SVBJECT: ENCON Tequesta Peninsnla Septfc Tank Study; Aqeada Ites
In light of Mayor Mackail's report concerning the Auqust ENCON
Board Meetinq, I believe we are forced to conclude the followiaq:
1) ENCON�s actions are such that they may seek Tequesta to
participate in funding of this Stndy.
2) ENCON intends for there to be no meaninqful role for our
citizens from thcse neighborhoods affected bp the proposed
Septic Tank Study. To date, ENCON has selected the consultinq
engineer to.undertake the work effort. Additionallp, without
any indication to the Villaqe as to its make-up, ENCON has
created a Technical Advisory Committee via its consultinq
engineers to direct the work of the chosen consultinq firm.
It is feared that the members of the Technical Advisory
Committee may have predetermined opinions on this issue.
Finally, ENCON has made no formal indication as to its
methodology, outline or approacb to this Septic Taak Study.
3) ENCON is not willinq to co�aait to the gravity sever system in
the event that pollution enoonntered in the River is
attributed to Tequesta septic tanks and cannot bes cbrrected.
This flies in the face of the ENCON Governinq Board previous
conunitments relative to provision of qravity sewers within the
Tequesta area. i recall certain Board Members statinq that
gravity sewer systems t�ould be the 'seweraqe eystem of first-
choice" for tbe Tequesta area fa the event that ENCO�i were to
chocse to move forward with installation of c�ntralized sever
systems. �

Based upon the foreqoinq, it is my recommendation that we write a
letter to ENCOtd indicatinq the followinq:
1) In liqht of the foreqofnq, Tequesta is.unable to endoree or
participste in your Tequesta Septic Tank Study and,
accordinqly, does not recognize the same.
2) By virtue of ENCON's failure to accept the conditions put
forth by the Villaqe of Tequesta, any recommendations of such
Septic Tank Study shall be of no value to the Villaqe of
Tequesta and its findinqs and recommendations relative to
centralized seweraqe systems shall be ignored since nothinq
causes us to adhere to its findinqs. �
3) In the event that the ENCON Septic Tank Study recommends a
centralized seweraqe system found to be unacceptable to the
people of Tequesta it will be fought agqressively at each and
every step in the process should ENCON choose to pursue tbe
same.
4) Sugqest the Mayor and Board Chairman of ENCON meet one on oae
in a last attempt to reverse this course. �
Copies of Mayor Mackail•s correspondence to ENCON and their
responses to the same are attached for your review in your efforts
to prepare an adequate response to the actions of ENCON.

Tequesta's participation in the Septic Tank Study. We carinot,
however, accept the pre-conditions you state. In order to preserve
the independent nature of the prxess, We ourselves are maintaininq
an arms length posture leaving the technical aspects of the progra�
up to independent experts.
I think it is appropriate for our staffs to identily and
coordinate your committee•s involvement in overseeing the effort.
�lccordinqly, I have asked Rick to follow up on his letter o! Jnly
21, 1994 and �vork with the villaqe as outlined in Toa Sradtord�s �
letter of I�pril 19, 1994 we will also include an appropriate itea

This is in response to your letter of May 31, 1994, and the follow-
up correspondence of June 17, 1994, requestinq the Villaqe of
Tequesta to participate in the establishment of a epecification for
a study initiated by ENCON to study the impact of septic tanks on
the Loxahatchee River Basin. We are eacouraged by pour Board'a
decision to apperently withdraw your penait application fQr a low-
pressure sewer system within any portion of Tequesta. Accordinqlp,
our response to your request has been ameaded as appears below.
At the request of your Executive Director made at a meetiaq with
our Villaqe Manaqer on April 14, 1994, the Villaqe Manaqer sougbt
Village Council direction reqardinq Tequesta participation in a
proposed ENCON Septic Tank Study at the Village Couacil Meeting on
April 14, 1994. The Villaqe Council responded that their wieh was
for Tequesta to be involved in the ENCON Septic Taak Studp by
solicitinq the direct involvement of citizeas from each area
potentially i.mpacted bp the installation of a sewer system. A copp �
of the Villaqe Manaqer's correspondeace of April 19, 1994, advisinq
your Executive Director of the Village Council's preferences in
this reqard, ia attached for your�reviev.

