The Tequesta Villaqe Council held a regulariy sch�ulad
meetinq at the village Hall, 3s7 Tequesta Drive, Teguesta,
Florida, on Thursdap, snly 14, 1994. The meetinq was call�
to order at 7:00 P.l�i. by Mayor Ron T. �sckaf l. 1! roll call
was taken by Joann Kariqaniello, Village Clerk. Council
members present were: Kayor Ron T. l�tackail, Blizabeth �i.
Schauer, and Earl L. Collfriqs. Joseph N. Capretta and Vice

Buiidinq Officiai Ladd explained tLat since t�e �a
property was homestead property it csauld� ��'��
foreclosed, only personal assets could be lorec�osed,
and the Walters property was not ho�estead, therefore
foreclosure could be accomplisbed. l��tayor �ackail
questioned the possibility of fnll recovary o! the
Laduca fine, since personal assets �ould prob�bly not
cover the total ammount. Villaqe I�ttorney Rsndol�t
stated that the Villaqe t�as quided c�apletely by etata
statute in Code $nforcement Hoard proceedings and it
was very difficult to obtain a re�edy in a casa where
only persoaal assets were available. Tl�e finas.had
reached the point where the asounts were not s�lly
relevant; ttie relevant aatter was whether the Villaqe
could brinq the property into cospliance. The state
has atte�pted to qive aunicipalities a re�edy by (i)
allowinq a daily fine and (2) allo�wiaq foreclosuuce; it
those did not produce the desired result tt� only
other recourse would be to try to obtain a re�dy
throuqh a Court of law for abate�ent of a nuisance or
condemnation of the property if it were in a state of
disrepair. The stance that the Qillaqe has taken
recently of abate�ent rather than _iiposiaq �fues�-hes

villaqe Kanqer Bradford explained in light o! pendinq�
litiqation on the villaqe lease with JTJC, and the
uncertainty of its outcome and tine constraints, statf
recommended the villaqe Council reject all bids for
Constitution Park and return the bid bonds to the five
bidders i�ediately. IIpon resolution of the lawsnit
and ass�minq the Sua�ary Judqement was rendered fn
Tequesta�s favor, the project could be re-bid.
l�ayor l�ackail questioned whether the, parties suinq th�a
village had any. basfs for the lawsuit, and atated
costs incurred should be paid for by the suiag
parties. Village l�ttorney Randolph stated Su�mary
� Judqemeat had been filed because it utas felt the suiaq
parties did not have a qood position. 8e Y explain�d
that if snccesst'ul, the vf liaqe conld rec�ver t2is cost
of the litigatfon, and oould thes� consider a �ealicio�s

damaqes. He explained that if the Judqe .aade the

to the ENCON Board•s letter requesting Tequesta

capaclty," so that citizens would not have to pay any
costs that were not amortized. villaqe Kanaqer
Bradford voiced concern over l�ir. Collinqs' com�ent
that the letter isplied Tequesta wouid qo a].onq wfth

that Villaqe Manaqer Bradford would reword the letter
to simplify it and make reference to the fact that
alternatives other than low pressure vill be explored.

has a franchfse agreement with SNCON, a specfal
district of the state of Florida with purview over all
� sewer issues in this reqion includinq Tequesta, it ia
hiqhly unlikely there will ever be ariy investor-owned
utilities in Tequesta. However, in order to eatablish
contfnuity, viliaqe l�tanaqer Bradford auqqested in tLe
- event that an investor-owned utility wera located in
Tequesta, that the Villaqe shonld use the saae
hardship criteria that BNCON us� and would fi� out
what that crfteria was before se�ir�q, a replp � to
ENCON.

the R-3 Zoninq study and questioned when that inventory
would be available. Village Kanaqer Bradford stated the
inventoi-y would be avaflabla� the next day after this

to make a determination whether any zoninq chanqes were
