In light of Mayor Mackail's report concerninq the Auqust ENCON
8oard Meetinq, I believe we are forced to conclude the followiaq:
1� ENCON actions are such that they may seek Tequesta to
participate in fundinq of this Study.
2) ENCON intends for there to be no meaninqful role for our
citizens from those neighborhoods affected by the proposed �
Septic Tank Study. To date, ENCON has selected the consultinq
engineer to.undertake the work effort. Additionally, without
any indication to the Villaqe as to its make-up, ENCON has
created a Technical Advisory Comm�ittee via its consultinq
engineers to direct the work of the chosen consulti.nq firm.
It is feared that the members of the Technical Advisory
Committee may have predetermined opinions on this issue.
Finally, ENCON has made no formal indication as to its
methodology, outline or approach to this Septic Tank Study.
3) ENCON is not willinq to co�mai,t to the gravity sever system ia
the event that pollution enoonntered i.n the River is
attri.buted to Tequesta septic tanks and cannot be corrected.
This flies in the face of the ENCON Govern.inq Board previous
coAnnitments relative to provision of qravity sewers withia the
Tequesta area. I recall certain Board Members statinq that
gravity sewer syatems �uld be the 'seweraqe eystentof first-
choice" for the Tequesta area ia the event that ENCON were to
choose to move forward with installation of centralized sewer
systems. -

Sased upon the foreqoinq, it is my recommendation that we write a
letter to ENCON indicatinq the followinq:
i) in liqht of the foreqofnq, Tequesta is.unable to �ndorse or
participate in your Tequesta Septic Tank 3tudy aad,
accordingly, does not recognize the same.
2) By viztue of ENCON's failure to accept the conditions put
forth by the Villaqe of Tequesta, any recommendations of such
Septic Tank Study shall be of no value to the Villaqe of
Tequesta and its findinqs and recommendations relative to
centralized seweraqe systems shall be ignored since nothinq
causes us to adhere to its findinqs. -
3) In the event that the ENCON Septic Tank Study recommends a
centralized seweraqe system found to be unacceptable to the
people of Tequesta it will be fought aggressively at each and
every step in the process should ENCON choose to pursue the
same.
4) Suggest the Mayor and Board Chairman of ENCON meet one on oae
in a last attempt to reverse this course.
Copies of Mayor Mackail's correspondence td ENCON aad their
responses to the same are attached for your review in your efforts
to prepare an adequate response to the actions of ENCON.

however, accept the pre-conditions you state. In order to preserve
the independent nature of the process, we ourselves are mafntaininq
an arms lenqth posture leaving the technical aspects of the p=ogzaa
up to independent experts.
I think it is appropriate for our staffs to fdentily and
coordinate your committee•s involvement in overseeing the effort.

Dear Mr. Thompson: '
This is in response to your letter of May 31, 1994, and the follow-
up correspondence of June 17, 1994, requestinq the Villaqe of
Tequesta to participate in the establishment of a specificatioa for
a study initiated by ENCON to study the impact of septic tanks on
the Loxahatchee River Basin. We are eacouraqed bp your Soard•s
decision to apparently withdraw your permit application for a low-
pressure sewer system within any portion of Tequesta. Accordingly,
our response to your request has been amended as appears below.
At the request of your Euecutive Director made at a meeting wi.th
our Villaqe Manaqer on April 14, 1994, the Villaqe Man�qer sought
village Council direction reqardinq Tequesta participation in a
proposed ENCON Septic Tank Stndy at the Villaqe Council Meeting on
April 14, 1994. The Villaqe Council responded that their wish was
for Tequesta to be iavolved in the ENCON Septic Tank Studp by
solicitinq the direct involvement af citizens from each area
potentially impacted by the installation of a sewer system. A copp �
of the Village Ma.naqer•s correspondence of April 19, 1994, advisinq
your Sxecutive Director of the Village Council�s preferences in
this reqard, ie attached for ponr�review.
Subsequent to our April 14th Villaqe Council I+ieetfng, Village ataff
has identified rep=esentatives fr� each potentiallp impacted
neighborhood that wf sh to be involved f n ENCOI�i • s Septic Tank Study.
Since� ExCON has authorized the enqaqemeat of an engineerinq firs to
prepare a specificatian for the study and im prepared to campeasate
�$63, 000 ) the enqineerinq fir� to nndertal� such efforts, Tequesta
sponsorship of the studp appeare to entail aa en�orse9nent of and
participation in the same.