we believe that if the tollowinq conditions are n�et, Tequesta could
endorse and that the septic tank itudy could be eonsidered,
'Tequeste sponeored":
1) ENCON funds 100t ot the specificetion for the study and 100t
of the study itaeli.
2) The citizens volunteerinq from the ettected neiqhborhoods ars
quaranteed an active and meaninqful role �n the entirs studp
proceas, in addition to the preparation of th� speeification
for the study.
3) In the event that the study demonstrates conclusively thnt a
substantial neqative impact to the Loxahatchee River is
directly caused by septic taAks located solely within
Tequesta, and such problems cennot be corrected, then, in
keepinq with ENCON's previous public commitments in this
reqard, a more traditional and acceptable alternative to the
low-pressure sewer system, installed and funded by ENCON,
shall be the aqreed upon alternative for mitiqation if a
centrelized sewer system is recommended to address substantial
neqative impacts attributed soleiy to septic tanks located
within Tequesta, and problems from which cannot be corrected.
Lastly, please be advised that Tequesta's Comprehensive Development
Plan does not call for a septic tank study under the conditions pou
have refereaced. Tequesta, however, is willinq to sponsor ENCON's
funded study under the conditions referenced in the name of qood
interqovernmental coordination which is an important element of
Tequesta�s Comprehensive Developmeat Plaa.
We look forward to workinq toward a cooperative arranqement to
study the problems of the Loxahatchee River alleqed bp ENCON and to
rectify anp significant neqative fiadinqs in an acceptable manner
as referenced.herein. We would appreciate receivinq any and all
documentation ia the possessioa of ENCON regardinq your alleqatioa
that the Loxahatchee River does not meet state sta.ndarda.

Zn response to your request at our meeting on Thursday, April 14,
1994, wherein you requested a formal response reqardinq Tequesta
participation in the proposed ENCON Septic TaAk Study of the
Tequesta area, I brouqht the same up before the Villaqe Council at
�heir �eeting on April 14, 1994.
The Villaqe Council response is that they wish for Tequesta to be
involved in the Septic Tank Studp nominatinq a citize=r- €rom eaeh-- -� -
area po �entially impacted by the low-pressure sewer system proposal
to be izvolved in some fashion to oversee�the Study ia conjunction
with ENCON. Whether this would ba by formation of a citizeas
committee or use of a more ibformal process is open for discussion.
I understaad that pou would prefer for the neighborhood
representatives under this concept to have aa enqineerinq
background in order to facilitate understandinq of the iadependent
study process. It is also my understandinq that the pennit you are
seekiag for the i,nstallation of a low�ressure sewer systea
involves all neighborhoods upoa the •Tequesta peninsula' and those
areas within the corpa►rate limits of Tequesta, such as alonq
R.iverside Drive, fa that subdivisioa knovn as Riverside on the
Loxahatchee. Therefore, based npoa mp under8tanding of the area in
questioa and that directioa qiven by the Villaq� Conncil, Teqnesta
vill be seeking representatives from tbe followiaq areas within

By way o! update, the District awarded a contract to conduct
a septic tank-water quality study in Jupiter and � are on track to
initiate a study for the Tequesta peninsula rithin the next iew
months. �,lso, as you are aware, the permit application tor Lo�t
Pressure Sewers in Tequesta has been withdrawn and t�e look forward
to Tequesta�s participation in the study effort. I understand you
are a�aitfnq closure on the issue from the attorneys in Tallahassee
before initiatinq your involvement.
In my letter of June 17, I asked that our staff provide you
with information that the Loxahatchee River does not mest state
standards . In gatt�erinq tbis - inlormation it becase evident that
much of it is in Tequesta•s hand already and I a� forwardiriq it to
you so the record wfll show the appropriate elected officials are
directly informed. please be advised that T�ater Quality standards
established by the State of Florida Dave been violated ia the
waters of the Loxahatchee River (includinq the north and northvest
forks which bracket the Tequesta peninsula) for over 2o years.

- The Technical �,dvisory Committee finds that the continued
use of septic tanks within the urban portions o! the
watershed poses an additional potential threat to the areas
waters and recommer�ds that this issue ba prudently addressad
concurrent �vith the storm watar proqraa.
By way of specific example and based on data collected over
the past 33 months, the waters surrounding the Tequesta peninsula
have sho�m Dissolved Oxyqen levels below state atandards 29� o! the
time and Fecal Coliform Bacteria standards o! the Stste bave been
violated 51� of the time. The data also reflect exceedences in
nutrients, clarity parameters and the values for orqanic wastes.
Ron, ve still have a beautiful and viable resource, but tha
continued stewardship of qovernments like yours and airie �ie needed: ----- --- -
I know that your Town and ay District will continue to i,�plea�nt
ProQrams which will iaprove water quality and preserve the
lifestyle which our citizens now enjoy. Our staffs continus to
work jointly on storm water proqrams and I•� sure tbe septic tank
situation will be resolved in concert vith the District•s
responsibilities and your villaqe's Co�prehensive Plsn.

