Bradford, Villaqe Manaqer ����� DATE: September 1, 1994 SVBJECT: ENCON Tequesta Peninsnla Septfc Tank Study; Aqeada Ites In light of Mayor Mackail's report concerning the Auqust ENCON Board Meetinq, I believe we are forced to conclude the followiaq: 1) ENCON�s actions are such that they may seek Tequesta to participate in funding of this Stndy. 2) ENCON intends for there to be no meaninqful role for our citizens from thcse neighborhoods affected bp the proposed Septic Tank Study. To date, ENCON has selected the consultinq engineer to.undertake the work effort. Additionallp, without any indication to the Villaqe as to its make-up, ENCON has created a Technical Advisory Committee via its consultinq engineers to direct the work of the chosen consultinq firm. It is feared that the members of the Technical Advisory Committee may have predetermined opinions on this issue. Finally, ENCON has made no formal indication as to its methodology, outline or approacb to this Septic Taak Study. 3) ENCON is not willinq to co�aait to the gravity sever system in the event that pollution enoonntered in the River is attributed to Tequesta septic tanks and cannot bes cbrrected. This flies in the face of the ENCON Governinq Board previous conunitments relative to provision of qravity sewers within the Tequesta area. i recall certain Board Members statinq that gravity sewer systems t�ould be the 'seweraqe eystem of first- choice" for tbe Tequesta area fa the event that ENCO�i were to chocse to move forward with installation of c�ntralized sever systems. � � P� � KBKO: Villag• Council � Page 2— M�M���N Based upon the foreqoinq, it is my recommendation that we write a letter to ENCOtd indicatinq the followinq: 1) In liqht of the foreqofnq, Tequesta is.unable to endoree or participste in your Tequesta Septic Tank Study and, accordinqly, does not recognize the same. 2) By virtue of ENCON's failure to accept the conditions put forth by the Villaqe of Tequesta, any recommendations of such Septic Tank Study shall be of no value to the Villaqe of Tequesta and its findinqs and recommendations relative to centralized seweraqe systems shall be ignored since nothinq causes us to adhere to its findinqs. � 3) In the event that the ENCON Septic Tank Study recommends a centralized seweraqe system found to be unacceptable to the people of Tequesta it will be fought agqressively at each and every step in the process should ENCON choose to pursue tbe same. 4) Sugqest the Mayor and Board Chairman of ENCON meet one on oae in a last attempt to reverse this course. � Copies of Mayor Mackail•s correspondence to ENCON and their responses to the same are attached for your review in your efforts to prepare an adequate response to the actions of ENCON. We are eacouraged by pour Board'a decision to apperently withdraw your penait application fQr a low- pressure sewer system within any portion of Tequesta. Accordinqlp, our response to your request has been ameaded as appears below. At the request of your Executive Director made at a meetiaq with our Villaqe Manaqer on April 14, 1994, the Villaqe Manaqer sougbt Village Council direction reqardinq Tequesta participation in a proposed ENCON Septic Tank Study at the Village Couacil Meeting on April 14, 1994. The Villaqe Council responded that their wieh was for Tequesta to be involved in the ENCON Septic Taak Studp by solicitinq the direct involvement of citizeas from each area potentially i.mpacted bp the installation of a sewer system. Lastly, please be advised that Tequesta's Comprehensive Development Plan does not call for a septic tank study under the conditions pou have refereaced. Tequesta, however, is willinq to sponsor ENCON's funded study under the conditions referenced in the name of qood interqovernmental coordination which is an important element of Tequesta�s Comprehensive Developmeat Plaa. By way of specific example and based on data collected over the past 33 months, the waters surrounding the Tequesta peninsula have sho�m Dissolved Oxyqen levels below state atandards 29� o! the time and Fecal Coliform Bacteria standards o! the Stste bave been violated 51� of the time. The data also reflect exceedences in nutrients, clarity parameters and the values for orqanic wastes. A year a9o, that committee recommended that the Oistrict develop additional technical information and get a better understanding of public perception before proceeding with this pollution prevention p�o9ram. The participation of your government in that process was both valued and appreciated. Ove� the past year, the District 8oard, staff, and consultants have learned �uch from two new committees - a technical adviso�y coemittee and a citizens adviso�y committee. Five aqencies, the Florida DER, the Federal tiSGS, the Regional Water Managemeat District, the Couaty Environmental Resource Aqency aa�..the local Loxabatcbe+� River District, have each collected water quality data oa the river system. withia the past eighteea months, tbe individual inf ozmatioa froa� each of these saurces has been combined. DER and USGS data v�ere consolidated and reviewed under studies conducted by La�r Environmental for th�e Jupiter Inl+et District. The Couaty an$ LRECD data was cambiaed aad published by ths' Loaahatchee 8iver District through its c:onsu].taats 8azen aad Sawyet. An information package was provided to the cou�ittee members which included a map of the sampliag locations ia the rives . basin, with a description of the locatioa and the parameters monitored, a.nd also included var3ous tables developed to isolate specific pollution sources. Analysis was coaducted first, by co�aparison cf the 8istoric water Quality Means for each of the 5 river segmeats, aad for nine parameters. . The neat analysis identifted the 3•worst' quality statioas ot the nine most sa:apled locations oa t.�e river. Each of 23 stations, in 5 river seqna�ats, was looked at toz tb� 1992 period, to determiae tbe percent of times each station was in violatioa of the Hi�toric Mean, !or that se�ent of tb� rivez. Riverwide, parameters aze violated,aa avesaqe ot 32� ot the tim�. The freguency of violations ranQe fro� 27� ia th� Class Z=I Marine Segmeat of the river to 39� ia tha Class 22I �tsstsra Tributaries. Occurreace og violatioas appear more fr�queatlY ia the freshwater portioas of the ziver. when seasonal variations weze taken iato consideratioa, . violations Were most frequeat duriaq the July-J�uquat period (36�) and oaly slightly less frequeat ia Oct-November t31�), nearly twice as fregueat as samples durinq the January to i�tay . period. Review of water quality samples was also provided by Mr. Dent which indicated the percentage of violatioas in 1992 by parameter, withia the 5 segment$ of the river• Discussioa was held by the coamaittee about Mr. Dent's report aad it's fiadinqs. It was concluded that althouqh there was no •'smokiag gua" to point to a specific culprit ia creatiaq th� violations, the violations were si9nificaat enouqh to warraat - efforts to correct conditions. The river is clearly aot meetinq the standards which the co�munity encouraged, aad the Sta't� adopted, to afford the highest levels of protectioa. Members of the conanittee suqqested that additional data be developed and reviewed in reqard to seasonal variations, to further substantiate the effect of stonawate�.