we believe that if the tollowinq conditions are �et, Tequesta �ould
endorse and that the septic tank �tudy could bs conaidered,
'Tequesta sponeored":
1) ENCON funds 100= of the epecilication for the study and 100t
of the atudy itselt.
2) Tbe citizens volunteering lrom the eftected neiqhborhoods are
quaranteed an active and meaninqful role �n th� �ntirs studp
process, in addition to the preparation of th� specificatioo
for the study.
3) In the event that the study demonstzates coaelusively that a
substantial neqative impact to the Loxahatchee River is
directly caused by septic tanka located solely vithin
Tequesta, and such problems cannot be corrected, thea, in
keeping with ENCON�s previous public commitments in this
reqard, a more traditional and acceptable alternative to the
low-pressure sewer system, installed and funded by ENCON,
shall be the aqreed upon alternative for mitigation if a
centralized sewer system is reconunended to address substantial
neqative impacts attributed solely to septic tanks located
within Tequesta, and problems from which cannot be corrected.
Lastly, please be advised that Tequesta's Comprehensive Development
Plan does not call for a septic tank study under the conditioas you
have referenced. Tequesta, however, is rillinq to sponsor �TCON•s
funded study under the coaditions refereaced in the name of qood
intergovernmental coordination which is an important element of
Tequesta•s Comprehensive Development Plan.
We look forward to workinq towazd a cooperative arranqement to
study the prob2ems of the Loxahatchee River alleqed by ENCON and to
rectify anp significant neqative findinqs ia an acceptable manner
as referenced.herein. We would appreciate receivinq any and all
documentation in the possession of ENCON reqardinq your alleqation
that the Loxahatchee River does aot meet state standards.

In response to your request at our meeting on Thursday, April 14,
1994, wherein you requested a formnl response regardinq Tequesta
participation in the proposed ENCON Septic Tank Study of the
Tequesta area, I brouqht the same up before the Villaqe Council at
their �eeting on April 14, 1994.
The Village Council response is that they vish for Tequesta to be
involved in the septic Tank Study nominatinq a �itize;t- �r�a eac.h-- -- -
area po �enti�lly impacted by tbe low-pressure sewer system proposal
to be iavolved in some fashion to oversee�the Study in conjunction
with E�CON. Whether this would be by formation of a citizens
committee or use of a more ibformal process is opea for discussion.
I understand that pou would prefer for the neiqhborhood
representatives under this concept to have an engineerinq
background in order to facilitate understandinq of the indepeadent
study process. It is also my understandinq tbat the permit you are
seekinq for the installation of a low�ressure sewer systea
involves all neighborhoods upon tbe •Tequesta peninsula' and tbose
areas within the corporate ifmits of Tequesta, such as alo�

a septic tank-water quality study in Jupiter and ros are on tracic to
initiate a study for the Tequesta peninsula rithin tha next !ew
months. l�lso, as you are aware, the permit application !or Lo�t
Pressure Sewers in Tequesta has been withdrawn and we look tosvard
to Tequesta�s participation in the study effort. I understand you
are awaitfnq closure on the issue from the attorneys in Tallattassee

In my letter of June 17, I asked that our staff provide you
with information that the Loxahatchee River does not meet stata
standards. In gatherinq this�intormation it beca�e tbat
much of it is in Tequesta•s hand alrea�dy and I aa forwardinq it t�o

directly informed. please be advised that water Quality standarda
established by t.he State of Florida have been violated fn the
waters o€ the Loxahatchee River ( includinq the north anci northwest
forks which bracket the Tequesta peninsula) for over 20 years.

use of septic tanks within the urban portions o� the
watershed poses an additional potential threat to the areas
waters and recommends that this issue be prudently addressad
concurrent �ith the etorm water proqraa.
By way of specific example and based on data collected over
the past 33 months, the waters surrounding the Tequesta peninsula
have sho�m Dissolved Oxyqen levels belot� state atandards 29� o! tbe
time and Fecal Colifor� Bacteria stand�rds of the State have been
violated 51t of the time. The data also reflect exceedences in
nutrients, clarity parameters and the values for organic wastes.

ProQrams which will improve water quality and preserve the

In August of 1991, the subject co�amittee was fo�med with
rep�esentatives of seve�al local governme�ts and put to work ass�stinQ
the Boa�d of the Loxahatchee River District in evaluating th•
sto�mwater management options availabie to our watershed. A year ago,
that committee recommended that the Dist�ict develop additional
technical information and get a better understanding of public
perception before proceeding with this pollution prevention prograa�.
The participation of you� gove�nment in that process was both valued
and app�eciated.
° Ove� the past year, the District Boa�d, staff, and consultants have
learned much from two new committees - a technical advisory coomittee
and a citizens adviso�y committee. The reports of tfiese committess
were finalized and submitted to the Board quite recently and copies of
their meeting minutes and �eco�nmendations a�e enclosed fo� your rsvie`+.
It is now time to reactivate the Governmental Advisory Coaaaittee and
we hope you will continue to participate. Wa will convene a veetin�
of the Government Advisory Committee on:

2- The Technical Advisory Comnit��e finds that a substaatial
amount of useable wat�r quality data has beea collected cver the
past 19 years aa,d this inf ozaiatioa recently beea consolidated
into a manageable fozmat.
Five agencies, the �'lorida DEA, the Federal �JSGS,
the Regional Water Ma.naqe�nent District, the Couaty
Environmental Resource Agency aa+d the local Loxa�hatchee
River District, have each cQlleeted water quality data aa
the river spstem. within the past eighteea months, the
ind;vidual iafo=matioa fram each of these sources ha�
been combined. DER and USGS data a+ere consolidated
and reviewed uader studies conducted by I�av
Eavirorunental for the Jupit�r Inl�t Disttict. T�e
County and LBECa data was cambiaed and published by ths'
�.oaahatchee 8iver Distriet throngh its coasnitaats 8azen
and Sawyer. Over the last 6 moaths each o! these data
souress was plac�d ia the 'STOBET' water quality -
database syst� and made available for evaluatioa.

