SUB�CT: Ordiaance Levyiaq Fire-Rescue impact Fees
Pursuant to the�direction given by the Villaqe Council, please
provide to the Villaqe Attorney information sufficient to amend
Section 4 of the proposed Tequesta Ordinance implementinq fire-
rescue impact fees so that the schedule of impact fees dovetails
exactly with those fees currently in effect for the Palm Beach
County Fire-Rescue Depa=tment, based upon the primary types of
construction identified by Palm Beach County, which I believe to be -
residential, multi-family and commercial.
Please request the Villaqe Attorney to revise the Ordinance
accordingly and to transmit it - to you so that it may be in the
possession of the Village Manager's Office no Iater than Thursday,
August 25, 1994, in time for the transmittal of the agenda to the
Village Council for their meeting on August 30, 1994. .

SZJBJECT: Ordinance Levpinq Firs-Rescue impact Fees; Agenda Itmm
At the Village Council Meeting on July 14, 1994, the Villaqe
Council tabled second reading on this Ordiaance and requeeted that
it be brought back before the Villaqe Council at your Special
Village Council Meeting on July 28. Also, the Villaqe Council
requested that information be provided showinq the eutent of itapact
fees within Tequesta when this Ordinance comes before the Villaqe
Council on July 28. �
In this reqard, attached hereto, please find a memorandum
enumerating applicable impact fees within the Village of Tequesta.
Please recall that a fire-rescue impact fee was in effect for
Tequesta until October 1, 1994. This was the Palm Beach County
Fire Impact Fee and it was no longer effective on October 1,
1994. A Palm Beach County Fire-Rescue impact fee table appears
below. It is recommended that, at a minimum, the Village Council
implement the same fire-rescue uapact fee as is in effect for
recipients of Palm Beach County Fire-Rescue service.

WHEREAS, the Villaqe of Tequesta desires to formulate impact
fees for fire rescue services; and ,
WHEREAS, the Villaqe of Tequesta must expand its fire rescue
facilit�es to maintain current levels of service if new development
is to be accommodated without decreasinq current levels of service;
and
WHEREAS, while not all new residents may call for fire rescue
services, the Village will have to provide additional facilities so
as to be in a position to serve each new dwellinq; and
WHEREAS, there is a reasonable connection bet�eea the ne� for
additional fire rescue services and the growth in popnlation that
will accompany the new development; and
WHEREAS, fire rescue servfce impact�fees shall not be used to
replace existinq cap�tal facilitieas or to fund existinq
deficiencies, but only to expand or provide new capital facilities
and equipment which are necessitated by new development; and
WHEREAS, impact fees on residential construction are best
imposed on a unit basis while those on non-residential construction
are best imposed on a square footaqe basis; and

For the purpose of requlatinq the use and development ot land
in the Villaqe of Tequesta so as to assure that new development
bears a proportionate shar� of the costs of fire reacus aervicea
and to help defray the costs o! new or expanded fire rescus service
facilities and equipment attributable to new cor�struction within _
the Villaqe limits, impact feee are her�by levied on �
construction t�ithin the Villaqe limits in accordance with the
schedule of impact fees and other provisions of this chapte,r.
seotioa 2. Applicabilitp.
This article shall apply to all new construction and expanaion
of commercial construction within the Villaqe limits except the
followinq: .
A. Expansion of a residential dwellinq unit;
, B. Remodelinq or rebuildinq of any structure without
expansion;
C. Construction under any buildinq permit oriqinally issaed
durinq the y�ar precedinq the effective date of this
� artfcle.

Fire rescue service impact f�es ehall be determined and
reviewed at least every other year in accordance; with a detailed
analysis of projected construction within ths villags linits, ths
cost of any expanded or new fire rescus servics laailities
qenerated by su,ch construction and the money otberwiss availabls to
mee�t such costs. The purpo�e of this review is to evaluate the

level ot service for sach impact !ea component to detor�ina whathar
� it ehould be adjusted based on chanqed conditions, to analyzo th�
etfects of inllation or other cost lactors on tho aotual coats o!
providinq liro rascua sarvices and to ensur� that ths impact !��
charqed new land us� activity vill not axoeed ita pro rata shsr�
!or the roasoriably anticipated cost4 0! lir� r�aau� oarvicos
necessitated by the new land development. Th� villaqo Council may
annually adjust the astablished impact !es ratea to rollact chanqea

residential purposes, the impact fee shall be the total of:

Fire Rescue Service impact fees sball be paid in cash unless
the villaqe Councii specifically accepts an in-kfnd contributioa of
land or capital facilities for a public use. Credit for an i�kind
contribution shall be on a Pafr market value basis as o! the dat�
the Villaqe Council accepts the offer ot such contribut3,on. The
fair market value of any Iand accepted as an in-kind contribution
shall be based upon an appraisal of its highest and beat use then
allowed under its current land use desiqnation.

title of the fund and for no other purpose. Expendituras lrom the
trust fund shall be specifically approved by the Villaqa Council
and shall be limited to tha e,xpaneion or ac:quisition ot capital
facilitiee or equipment made necessary by the new construation lroaa
�rhich the fees wera collected or Por principal payments on bonds
and loans to expaad or acquire such faciliti� or equipment.
Before authorizinq an expenditure from the trust fund, the Villaqe
Council shall determine that:
. 1. Such expenditure from the trust fund is for
capital facilities or equipment to be used for
the purpose of fire rescue servicea;
2. Such expenditure fro� the trust fund is made
' necessary by the new construction from which
such funds were collected; and
3. Such e�enditure from the tnzst fund will
result in a benefit to the new construction
from which the funds vere collected. �
D. Non-lapsinq: The trust fund shall be non-lapsinq.
Sectioa 7. Capital espanaion plan.
The Villaqe Council shall prepare and saintain a capital
expansion plaa for the fire rescue servics�impact fee trust tuad.
These plans shall be reviewed at least annuallp during tbs budget
revie� process. -

For any land usea not requirinq a buildinq permit, th� impaat
!ee shall be paid prior to receipt o! a devslopment ord�c that
initiates an impact on lire re�cue aervices.
Any exieting land ues that is expanded, replaced or chanqad
shall be raquired to pay lire rescua service impact lo�s basod on
the new or additional impact rasultinq lrom tho oxpansion,
replacement or chanqe o! use.
in the�event impact tees paid by cheok, dratt or otLor
neqotiable instrument do not clear, the buildinq permit or
development order suthorizinq the development for which the impact
fees were paid shall be euspended The aqency issuinq the lwildinq
permit or development order ehall send notice to the appliaant by
certified mail. If the impact fees, together with say charg� !or
the check not clearinq, are not paid within ten �10� workinq dayr�
followinq mailinq o! the notice, the building permit or d�vslopa�ent
order shall b� of no further force and effect and a stop work order
shall be iasued and not lifted until such time as the impact tees
are paid.
If impact fees are not paid in full, th� amount unpaid,
toqether with statutory interest accruirrq thirty (30j calendar clays
followinq the date of written notics by certified mail is sent to
the fee payor, sball be a lien aqainst the land containinq the
development for which the impact fees are due. Notice of the lien
shall be filed in the official records of the Clerk of the Circnit
Court in and for Palm Beach County. The lien shall have priority
over all liens, mortqaqes and encumbrancea, except ta�te�. If the
lien remains unpaid for more than thirty (30) calendar days
followinq the recordinq of the notice, it may be for�closed in the
manner provided by state law for the foreclosure of mortqaqes on
real property."
Section 2. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of
this ordinance which can be qiven effect without the invalid
provisions or applications, and to this end, the provisione of this
Ordinance are hereby declared severabl�.
�ecti.on 3. Repeal of Ordinances in Conflict. ]►11 other�
� ordinances of the Villaqe of Tequesta, Florida, or parts therao!
�hich conflict with thia or any part of this Ordinance are hereby
repealed.
Section 4. Codification. This Ordinancs shall bs codi�iad
and made a part of the off3cial Code of Ordinances o! the Vfllaqe
of Tequesta.

capital aseeta in the amount of $1,136,91Z.25.

4. The Villaqe now has 1,082,262 equare feet of commercial
construction.
5. The present ratio betr�een �inqle family residential

7. The Villaqe Council is aware of and has reviewed the
Villaqe of Tequesta Fire Rescue Services� present capital
investment for sinqle family residential units, �ulti-family
residential units and commercial construction, set forth above. To
insure that the fire rescue impact fee imposed does not exceed the
cost to provide fire rescue service to new developmerit and to
encourage new developnent, the Villaqe Council has dec eased the
fire rescue impact fee to be impose:d per each as se forth in
Article I, section 4.
