Subject: R-3 ZONING DISTRICT STUDY (BEACH ROAD)
Tam, attached is a spreadsheet that indicates the existing
site conditions at each of our multi-fami.ly Condominiums located
along Beach Road oa Jupiter Island. Also attached are copies of a
map of the area indicating our buildinqs with their addresses and
a map indicating the Palm Beach County unincorporated buildings
with their addresses. Additional support documentation includes our
current R-3 Zoning District Schedule of Site Requirements, Schedule
of District and IIse Regulations, the R-3 Zoning District
Requirements in eff ect when our Beach Road buildings were permitted
and the Palm Beach County Unified Land Development Code Zoning
District Regulations currentlp ia eff ect in the unincorporated
portion af Beach Road.
As you can see by comparinq the various Zoning District
Requirements, our current code is much more restrictive than the
code that was in effect when the buildings were built in the
Tequesta portion of Beach Road. With the exception of "Cliveden"
which was just approved by the village, all of the twelve existiag
condominium projects on Beach Road are noa-confcrming to our
current code. A Comparative Analysis is attached to this
memorandum that compares the various site requirements of our
current code, the code in effect when our condos were built and the
Palm Beach Countp current code.

Section 11.2
Special Exc_ eption Uses: When, after review of the application and public
hearing thereon, the Village Council flnds as a fact that the proposed use or uses
are in the public interest, after considering the standards set forth in Article
XVI, Section 16.7 of this Ordinance the foilowing uses may be permitted:
1. Planned Development: The site plan must be approved by the

Village Council pursuant to Article XII of this Ordinance.
2. Churches, schools, and publiciy owned and operated community
� , buildings.
' 3. Public utility structures and buildings such as sewage disposa�
works, water pumping plants, electric substations, police and fire
stations .
4. Landscaped park areas and neighborhood recreation facilities
including golf courses. .
Section 11.3
Bui_Idinc� Height Regulations:
1. For one and two family dwellings the height shali not exceed
two stories.
2. For more than two family dwellings the height sf�all not exceed
six i6) stories nor sixty-five (65) feet. •
Sectian 11.4
Buildin Site Area Regulations: Every dwelling structure erecteal or .
structu�ally altered shalt have a site area per family of not less than the following:
1. For single family dwellings, the minimum loi or building site area
shall be eight thousand (B, 000) square feet. The minimum width af lot
measu�ed at the building line shall be seventy-five (75) feet.

2. For two family dwellings, the minimum site area shall be ten
thousand (10,000) square feet and have a minimum lot width of eighty (80)
feet.
3. For two (2) story multiple family st�ucLures there shail be a lot
of at least ten thousand (10,000) square ieet for the �rst two dwelling
units plus three thousand (3,000) square feet of lot area for each additional
unit.
4. For struciures that exceed two (2) siores there shall be added to
' the minimum of ten thousand (10, 000) square feet, two thousand (2, 000�
square feet of site area for each additional dweliing unit.
Section 11. S �
Buiiding Regulations: For muitiple family dwetlings exceeding two (2) stories
with flat roofs.air conditioning compressor units shali be located on the roof of the
main building.

Buiidtng Area Requirements:
1. A single family dwelling shall contain rtot less than 1,400 square
feet of living area computed from the outside finished dimensions. Screenes3
porches, garages, carports, breezeways, and other such non-living areas
may be counted at the rate of fifty (50) percent of actual area up to but not
to exceed 3d0 square feet.
2. In multipie family struciures one bedroom units shall have a minimum I
floor area of 900 square feet; an addltional one hundred fifty (150) square
feet of f(oor area shali be provided for each additional bedraom.
3. Lot coverage shall not exceed thirty (30) percent.
Section 11.7
O en S ace Requirements: A minimum open space, landscaped and kept
"green• of thirty (30) percent shall be provided. The term °green" shail not be
construed as prohibitinq the use of creative landscape involving gravel, tile,
etc. , instead of grass, as long as a g�een landscape appearance is achieved.

Thirty-three and one-third (33-1/3) percent of the thirty (30) percent •
desc�ibed above may be devoted to recreatlonal uses, such as swimming
pools, tennis courts, walkways, pattos, etc.
Seciion 11.8 ,
Ya�d Requirements:

1. Front Yard.
a) For structures not exceeding thirty (30) feet i� height there
shall be a front yard of not less tha� twenry-five (25) feet
measured from the street line to the front wall buflding li�e.
b) For multiple family and other strucutures exceeding thirty (30)
, feet in height there shall be a front yard of not less than forty (40)
' feet measured from the street line to the front wall building line.
c) No bulldings, nor other structures of any type (inciuding
swimming poois) other than a carport or garage shall be located
in a front yard,-nor shall any conveyance other than a passenger
autorrtabile be parked tn that area; except tt�t, as a temporary
convenience, a trailer, boat, or recreattonal vehicle may be parked
in a front yard during, and for not longer tha�, one twenty-four
hour period within any thirty (30) consecutive days.
2. Side Yard
a) For all structures not exceeding thirty (;0) feet In height there
shall be a side yard of not less than twenty (20) feet measured from
the side lot line to the side wall building line.
b) For structures exceeding thirty (30) feet in height, two (2) feet
additional side yard on each side af the structure shall be added for
each additiona! ten (10) feet or fraction thereof, above the base
height of thirty (30) feet. �
3. Rear Yard
a) For all structu�es not exceeding thirty (30) feet in height there
shall be a rear yard of not less than twenty t201 feet measured from

b) For structures exceeding thirty (30) feet in height there shall be '

4. Corner Lots. In the case of corner lots, no building or portion thereof and
no acccsso�y bulldings shall be erected o� placed nearer than twenty
(20) feet to the side street line of any such lot measured frorn the
street line to the side wall building line.

PLANNED DEVELOPMENT
� Section 12. i
. General Description: This distrlct is intended to provide optionai methods
of larid development whtch encourage more imaginative solutions to environmentai
design of problems. Residential areas thus established woutd be characterized
by a unified building and site development program and open space fo� recreational
facilities whlch are integrated with the total project by unifying architectural and
open space treatment. Planned development is intended to permit diversification
ln the location of structures and improve circulation facilities and other site quali-
ties while insuring adequate standards relating to public health, safety and welfare
and morals, both in the use and occupancy of buildings and facilities and planned
groups.
Section 12.2 �
A roval: Planned Development, as a special euception use, shall be
subject to the approval of the Village Councif after a review and report by the
Community Appearance 8oard and after a publlc hearing is held by the Village
Council In accordance with Article XVI, Section 16.7 of this Ordinance.
The review by the Community Appearance Board shall be to make �ndings pur-
suani to this Article and other appllcable sections of this Ordi�ance and to make
. recommendations thereon.
