Please request the Villaqe Attorney to revise the Ordinance accordingly and to transmit it - to you so that it may be in the possession of the Village Manager's Office no Iater than Thursday, August 25, 1994, in time for the transmittal of the agenda to the Village Council for their meeting on August 30, 1994. . Hradford, Villaqe Manaqer ��r�, / DATE: July 22, 1994 SZJBJECT: Ordinance Levpinq Firs-Rescue impact Fees; Agenda Itmm At the Village Council Meeting on July 14, 1994, the Villaqe Council tabled second reading on this Ordiaance and requeeted that it be brought back before the Villaqe Council at your Special Village Council Meeting on July 28. Also, the Villaqe Council requested that information be provided showinq the eutent of itapact fees within Tequesta when this Ordinance comes before the Villaqe Council on July 28. � In this reqard, attached hereto, please find a memorandum enumerating applicable impact fees within the Village of Tequesta. Please recall that a fire-rescue impact fee was in effect for Tequesta until October 1, 1994. This was the Palm Beach County Fire Impact Fee and it was no longer effective on October 1, 1994. A Palm Beach County Fire-Rescue impact fee table appears below. It is recommended that, at a minimum, the Village Council implement the same fire-rescue uapact fee as is in effect for recipients of Palm Beach County Fire-Rescue service. For the purpose of requlatinq the use and development ot land in the Villaqe of Tequesta so as to assure that new development bears a proportionate shar� of the costs of fire reacus aervicea and to help defray the costs o! new or expanded fire rescus service facilities and equipment attributable to new cor�struction within _ the Villaqe limits, impact feee are her�by levied on � construction t�ithin the Villaqe limits in accordance with the schedule of impact fees and other provisions of this chapte,r. seotioa 2. Applicabilitp. This article shall apply to all new construction and expanaion of commercial construction within the Villaqe limits except the followinq: . A. Expansion of a residential dwellinq unit; , B. Remodelinq or rebuildinq of any structure without expansion; C. Construction under any buildinq permit oriqinally issaed durinq the y�ar precedinq the effective date of this � artfcle. seatioa 3. Determination of tae a�onnts. Fire rescue service impact f�es ehall be determined and reviewed at least every other year in accordance; with a detailed analysis of projected construction within ths villags linits, ths cost of any expanded or new fire rescus servics laailities qenerated by su,ch construction and the money otberwiss availabls to mee�t such costs. The net fire rescue impact fee for a residential unit, added to 2. The total square footaqe of commercial space times tha net fire rescue impact fee for each square foot. Sectioa 5. Paysnent ot fees. Fire Rescue Service impact fees sball be paid in cash unless the villaqe Councii specifically accepts an in-kfnd contributioa of land or capital facilities for a public use. Credit for an i�kind contribution shall be on a Pafr market value basis as o! the dat� the Villaqe Council accepts the offer ot such contribut3,on. The fair market value of any Iand accepted as an in-kind contribution shall be based upon an appraisal of its highest and beat use then allowed under its current land use desiqnation. 3 ssotion 6. Expendituras lrom the trust fund shall be specifically approved by the Villaqa Council and shall be limited to tha e,xpaneion or ac:quisition ot capital facilitiee or equipment made necessary by the new construation lroaa �rhich the fees wera collected or Por principal payments on bonds and loans to expaad or acquire such faciliti� or equipment. Before authorizinq an expenditure from the trust fund, the Villaqe Council shall determine that: . 1. Such expenditure from the trust fund is for capital facilities or equipment to be used for the purpose of fire rescue servicea; 2.