At the prior meetinq of the conaaittee it was requested that
staff attempt to determine, more specifically, what areaa of tb�
river exhibited the worst qualitative conditians, lendinq to
violations of standards.
Mr. Dent provided zespoase to this request, reviewinq the
"se�nents" of the river, aad data provided by STOaEP to date. �
Aa information packaqe was provided to the ccamnittee members
wh�.ch included a map of the sampliag locations fa the zives .
basin, with a description of the location and the parameters
moaitored, a.nd also facluded var;ous tables develaped to isolate
specific pollution sources.
Analysis was conducted first, by co�apazison cf the Sistoric
Water Quality Meaas #or each o� the 5 river segmeats, and for
niae parameters. .
The aeat analysis identified the 3•worst' qualitY stationa af
the nine most sampied locati�s on the river. Statioos �69 �11uT
� Fork at SR 706 ) and #55 t� Fork at Caunty Line 8d) �rere '
identified as beinq ia the worst cateqory !`or 4 of t2�s 6
parameters monitored. Statia� #71 (Jones Cteelc at Ceater
Street) was iadicated ia the �orat 3 for 3 para�tess aad �
stations �81 (Freshwater C-18) _aad #62 (l�iU1 Fo=]t at Islandway) '-
were identified as beinq ia t.he •worst' cateqosy �or 2
parameters. Clearly all of the •worst• static�s vere located ia
the freshwatar reaches ot the ziver and its psi�oary t�ribtttaries.
.A��:�'_onal�y, Mr. Dent reviewed the mean water qual:ty from aa�h
a- of t�e stations alonq :he wild i Scenic seqment of the r:ver,
:zom t:�e Es:uary to Jupiter Farms, tor nine parameters to
determine if there ue any t:ends in quality lrom one area ta
' the �thez.
Each of 23 stations, in 5 river se�ae�ats, was looked at !or tb�
1992 period, to determiae tha perceat ot times each :tation
was in violatioa o� the Si�toric Meaa, !or that seqment o! tbe
river. Riverwide, parametezs are violated_an averaqe o! 32�
ot the time.
The freguency of violationa ranqe lra� 2?� ia th� Ciaas =ZI
Marine Segment of the river to 39� ia tha Class ItZ Westera
Tributariea. Occurreace og violations appear mors lr�queatlY i�►
the freshwatez portioas of the river.
when seasonal variations were taken into consideratioa, .
violations were most frequent durinq the July-7�uquat period
i36�) and only slightly less frequeat in Oct-November t31�),
nearly twice as frequent as samples during the January to 1Kay
period.
Review of water quality samples was also provided by Mr. Dent
which iadicated the percentage of violatioas ia 1992 by
parameter, within the 5 segmentS of the river.
Discussion was held by the connaittee about Mr. Dent's report and
it's findiags. It was concluded tbat althouqh there was no
"smokinq qun" to point to a specific culprit ia creatinq th�
violations, the violations were siqnificant eaouqh to warraat -
efforts to correct conditions. The river is clearly not meetiaq
the standards which the caa�unity encovraqed, aad the State
adapted, to afford the highest levels of protectioa.
Members of the co�aittee sugqested that additianal data be
developed and reviewed in reqard to seasonal variations, to
further substantiate the effect of stormwate=. It `�as also
.suqqested that shorter term "means" be looked at for
establishment of the "Staadards"-

While stormwater was rec�gnized as o� of the major threats to
�he r3ver, the Conuaittee eapressed qreat concera �ith the
remain=nq septic taaks alonq the banks of the ziver.
Mr. Dent reviewed past seweriaq programs with the Coaomittee
�nd what was currently proposed. Mr. Kahr� questioned what
incentives could be provided to the affected resideats, to which
Mr. Dent explained the several iaceatives currently available
through the District and our ef�orts to enlist fu.•ther liaancial
assista.ace.
The Coimnittee determined that they v�o�nld aeed �t least one mmore
meet+nq before the arorksl�op mee'tinQ vith tl�e GoverniaQ 8oar�.
- Mr. wodr�slca summarized what he felt were the recaa�aaeadati�s
of the Ca�a�nittee and offered to prepare a draft report �of t�
Cosmaittee. The draft wovld be distributed to members prior to
