Bradford, Village Manager f �?��� DATE: July 21, 1994 SUBJECT: Professional Services Proposal; Dover Ditch Improvement project In the Spring of this year, the Finance & Administration Committee, in reviewing the Dover Ditch Improvement Project for consideration with the 1994 Bond Issue, concluded that too many matters were unresolved that could impact this Project and recommended that additional time pass before the Village commits itself to the full- cost of the anticipated improvement (enclosed culverts). The Committee also recognized that additional time would be needed to receive a permit for mangrove mitigation, which requires clearing many regulatory hurdles, not to mention finding a site to piant new mangroves, if needed. Therefore, the Committee recommended that, in the interim, the Village pursue with Gee & Jenson the necessary mangrove mitigation permit for this Project, and upon receipt of • the same, revisit the Project to finalize construction funding matters. � Attached hereto, please find a Professional Services Proposal with Gee & Jenson in the amount of $27,900 for South Florida Water Management District conceptual approval of the design contemplated to address this drainage problem and the dredge/fill permit necessary for this Project. The Proposal is in an amount approximating what we estimated it to be for this work. It is recommended that the Village Council approve the Proposal and authorize the Village Manager to execute the same. MANAGER`S Re: Dover Ditch Improvement Project '' OF���E Professional Services Proposal '���" . .�;' � Gentiemen: We are pleased to submit the following proposal for permitting, engineering and construction phase services for the Dover Ditch Improvement Project within the Village of Tequesta. Gee 8� Jenson Engineers-Architects-Planners, Inc., hereinafter referred to as the Consultant, proposes to fumish professional services for the Vllage of Tequesta, hereinafter refeRed to as the Client, for the scope outlined below, for the fees stipulated herein. These services will be performed in accordance with Section 2(Professional Services) of our Mnual Agreement befinreen the Vllage of Tequesta and Gee 8� Jenson, dated October 31, 1989. Scope of Services The Consultant will perform the following tasks: Task 1: SFWMD Coordination 1.1 Perform a survey of the existing drainage system elevations and pipe sizes within the Dover Ditch drainage area, including the Dover Road and Beacon Street systems, to assess cuRent system conditions. Survey will also include structural geometrics of cufverts at Riverside Drive and Seabrook Road. 1.2 Plot #he data identified in Subtask 1.1 on site plan and cross-sectional plots. . � 1.3 Revise and upgrade the previously developed HEC-2 (Backwater Profile P�ogram) computation wi#h new survey data from the upper reaches of the drainage basin_ 1.4 Perform a final hydrologic analysis to compute design discharges for the proposed channel improvements. Bradford, Viliage Manager July 18, 1994 - Page 2 1.5 The finro culvert systems (48" and 54" diameter) selected will be analyzed and designed to handle the design storm event (25-year frequency) to eliminate the requirement of applying for a surface water management peRnit. Effects on existing drainage systems and surrounding properties will be determined by this final hydraulic analysis. 1.6 Provide a final cost estimate for construction of the two altematives and recommend the most cost effective altemative. 1.7 Prepare and submit a conceptual design plan and stormwater calculations to South Florida Water Management District (SFWMD) to demonstrate the ability of the proposed culverts to convey the design storm event and request a"No Permit Required" letter. 1.8 Prepare and submit two (2) responses to the DistricYs comments. 1.9 Attend two (2) meetings with the Village. Task 2: Dredge/Fill Permitting 2.1 Research and review existing data and reports relating to the history of Dover Ditch to demonstrate the ditch was constructed in an historical upland. 2.2 Visit the site and assess the biological resources to be used in permit condition negotia- tions. It is assumed mitigation will be required. 2.3 Prepare mitigation altemative analysis to show the type of mitigation and the required mitigation acreages and review same with the Vllage. 2.4 Locate a potential mitigation site. (16 hours max.) 2.5 Based on 2.4 above, prepare a mitigation plan and pneliminary cost estimate for acquisition of site and construc�ion of mitigation plan. 2.6 Prepare permit sketd�res and submit an application for a dredgeffill �rmit to SFWMD and U.S. Army Corps of Engineers (COE). 