SUBJECT: Thru—Truck Permit Ordinance Amendment
Pursuant to the direction of the Public Safety Committee at their
meeting on ,7uly 27, 1994, please request the Village Attorney to
prepare an o=dinance amending the applicable portion of the Code so
as to reduce the geographic area in Tequesta that counts towards
"concurrent delivery of goods or services to destination points".

SIIBIECT : Thru Truck Ordinance ( ques t i on ).
On page 690 of the ordinance book (see attached), section (3)
states that "..delivering qoods or services to destination points
within the Village of Tequesta..." [and] shall not be subject to
the provisions of subsection (b)(2) above.
Question! Could this be construed that a vehicle making a delivery
anywhere, i.e. Village Square Shopping Center on U.S. l, would not
be subject to the ordinance and therefor, cauld use Tequesta Drive
and Country Club Drive for delivery to Turtle Creek or even into
Martin County.
If that is correct, it may behoove us to change the wordinq where
the deliveries are made to properties adjacent to the restricted
roadways of the ordinance, instead of the "Village of Tequesta".

�> (3) 'h-ucks engaged in deli�•erin�; goods or services to de�tina-
tion points within the �'illage.of Tequesta may be permit-
ted to make concurrent deliveries of goods or sei•vices to
destination points outside the corporate limits of the vil-
lage which deliveries are part of the same trip. Such trticks
engaged in making concurrent deliveries to the area known
as Turtle Creek shall not be subject to the provisions of
subsection (bX2) above.
(4) The permit shall be valid only between t�e hours of 7:00
a.m. and 6:00 p.m. on �ti•eekdays and between the hours of
8:00 a.m. to 12:00 noon on Saturdays and Sundays.
(5) That residential permits may be issued in accordance with
the terms set forth herein to owners of vehicles in excess of
the maximum weight prescribed by this article, where said
owner is a resident at thP destination point requiring the
use of restricted streets and where said vehicle is main-
tained at said residence and is for the personal transporta-
� tion of said owner or his family for use to and from his
residence. Said permits shall not be bound by the time
limitations set forth in subsection (4) above.
(6) Permits may be issued on a daily, weekly, monthly or
� annual basis subject to the fee schedule set forth below.
The village manager shall have the authority to determine
the length of the permit, based upon the in#'ormation pro-
vided by the applicant. �

(7) Special cvnditions for the operation of vehicles under any
permit issued hereunder, aimed at providing for the public
safety and welfare of the residents of the Village of Tequesta
and the users of the restricted streets, may be provided by �
the village manager and the applicant shall operate under
the permit in accordance with the terms of said special
conditions.

SIIBJECT- No Thru Truck Ordinance, Revised..
Mr Randolph has responded to our question on delivery points within
the village that would allow a truck to make a deliverp on US 1 and
travel west to Turtle Creek via Tequesta Drive and Countrp Club
Drive which was not the intent of the ordinance. My suqgestion was
to change the wording where concurrent deliveries would onlp be
allawed within the confines of the streets effected by the
ordinance.
Attached is a revision that I feel will handle the discrepancy.
Please review it and let me know if it is satisfactorp with pou.

AN ORDINANCE OF THE VILI�AGE COUNCIL OF TIiE
VILI�AGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING THE CODE OF ORDINANCES AT
CHAPTER 11.5, ARTICLE II, RELATING TO
OPERATION OF HEAVY TRUCKS, AT SECTION 11.5-
13.1(b)(3j SO AS TO SPECIFICALLY PROVIDE THAT
TRUCKS ENGAGED IN DELIVERING GOODS OR SERVICES
TO DESTINATION POINTS WITHIN TH8 VILI�IGB OF
TEQUESTA WHICH ARE ACCESSIBLE ONLY HY USING A
STREET OR STREETS RESTRICTED TO TROCR TRAFFIC
BY THIS ORDINANCE, MAY 8$ PERMITTED TO MAR]3
CONCURRENT DELIVERIES OF GOODS OR SERVICES TO
DESTINATION POINTS OUTSIDE THT CORPORATE
LIMITS OF THE VILLAGE IN THE EVENT SAID
DELIVERIES ARE PART OF THE SAME TRIP;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL OF ORDINANCES IN CONFLICT; PROVIDING
FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VIL7�iGL OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
�ection 1. Chapter 11.5, of the Code of Ordinances of the
Village of Tequesta, is hereby amended at Article II, relatinq to
operation of heavy trucks, Section .11.5-13.i�b)(3� to read as �
follows:

Section 2. Severability. If any provision of this
Ordinance or the application thereof is held invalid, such
invalidity shall not affect the other provisions or applications of
this Ordinance which can be qiven effect without the invalid
provisions or applications, and to this end, the provisions of this
Ordinance are hereby declared severable.
�ection 3. Repeal of Ordinances in Conflict. All other
ordinances of the Village of Tequesta, Florida, or parts thereof
which conflict with this or any part of this Ordinance are hereby
repealed.

Section 4. Codification. This Ordinance shall be codified
and made a part of the official Code of Ordinances of the Villaqe
of Tequesta.
�ation 5. Effective Date. This Ordinance shall take
effect immediately upon its passaqe and approval, aa provided by
law.