In August of 1991� the subject con,mittee was formed with
representatives of several local 9overnme�ts and put to wo�k assisting
the 8oard of the Loxahatchee River Oistrict 4n evaluating th�
sto�mwater management options available to our watershed. A year a9o,
that committee recommended that the Oistrict develop additional
technical information and get a better understanding of public
perception before proceeding with this pollution prevention p�o9ram.
The participation of your government in that process was both valued
and appreciated.
Ove� the past year, the District 8oard, staff, and consultants have
learned �uch from two new committees - a technical adviso�y coemittee
and a citizens adviso�y committee. The reports ot these co�mittees
were finalized and submitted to the Board quite recently and copias of
their meeting minutes and recommendations are enclosed fo� your revie+�+.
It is now time to reactivate the Governmental Advisory Comaittee and
we hope you will continue to participata. We will convene a aieetin�
of the Gcvernment Advisary Con�ittee on:

2- The Technical Advisory Can�nit�ee finds that a substaatial
amount of useable water quality data has beea collected over the
past 19 years aad this iaformatioa receatly beea consolidated
into a manaqeable format.
Five aqencies, the Florida DER, the Federal tiSGS,
the Regional Water Managemeat District, the Couaty
Environmental Resource Aqency aa�..the local Loxabatcbe+�
River District, have each collected water quality data oa
the river system. withia the past eighteea months, tbe
individual inf ozmatioa froa� each of these saurces has
been combined. DER and USGS data v�ere consolidated
and reviewed under studies conducted by La�r
Environmental for th�e Jupiter Inl+et District. The
Couaty an$ LRECD data was cambiaed aad published by ths'
Loaahatchee 8iver District through its c:onsu].taats 8azen
aad Sawyet. Over t�e last 6 montt�ss each of these data
sources was plac�d ia the ' STORLT• water s��ty -
database system aad made available for evaluatioa.

At the prior meetinq of the con�ittee it was requested that
staff attempt to determine, more specifically, what areas of th�
river exh.ibited the worst qualitative coaditions, lendinq to
violations of standards.
Mr. Dent provided respo�ase to this request, revie�ing the .
"segments" of the river, and data provided by STO�tET to date.
An information package was provided to the cou�ittee members
which included a map of the sampliag locations ia the rives .
basin, with a description of the locatioa and the parameters
monitored, a.nd also included var3ous tables developed to isolate
specific pollution sources.
Analysis was coaducted first, by co�aparison cf the 8istoric
water Quality Means for each of the 5 river segmeats, aad for
nine parameters. .
The neat analysis identifted the 3•worst' quality statioas ot
the nine most sa:apled locations oa t.�e river. Statioa�s #69 ��llw
� Fork at SR ?06) aad #55 tN Fork at CountY Liae Rd) �ce '
ideatified as beinq in the worst cateqorY for 4 0� t�e 6
parameters monitored. Station #71 IJ�� �� at C�ater
Street) was indicated ia the �rst 3 for 3 para�et�s's aad .
station� #81 �Freshwater C-i8) ,and #62 (1�1 Foilt at 2alaadway) '-
were identified as beiaq ia the 'arorst' cateqory for 2
parameters. Cleuly all of the •worst' statio�s wer� lo�ated ia
the freshwater reaches of the siver and its pr3msY trib�ttaries.
.A��:��onal�y, Mz. Dent zeviewed the mean watez qual:ty f:om each
.- o: t�e stations alonQ :he Wild � Scenic seqment ot the z:ver,
=rom t:�e Es:uary to Jupi�er Farms, tor nin� parameters to
determiae if there ue any treads in quality trom one area to
' the ather.
Each of 23 stations, in 5 river seqna�ats, was looked at toz tb�
1992 period, to determiae tbe percent of times each station
was in violatioa of the Hi�toric Mean, !or that se�ent of tb�
rivez. Riverwide, parameters aze violated,aa avesaqe ot 32�
ot the tim�.
The freguency of violations ranQe fro� 27� ia th� Class Z=I
Marine Segmeat of the river to 39� ia tha Class 22I �tsstsra
Tributaries. Occurreace og violatioas appear more fr�queatlY ia
the freshwater portioas of the ziver.
when seasonal variations weze taken iato consideratioa, .
violations Were most frequeat duriaq the July-J�uquat period
(36�) and oaly slightly less frequeat ia Oct-November t31�),
nearly twice as fregueat as samples durinq the January to i�tay
. period.
Review of water quality samples was also provided by Mr. Dent
which indicated the percentage of violatioas in 1992 by
parameter, withia the 5 segment$ of the river•
Discussioa was held by the coamaittee about Mr. Dent's report aad
it's fiadinqs. It was concluded that althouqh there was no
•'smokiag gua" to point to a specific culprit ia creatiaq th�
violations, the violations were si9nificaat enouqh to warraat -
efforts to correct conditions. The river is clearly aot meetinq
the standards which the co�munity encouraged, aad the Sta't�
adopted, to afford the highest levels of protectioa.
Members of the conanittee suqqested that additional data be
developed and reviewed in reqard to seasonal variations, to
further substantiate the effect of stonawate�. It `ras also
,suqqested that shorter term "means" be looked at for