2.7 Attend one (1) site visit with the permitting agency staff. � 2.8 Prepare and submit two (2) response to the SFWMD's comments. (16 hours max.) Village of Tequesta Attn: Thomas G. Bradford, Village Manager July 18, 1994 - Page 3 2.9 Attend two (2) coordination meetings with the �Ilage. Task 3: Additional Services _ 3.1 As an additional service, the consultant will prepare and submit a permit application (MSS111n to South Florida Water Management District in the event the "No Permit Required" letter requested under Task 1.7 of the Scope of Services is not obtained. The effort (Task 3.1) will only be initiated after separate written authorization by the �Ilage. 3.2 Provide additional services as mutually agreed upon. Items to be Fumished by Client At No Expense to the Consultant Furnish at no cost to Consultant, title search and abstract of property, all permit application and Govemmental inspection fees; appropriate professional interpretations of all of the foregoing; other special data, all of which the Consultant will rely upon in performing services. It is agreed and understood that the accuracy and veraaty of said information and data may be relied upon by Consultant without independent verification of the same. Designate in writing a person to act as #he Client's representative with respect to the services to be performed under this Agreement. Such person shall have complete authority to transmit instructions, receive informa#ion, interpret and define the Clien#'s policies and decisions with respect to materials, equipment, elements and systems pertinent to the Consultant's services. Time of Performance Tasks 1 and 2 of the Scope of Services w+ll be completed within one-hundred finrenty (120) calendar days after receipt of Notice to Proceed, except for delays beyond the reasonable control of the Consultant. Said representation is not, however, a warranty or guarantee that said services will be completed within such time frame. Task 3 of the Scope of Services will be campleted as required. Fees to be Paid For Tasks 1 and 2 of the Scope of Services, the Consultant shall be paid a lump sum fee of Twenty Five Thousand Four Hundred Dollars ($25,400), in accordance with Section 4(C) of the existing Agreement with the �Ilage of Tequesta. None of the Tasks listed above include any professional services associated with the negotiation of, or implementation of a tri-party or interlocal agreemerrt with Palm Beach County and/or Jupiter concerning funding of this project. For Task 3.2 of the Scope of Services, for additional services, the Consultant shall be paid a fee equal to personnel costs times a factor of 2.3. Houriy rates and OT budget agreed to in writing with � Client. The fee for Task 3.1 of the Scope of Services will be a lump sum amount of $2,500. in accordance with Section 4(c) of our agreement with the Yllage of Tequesta.. In addition to the fees specified above, the Consultant shall be reimbursed for direct non-salary expenses, including, but not limited to, data processing, equipment rental, automobile travel at $0.33 per mile, long distance telephone, subsistence, prirrting and reproduction, plus Florida sales taxes, if applicable, (Task 3.2 of the Scope of Services). Invoices for services rendered are prepared monthly and are due and payable within thirty (30) days from date of the invoice. Past due statements shall include interest from the date of invoice at a compound interest rate of one and one half (1-1/2) percerrt per month. Payments which are not received within sixty {60) calendar days from the date of invoice will be considered sufficient cause for Consultant to discontinue performing and providing senrices until payment in full is received. If Consultant is required to take ac�ion to collect past due invoices, the Client will pay all legal fees and costs. This contract shall be govemed by the laws of the State of Florida, and the appropriate venue for any actions arising out of the agreement would be West Palm Beach, Florida. Code and Reaulatory Comptiance The Consultant prepares his work product based on known codes and interpretations and relies on his experience to evaluate their applicability. Input and comments are often sought from authorities having jurisdiction and in many instances, agreem�nts are reached which impact the work product. When situations arise such as code revisions, changes in interpretations, changes . Viliage of Tequesta Attn: Thomas G. Bradford, Village Manager July 18, 1994 - Page 5 to agreed upon direction, or work perFormed before required permits or agency approvals are received, the Consultant will take appropriate action subject to the direction of the Client. Services associated with these situations will be compensated for as additional services. Acceptance Acceptance of this proposal may be indicated by the signature of a duly authorized official of the Client in the space provided below. One signed copy of this proposal, returned to the Consultant, will serve as an Agreement between the two parties and as Notice to Proceed. This contract will be binding on the parties hereto and the parties' successors and assigns.
