SUBJECT: Response to Public Service Commission Request for Village
Council Intentions Relative to Establishment of Hardship
Criteria for Mandatory Hook-Up to Investor-Owned Sewerage
Systems; Agenda Item
Attached hereto, please find correspondence received from the
Public Service Commission. The Public Service Commission seeks
Village Council input relative to what action you plan to take with
regard to F.S. 381.00655. Basically, the PSC wants to know what
action Tequesta will be taking with regard to establishing criteria
for hardship whenever an investor owned sewerage system requires
mandatory hook-up.
In this regard, I would suggest that the Village Council authorize
the Village Manager to direct a letter addressed to the PSC,
stating the following:
1) The Village of Tequesta has granted a Franchise to the
Loxahatchee River Environmental Control District, a special
district of the State of Florida which gives it purview over
� all sewer issues in this region and within the Village of
Tequesta.
2) Accordingly, there will be no investor owned utilities
operating within the Village of Tequesta, as such would be in
contravention of the Franchise granted to the Loxahatchee
River Environmental Control District.
3) In the event that a private investor owned utility were to
operate within the Village of Tequesta, Tequesta would, in all
likelihood, employ the same criteria used by the Loxahatchee
River Environmental Control District in dealing with hardship
cases wherein mandatory hook-up is required.

4) Therefore, Tequesta would defer to the Loxahatchee River
Environmental Control District for criteria for hardship when
dealing with mandatory hook-up for investor owned utilities.
It is recommended that the Village Council authorize the Village
Manager to send a letter including the above referenced in response
to the PSC correspondence of June 23, 1994.

Re: Section 381.00655, Florida Statutes
Dear Sir or Madam:
£nclosed with this letter is a copy of Section 381.00655,
Florida Statutes. The intent of this section is to require owners
of private septic systems to connect to an available publicly owned
or investor-owned sewer system. According to the statute, the
connection must occur within one year after written notification by
the owner of the public or investor-owned sewer system that the
system is available for connection. In addition, in casea where
connecting to an investor-owned utility would be an economic
hardship to the owner of the septic system,� the statute allows
local governing bodies to provide that any connection fee charged
by an investor-owned wastewater system may be paid without interest
in monthly installments over a period not to exceed five years.
As you are aware, the.,•Public Service Commission (PSC)
regulates privately-owned water a.nd wastewater utilities in 37
counties in Florida, including your county. The PSC staff has been
in contact with the Department of Health and Rehabilitative
Services (HRS) regarding the above statute since several of the
utilities we regulate are actively pursuing connections under the
provisions of Section 381.00655, Florida Statutes. According to a
letter from Sanix Poole, Chief, Onsite Sewage Program of HI2S, this
section of the statute was created during the 1993 legislative
sunset review of the HI2S statute dealing with sewage collection a.nd
treatment systems. A copy of this letter is enclosed for your
review. As indicated in the letter, HI2S has designated local
goveming bodies to review the hardship cases. According to Mr.
Poole, local governing bodies could include a city, county,
municipal or consolidated government.

The etaff of the PSC is polling county and municipal
governments in counties in which we regulate water and wastewater
utilities in order to detennine what action local governmenta will
be taking with regard to establiahing criteria for hardship
pursuant to Section 381.00655, FS. Our intent is to bring this
information to our Commission with a recommendation that utilities
under PSC jurisdiction be directed to cooperate with local
governments in enforcing this atatute and comply with their
decisions regarding hardship cases.
Since we hope to bring this matter to our Commission in the
near future, we would appreciate a response within.two weeks as to
what action your governing board plans to take with regard to this
statute. If this issue has not yet been addressed by the governing
bdard, please indicate if there is an intent to do so at some
future date.

disposal systems to ceatral seweraqe system; reqvirements.��
(1)(a) The owner of a properly fur.cticning onsite sewaqe
t�eatment and disposal svstem, excluding an approved onsite
qraywater sys�em, must connect the system or the building's
plumb ing to an avzilable publicly owned or investor-owned
szwerage system wi�hin 365 days after written notification by *he
owner of the publicly owned or investor-owned se�«erage system
that the system is available for connection. The publicly owned
or investor-owned sewerage system must notify the owner of the
onsite sewage trea`�ment and disposal system of the availability
of �he central sewerage sys�em. No less t�'�an 1 year prior to the
date �he sewerage system will become available, the publ.icly
ow or investor-owned sewerage system shall notify the affected
owner of the onsite se�aage �reatme:�t and dis�asal systeia af the
anticipated availabil��y of the se�erage syste*.n and sha1.1 alsa
notify the own�r t:�at the �w will be rec�uirad to cannect to
�he se�aerase syste� w=�.hin 1 year ai �he actual availabili�y.
The ow shall have the option of prepaying the a�ortize3 value
of raquired connec�ion charges in equal �onthl.y installments over
a pe=iod not �o exce�d 2 years from the da�e of the initial
noti�ication of anticipa�sd availability. Nothing in this.
section sha11 operate to impair contracts or other binding
obligations relating to p�yment schedules in exis�ence as of
October ?, 1993. Notiiing in this paraqraph limits the power of a
municipali�y or c�unty to enforce other laws for �he pratec:.�on .
of the public heal�h and safety.
(b) The owner o* an onsite sewage tr�atment and dispcsal
syst�n that ne�ds repair or modification �o function in a .
sanitary or to comply with the requirz�ents of ss.
381.0055a381.0067 or rules adopt2d under �hose sections must
connect to an avaiZabl� publicly owned or investor-owned s�we�
sys�e� within 90 days af�er written notifica�ion fram the
department.� In hardship cases, upon reeuast of the owiner, the
depa_rtment may approve an extension ef not more than 90 c�gs for
szwerage connection. The department �ay approve only one
extension. This paragraph does not authorize the awner of the
on�i�e sewage trea�en� and disposal sys�.�� to create or mai.ntain
a sanitary nuisance.
(2) The provisions of subszct=on (1) or any other provisica ef
law to the contr�� not;ai`hstanding:
(a) The local governing body of the jurisc?.iction in wh.i.c�tt tae
