, the provisions of this C�i are
hereby declared severable.
Section 3. Repea.l of Urdinances in Conflict. All other ordinances of the
Village of Tequesta, Florida, or parts thereof which conflict with tlus or any part
of tlus Ordinance are hereby repea.led.
Section 4. Codification. This Ordinance shall be codified and made a part of
the official Code of Ordinances of the Village of Tequesta..
Section 5 Effective Date. Tlus Ordinance shall take effect immediately upo�
its passage and approval, as provided by law.
